A RESOLUTION GRANTING
A CONDITIONAL USE PERMIT
FOR LAND ALTERATION WITHIN THE SHORELAND ZONE
PER SECTION 78-966
FILE NO. 08-3349
WHEREAS, Independent School District No. 278, a public corporation,
(hereinafter "the Owner") is the owner of the property located at 685 Old Crystal Bay Road
North within the City of Orono (hereinafter the "City") and legally described as Government
Lot 1, Section 33, Township 118, Range 23 West of the 5th Principal Meridian, Hennepin
County, Minnesota; and
WHEREAS, the Owner has made application to the City of Orono for a
conditional use permit per Orono Municipal Zoning Code Section 78-966 to allow deposit of
approximately 15,000 cubic yards of fill material within the shoreland zone; and
WHEREAS, after due published notice and mailed notice in accordance with
Minnesota Statutes and the City of Orono Zoning and Planning Codes, the Orono Planning
Commission held a public hearing on February 19, 2008, at which time all persons desiring to
be heard concerning this application were given the opportunity to speak thereon.
NOW, THEREFORE BE IT RESOLVED by the City Council of Orono,
Minnesota:
FINDINGS
1. This application was reviewed as Zoning File#08-3349.
2. The Planning Commission reviewed this application on February 19, 2008 and
on a vote of 5 - 0 recommended approval of the conditional use permit for land
alteration.
4. The City Council has considered this application including the
recommendation of the Planning Commission, reports by City staff, comments
by the owners and the public, and the effect of the proposed land alteration on
safety and welfare of the community.

CONCLUSIONS, ORDER AND CONDITIONS
Based upon the above findings, the Orono City Council hereby grants a conditional
use permit to place approximately 15,000 cubic feet of fill excavated during renovation of the
high school football stadium in the area immediately south of the stadium, subject to the
following conditions:
1. Council approval is based on the grading plan submitted by the owners attached to this
Resolution as Exhibit A. Any amendments to this plan may require further Planning
Commission and City Council review.
2. Compliance with the MCWD permit.
3. Authorities granted by this resolution run with the property not with the owner, but are
permissive only and must be exercised by obtaining a land alteration permit for the
work before February 25, 2009 or the conditional use permit will expire on that date.
4. Violation of or non-compliance with any of the terms and conditions of this resolution
shall constitute a violation of the zoning code, shall automatically terminate any
authority granted herein, and shall be punishable as a misdemeanor.
5. The undersigned Owner has read, understands, and hereby agrees to the terms of this
resolution and on behalf of the owner and the owner's heirs, successors and assigns,
hereby agrees to the recording of this resolution in the chain of title of the property.
Adopted by the Orono City Council on the 25th day of February, 2008.
