SECTIONS 78-1288 AND 78-30�

and «-ife (hereinafter "the applicants") are the owners of the property located at 377�
Bayside Road within The City of Orono (hereinafter the "City") and leball}r described as
follo�vs:

(hereinafter the "property"); and
�'I�EREAS, the applicants have made application to the City of Orono
for variances to Orono Municipal Zonin` Code Sections 78-1288 and 78-30� to allow
construction of a 12' x 12' shed where hardcover in the 0-250' zone is proposed at 30%
where 0% is nornlally permitted in tlle 0-7�' zone and 2�% is normally permitted in the
7�'-?50' zone and 30% in the 0-2�0' zone currently exists and ��-as approved by variance
in June of 2004, and a street/rear yard setback variance to perniit the shed to be located
21' from the property :ine �vhere 50' is normall�� required and the ?listin� holne was
permitted bv variance to be setback 21' from the property line.

l. This application was reviewed as Zoning File OS-3142.
2. The property is located in the LR— 1l�, Qne Familv Lakeshore Residential
Zonin� District, which requires a nlinimum lot area of 2.0 acres and a
minimum lot ��idth of 200' at the shoreline and required 7�' lal:e se�tback.
3. The Planning C�oininission reviewed this application at a public hearing �
held oi� October 17. 200� and rzconlinended denial of the requeste�d
variances based on a City policy of not allo���in� tradin� of non-structural

hardcover for stitiictural hardcover. The City Council review this
application at their meeting of November 14, 2005 and recommended
approval of the variances based on the following findings:
a. The proposed hardcover level in the 0-250' zone will have a net
decrease of 3.5 s.f. of hardcover and remain unchanged at 30%.
b. No new hardcover is proposed within the 0-75' zone.
c. The shed will not be located any closer to the road than the existing
hoine.
d. Lot coverage by stn.ictures remains confornling at 6.4%.
e. The proposed location of the shed is in confornlance with all wetland
regulations.
£ The proposed location of the shed will not impact adjacent residence's
views to the lake.
g. The shed will be screened by existing coniferous trees located partially
within the applicants' property and the right-of-way of Bayside Road.
h. No other more confonnin� location exists on the property.
i. The findings and conditions of variance Resolution#5198, approved in
June of 2004, will not be impacted.
4. The �City Cotilncil has considered this application including the findiil�s
and recommendation of the Planning Cominission, reports by City staff,
conunents by the applicants and the public, and the effect of the proposed
variances on.the health, safety and welfare of tlie community.
5. The City Council finds that the conditions existing on this property are
peculiar tio it and do not apply generally to other property ill this zoning
district; that granting fl1e variances would not adversely affect traffic �
conditions, light, air nor pose a fire hazard or other danger to neighborin�
property; would not inerely serve as a convenience to the applicants, but is
necessary to alleviate a demonstrable hardship or difficulty; is necessary to

preserve a substantial property ribht of the applicants: and would be in
keepin� with the spirit and intent of the Zonin� Code. and Coinprehensive

CONC�,iJSIOl�S, OKDER AND CONI)ITIONS
Based upon one or more of the above findinas, the Orono City Council hereby
arants variances to Orono Municipal Zonina Code Sections 78-1288 and 78-30� to allow
construction of a 12' x 12' shed where hardcover in the 0-250' zone is proposed at 30%
where 0% is normally permitted in the 0-7�' zone and 25% is nonnally permitted in the
75'-2�0' zone and 30% in the� 0-2�0" zone currentiv eaists and was approveci by variance
in June of 200�, and a street/rear }�ard setback variance to pe�rmit the slied to be located
21' from tlie property line where �0' is nonnall�r required and the ehisting home was
pei-�nitted by variance to be setback ?1' from the property line, subje�ct to the followin�
conditions: �
1. Council approval i� based on the site plan submitted by the applicants and
aiulotated by Cit�� staff; attached to this Resolution as Eahibit B. Any
amendments to the site plan which are not in confonnity with City codes will
require further Planning Commission and City Cotulcil review.
2. Hardcover in the 0-7�' zone shall not increase above the level of 3.5%.
Hardcover in the 75'-250' zone shall be limited to 11,430 s.f. or 20% and
hardcover in the 0-250' zone shall be limited to 30% per the proposed plan and
hardcover allowance sununary as depicted on Eahibit B. Applicants are advised
that any firture requests to increase hardcover or chan�e the nature of
existin�/approved l�ardcover shall require City approval, and increases ii7
hardcover will not lil:el�� be approved ���ithout eoncunent reduction in e�istin2
hardcover. �
�. 1�pplicants shall remove all plastic or fabric liner material froi�� the decorative
landscape beds on tl�e property io ensure their pernleabilit� as noz�-harcicover
surfaces.
4. Required removals of hardcover shall be completed by the first required buildiny
inspection for the proposecl shed, iulless a renioval timeline nas been aceepted 'oy�
Zonin� staff and/or the Buildina OfficiaUlnspector.

�. Authorities �ranted by this resollrtion run with the property not with the
applic�ants, but are perinissive only and nnlst be exercised by obtainina a building
permit for the new construction within one }rear of the date of Council approval,
or the variance�s will eapire on that date (November 28, 2006).
6. Violation of or non-compliance with any of the terms and conditions of this
resolution shall constitute a violation of the zoning code, shall automatically
tei-�ilinate any authority granted herein. a11d shall be punishable as a misdemeanor.
7. The undersigned applicants have read, Lulderstand and hereby agree to the terms
of this resolution and on behalf of the applicants and tl�e applicants' heirs,
successors and assigns. hereby agrees to the rec�rding of this resolution in the
chain of title of the propei-ty.
