G RESOLUTION OF THE CITY COUNCIL �; ��,� NO. 6 0 6 9 ESHgO • A RESOLUTION GRANTING PRELIMINARY PLAT APPROVAL, APPROVING VACATION OF EASMENTS AND APPROVING THE FINAL PLAT OF • CRYSTAL BAY BUSINESS CENTER 2ND ADDITION FILE#11-3513 • WHEREAS, the City of Orono is a municipal corporation organized and existing under the laws of the State of Minnesota; and • WHEREAS, the City Council of the City of Orono (hereinafter"City Council") has adopted subdivision and land development regulations for the orderly, economic and safe development of land within the City; and WHEREAS, the City Council has considered the application by Ryan Companies US Inc., a Minnesota corporation (hereinafter"Developer"), for subdivision of properties located at 450 Old Crystal Bay Road North and 550 Old Crystal Bay Road North and legally described as: Lot 1 and Lot 2, Block 2, Crystal Bay Business Center, Hennepin County, Minnesota (hereinafter"the Property"); and . WHEREAS, on June 21, 2011, the. Developer filed a complete subdivision application with the City for approval of a two-lot commercial re-plat of the Property; and WHEREAS, after due published and mailed notice in accordance with Minnesota Statutes 462.358 et seq. and the City of Orono Zoning and Subdivision Codes, on July 18, 2011, the'Orono Planning Commission held a public hearing for the application at which time all persons desiring to be heard concerning the application were given the opportunity to speak thereon; and • WHEREAS, after due published and mailed notice in accordance with Minnesota Statutes 462.358 et. seq. and the City of Orono Zoning and Planning Codes, the Orono Planning Commission held a public hearing on the proposed vacations at a regular meeting held on July 18, 2011 and in consideration of the following findings the Planning Commission finds the vacation as proposed is in keeping with the public interest: 1. The gas, electric, telephone and cable companies have consented to the vacation. . 2. The City Engineer finds the vacation acceptable. 3. New drainage and utility easements in the appropriate widths and locations determined .by the City Engineer will be granted to replace the easements being vacated. • • Page 1 of 4 p i Guaranty Title,Inc. Box 163 .1.04p 0 CITY of ORONO .t A',A RESOLUTION OF THE CITY COUNCIL 44E00' NO. . 6069 WHEREAS,on July 18, 2011, the Planning Commission reviewed the application and recommended on a vote of 6—0 that the Council grant preliminary plat approval; and WHEREAS, the Developer has submitted preliminary plat and final plat drawings for a re-plat of Lots 1 and 2, Block 2 Crystal Bay Business Center, to create a new plat entitled Crystal Bay Business Center Second Addition; and WHEREAS, the Developer has agreed to execute the First Amendment to Development Agreement Crystal Bay Business Center(collectively the "Agreement')which sets forth terms and conditions for the existing metal building on Lot 1, Block 2, Crystal Bay Business Center; and WHEREAS, the Developer has completed or has agreed to complete'all other requirements of the platting regulations of the City including: 1. Completion of all platting requirements of the Crystal Bay Business Center. 2. Dedication on the plat of perimeter Drainage and Utility Easements. 3. Submittal of Minnehaha Creek Watershed District(MCWD) permit approving the grading and stormwater management facilities plan for further development of the Property. 4. Payment to the City for the legal review and filing of the plat documents, agreements, easements and covenants in the amount of $280.00 plus incurred review and filing costs. 5. Payment of the Final Plat Review Fee in the amount of $700.00 plus incurred legal, engineering and planning consultant charges. 6. Provide to the City a title opinion for the Property and certified copies of all recorded easements currently affecting the Property. 7. Conformance with the Crystal Bay Business Center Development Agreement dated December 5, 2007 which sets forth terms and conditions for the development of the Property. 8. RESOLUTION OF THE CITY COUNCIL NO. LoDGOC/ �9k'ESA04� NOW, THEREFORE, BE IT RESOLVED the City Council of the City of Orono does hereby grant preliminary plat approval including the vacation of the existing drainage and utility easements along the common lot line of Lots 1 and 2, Block 2, Crystal Bay Business Center, and approves the final plat of Crystal Bay Business Center Second Addition, Hennepin County, Minnesota (a copy of which is attached as Exhibit A) subject to the following conditions: 1. Development within the Crystal Bay Business Center and Crystal Bay Business Center Second Addition is subject to the Development Agreement Crystal Bay Business Center dated December 5, 2007 and recorded with the Office of the Registrar of Titles for Hennepin County, Minnesota as Document Nos.9079458 and 4457476. 2. Development within the Crystal Bay Business Center and Crystal Bay Business Center Second Addition is also subject to the execution of the First Amendment to Development Agreement Crystal Bay Business Center. 3. The approvals granted in this Resolution shall become effective only when all conditions of approval requiring actions by the Developer have been satisfied. 4. Upon approval of this Resolution and completion by the Developer of the requirements set forth in this Resolution, the City Council shall direct the Mayor and Clerk to execute other documents required, subject to approval by the City Attorney. 5. The City Clerk shall release the plat documents for filing only upon certification by the City Attorney, Planning & Zoning Coordinator and City Engineer that all requirements of the platting regulations have been satisfied. 6. The aforesaid plat shall be filed by the City of Orono with the Hennepin County Registrar of Titles Office on or before February 22, 2012 together with a certified original copy of this resolution and executed copies of the easements, agreements and covenants pertinent thereto. The Final Plat approval granted by this Resolution shall expire six months from approval date (February 22, 2012) If the conditions of this Resolution have not been met or the plat has not been filed by the date specified above. The Preliminary Plat approval granted by this Resolution shall expire one-year from the approval date (August 22, 2012). In that event, it will be necessary to file a new application with the City of Orono for subdivision review. Adopted by the City Council of Orono this 22nd day of August, 2011.
