HomeMy WebLinkAboutResolution 5715 1 0 O O CITY of ORONO "* 4 f4 RESOLUTION OF THE CITY COUNCIL 0%.4`9kEs-tow NO. 5 7 1 5 A RESOLUTION GRANTING PRELIMINARY APPROVAL OF A CLASS II SUBDIVISION AND OF A PLANNED RESIDENTAL DEVELOPMENT FOR PROPERTY LOCATED AT 2940 SIXTH AVENUE NORTH FILE NO. 07-3332 WHEREAS, on October 16, 2007, acting on behalf of Stonegate Farm, Inc., PRC Development Company, (hereinafter the "Developer") filed an application with the City for approval of a six unit Planned Residential Development on property legally described attached as: That part of the East Half of the Southwest Quarter of Section 28, Township 118, Range 23, Hennepin County, Minnesota, lying north of the centerline of County Road No. 6 as monumented and platted in the plat of Hennepin County State Aid Highway Number 6, Plat 5, Hennepin County Minnesota, according to the Government Survey thereof. The north, east, and west boundary lines of said tract have been marked by Judicial Landmarks set pursuant to Torrens Cases Nos. 17158 and 18135 (hereinafter"the Property"); and WHEREAS, on October 16, 2007, acting on behalf of Stonegate Farm, Inc., the Developer also filed a subdivision application with the City for approval of the plat of the Property to correspond to the proposed Planned Residential Development. WHEREAS, after due published and mailed notice in accordance with Minnesota Statutes 462.358 et. seq. and the City of Orono's Zoning and Subdivision Codes, the Orono Planning Commission held a public hearing on November 19, 2007, at which time all persons desiring to be heard concerning this application were given the opportunity to speak thereon; and WHEREAS, at their regular meeting held on December 10, 2007, the Orono City Council considered the applications of the Developer noting the following findings of fact: 1. The property is located within the RR-1B One Family Rural Residential Zoning District requiring a minimum of two acres of contiguous dry buildable land within each newly created building lot. 2. The property contains a total of approximately 24.63 acres of land; approximately 14 acres of which is delineated wetland. The proposed development and plat consists of six residential lots and two outlots, one for the private road and one for common area. Within the common area are a wetland and a significant stand of maple trees. 4. A Planned Residential Development is an alternative to standard minimum lot size subdivision of land. Its purpose is to enhance the appearance of neighborhoods through preservation of natural open spaces, to counteract the effects of urban congestion and monotony, to provide cohesive structure to neighborhood design, to offer recreation opportunities close to home, and to aid in improving the welfare in general of city residents. The proposed development is consistent with these purposes. 5. The proposed development is generally consistent with conservation design principles. 6. The development will be served by a cluster septic system. Each residence shall have its own collection tank. A common sand filter and drainfield will be located within the common area. Primary and alternate drainfield sites meeting all pertinent standards have been identified. 7. The development will be served by City water. 8. Access will be from a new private road from Homestead Trail. 9. The Developer has agreed to provide a seven-foot easement for a future trail along Homestead Trail and a ten-foot easement for possible future relocation of the existing trail along Sixth Avenue North. NOW, THEREFORE, BE IT RESOLVED, that based on the findings noted above, the City Council of the City of Orono hereby approves the preliminary Planned Residential Development and preliminary plat applications per preliminary plans and plat drawings by David Nash dated October 16, 2007 and attached as Exhibit A, subject to the following conditions: 1. The final site, grading, utility, landscaping and buffer improvement plans shall address the concerns expressed by the City Engineer (in letter dated November 1, 2007) and Wetland Consultant (in memorandum dated November 1, 2007). 2. The right of way of the private road shall be increased to 50 feet; front setbacks may be reduced to 25 feet. All the development covenants shall become part of the PRD approval and enforceable by the City. 5. Any perimeter fence shall be a 60-inch high, four board English horse fence. This kind and height of fence is consistent with the Rural Oasis theme and the character and scale of the proposed development. It will also delineate the common area as being part of the development and not a public park or vacant land. The design and location of the fence shall be shown on the final development plans. 6. The Developer shall provide an easement for a future trail along Homestead Road and Sixth Avenue. 7. All plantings that are part of the PRD landscaping shall be native materials. (Plantings by homeowners on the house lots shall not be regulated except within the wetland buffer.) 8. The developer shall grant to the City 10 foot drainage and utility easements along perimeter property boundaries and adjacent to Outlot B. Other drainage, and drainage and utility easements shall be included on the plat where the City Engineer determines necessary, based on the final utility and drainage plans. 9. Outlot A shall be deeded to the Homeowners' Association for use as common area. It shall be restricted to septic, recreational, scenic, and conservation purposes by covenants. These covenants shall not be defeated or eliminated without the consent of the City Council. 10. Outlot B shall be deeded to the Homeowners' Association. 11. Developer shall execute a Flowage And Conservation Easement And Restrictive Covenant For Wetland And Wetland Buffer for the wetlands. 12. Payment of standard park dedication fee and standard storm water and drainage trunk fee. Developer is hereby advised that these preliminary approvals will expire on January 14, 2009. Record plat drawings in the form of two (2) Mylar copies and one (1) Mylar copy reduced to 1" = 200'. Drawings to include: a. Lot lines per preliminary plat. b. Ten foot drainage and utility easements along perimeter development boundaries and adjacent to Outlot B. Other drainage, and drainage and utility easements as the City Engineer determines necessary. c. Dedication of a drainage and utility easement over Outlot B. d. Dedication of drainage easement over the delineated wetlands. e. The name of plat. 2. Legal documents: a. Title opinion addressed to the City. b. Certified copies of all recorded easements currently affecting the property. c. Signed and executed Developer's Agreement. d. Signed and executed Flowage and Conservation Easement over the wetlands and buffer. e. Signed and executed trail easement. f. "Declaration of Covenants, Conditions, Restrictions and Private Roadway Easement" as well as an easement to the City for road over Outlot B. g. Homeowners Association Articles of Incorporation and Bylaws. h. Signed and executed deeds conveying Outiots A and B to the Homeowners Association. Complete and correct final site, grading, utility, landscaping, fence, and buffer improvement plans acceptable to the City Engineer and Wetland Consultant. 4. Fees: a. Final plat and PRD fee: $250.00 b. Legal review and filing fees for subdivision and associated documents: $280.00 c. Park dedication fee, amount to be determined. d. Storm water and drainage trunk fee, amount to be determined. 5. Either a copy of the MCWD permit or information from the MCWD indicating their conditional approval of the permit.
