PARTIAL RELEASE OF ENCROACHMENT AGREEMENT
AGREEMENT made this 13th day of February, 2012, by and between the CITY OF
ORONO, a Minnesota municipal corporation("City"); and RYAN COMPANIES US, INC., a
Minnesota corporation ("Developer").
1. BACKGROUND. Certain real property, Orono Industrial Boulevard, with the
City of Orono, County of Hennepin, State of Minnesota has been dedicated to the City of Orono
(the "Subject Property"). The City granted the Developer permission to encroach upon the
Subject Property pursuant to an Encroachment Agreement dated December 5, 2007 and filed of
record on January 17, 2008 as Document No. 9086547 in the office of the Hennepin County
Recorder and also filed of record on January 8, 2008 as Document No. 4459627 in the office of
the Hennepin County Registrar of Titles. The City and the Developer desire to release a certain
parcel of property described on Exhibit "A" attached hereto from the existing Encroachment
Agreement.
2. RELEASE OF ENCROACHMENT AGREEMENT. The parties hereby
release in the existing Encroachment Agreement as it relates to the real property described in
Exhibit "A" attached hereto.
3. RECORDING. This Partial Release of Encroachment Agreement shall be
recorded against the title to the Subject Property and shall run with the land.
