Based on a preliminary evaluation without a formal or complete application,the project appears to trigger Erosion Control,Wetland Protection, and Stormwater Management rules. Other rules may be found to be triggered as additional information is submitted and reviewed. Stormwater Management: http://m innehahacreek.org/permits/full-mcwd-rules/stormwater-management-rule 1. This project will trigger our Stormwater Management rule as the proposed project will likely result in an increase in impervious surface.The project will be considered "redevelopment" as the project will create new impervious surface. A stormwater management plan will need to be submitted to the District.The treatment requirements of the rule will depend upon the amount of site disturbance and impervious surface created. a. For example, for sites that are greater than one acre and the proposed activity disturbs less than 40 percent of the site and results in an increase in impervious surface of less than 50 percent,the phosphorus control requirements of subsection 3 (a), rate control requirements of subsection 3(b) and volume control requirements of subsection 3(c) apply to the area of increased impervious surface; b. For sites that are greater than one acre and the proposed activity disturbs 40 percent or more of the site, or results in an increase in impervious surface of 50 percent or more,the phosphorus control requirements of subsection 3(a), rate control requirements of subsection 3(b), and volume control requirements of subsection 3(c)apply to the entire site's impervious surface. According to the District's FAW,there are three wetlands on site.The wetlands to the east of the existing arena and parking lot are classified as Manage 3 wetlands,which require a 20-ft buffer.The wetland to the south of the arena is classified as a Manage 1 wetland, which requires a 40-ft buffer. Wetland buffers are a naturally vegetated, no-mow area. 1 2. Buffer widths may vary based on demonstrated site constraints, provided that a width of at lead 50%is maintained at all points, there is no reduction in total buffer area, and the buffer provides wetland and habitat protection at least equivalent to a buffer of uniform width. 3. A wetland delineation will be required to determine the wetland and buffer edges. 4. Depending on if there is disturbance within the buffer, you may be required to submit a planting plan, maintenance plan and monitoring. Erosion control is triggered for any project over 5,000 square feet of disturbance or 50 cubic yards of grading, excavating or fill on site. 2. Requirements include an erosion control plan that indicates proposed runoff control, erosion prevention, sediment control and temporary and permanent soil stabilization measures. The District's Financial Assurance Rule may also be triggered depending on the size of the activity, wetland alterations and stormwater requirements. It was our conclusion that there are no apparent issues that cannot be resolved by careful site planning. The addition as presented would appear to meet lot line setback requirements, and absent a final wetland delineation, it appears from available airphotos that the City's 35' wetland setback requirement will likely not be an issue. We discussed parking needs and the fact that the site is on the same parcel as the high school and ample overflow parking is available on the site. Traffic circulation was discussed and the idea of a drop-off lane makes sense. The loss of some vegetative screening at the site of the addition is not considered to be significant. We did bring up the issue of the need for screening of the mechanical equipment at the north end of the building, which should be addressed as you move forward. The addition will require approval of a Conditional Use Permit by the City Council,for which we provided you with an application packet. The School District as owner of the land should be a co-applicant. If at any time you have questions about the application process, please feel free to call or email me. The Arena Board is requesting a summary of our meeting,while not official, would give them comfort to know the City has looked at it and believe the project fits in the City's guidelines and should hit major stumbling blocks.
