Box 66 Crystal Bay, Minnesota 55323 Re: Building Permit # 000297 265 Old Crystal Bay Road North Dear Mr . Jacobs : On 8 October 1987 , I renewed the building permit for the construction of my residence at 265 Old Crystal Bay Road North. For the renewal , I paid a Base Fee of $1 , 228 . 00 , and a Surcharge of $208.75, for a Total Fee of $1, 436 .75. This additional fee represents an extreme financial burden to me . I also do not think that this result was intended by Section 12. 05, Subd. l of the Municipal Code. I recognize that the ordinance does state that a full new permit fee should be paid if a certificate of occupancy has not been issued. But that section also makes clear that the reason for the fee is "to reimburse the City for ongoing and more than normal number and cost of inspection services. " My original building permit fee ($2, 475. 00) fully covered the City' s costs for this work and these inspections. There have been no unusual requirements on the time of City inspectors and personnel on this project. Furthermore, only the footing and framing inspections have been performed at this time. Under these circumstances, my payment of any portion of this new fee represents a windfall to the City and just seems unfair to me . I could understand some additional fee if it could be shown that the City has been or would be subjected to the expenditure of costs or time beyond what it ordinarily would have had under the original permit. But I do not believe that is the case. Accordingly, I would respectfully request a full refund of the $1, 436 .75 fee. Thank you for your consideration. Very truly yours, r� Off 1 61987 Scott K. Jacobs : Building Permit # 5798 was issued to me on 11 October 1985 for construction of my residence at 265 Old Crystal Bay Road North. In the total fee for that permit , a "SAC Charge" was included. I understand that it may not have been appropriate for that SAC Charge to have been assessed for this construction. Accordingly, I would respectfully request a refund of the SAC Charge for Building Permit # 5798 , dated October 11, 1985. . Thank you for your consideration. Box 66 Crystal Bay, Minnesota 55323 Re: Leaded Glass Windows Building Permit # 000297 265 Old Crystal Bay Road North Dear Mr. Jacobs : Confirming our telephone conversation, I will be installing two (2) adjoining leaded glass windows in the dining room on the south wall of my house. These windows are shown on the plans as submitted. Each window is approximately 5. 5 feet wide by 6. 3 feet tall . Each window has individual lights of 4. 5 inches by 8 inches, or smaller. These windows will be set into frames with insulated glass exterior panels constructed by Pella. The windows will then be installed more than eighteen (18) inches above the outside, finished grade. As we discussed, the exterior glass panels will not need to be safety or plate glass because (1) the windows will be more than 18 inches above the outside, finished grade, and (2) the windows are leaded glass windows and consist of small lights throughout. Mr. Goldsmith is requesting a full refund which the ordinance does not allow nor does the building code. Therefore, a refund of $614.00 should be' refunded pursuant to the above ordinance change. The City has reviewed the ordinance and felt that a change should be made to this section of the code. After considering your proposal and. reviewing, the code, it was decided by staff and Council that 1/2 the building permit fee should be charged along with the State surcharge. Therefore the City is refunding $614.00 which is 1/2 the building permit fee paid.
