' `�� y G'�' RESOLUTION OF THE CITY COUNCIL ��kESI3�4��' NO. � � �1 � A RESOLUTION GRANTING VARIANCES TO MUNICIPAL ZO�I�G CODE SECTION 78-282, 78-1288, 78-30� (B) FILE NO. 0�-3017 WHEREAS, Spnice Hill Properties, Inc., (hereinafter "the applicant") is the owner of the property located at 377� Bayside Road �vithin the City of Orono (hereiizafter the "City") and legally described as follo�vs: See Attached Exhibit A (hereinafter the "property"); and WHEREAS, the applicant has made application to the City of Orono for hardcover, lalce setback, and street yard setback variances to Orono Municipal Zoning Code Section 78-282, 78-1288, and 78-305 (B) to allow an extensive remodel of the e�cisting building which consists of renovating the first floor and re-constructing the %z story above. NOW, THEREFORE BE IT RESOLVED by the City Council of Orono, Minnesota: FINDINGS 1. This application was reviewed as Zoning File #04-3017. 2. The property is located in the LR— lA, One Family Lakeshore Residential District, which requires a minimum lot area of 2.0 acres. The applicant's property is 0.94 total acres in area. 3. The Plannin� Commission reviewed this application at a public heanng held on May 17, 2004 and recommended approval of the hardcover, lake setback, and street yard setback variances based on the following findin�s: a. The configuration of the property causes the required lake yard setback and street yard setbacks to overlap resultin; in no buildable area unless variances are �ranted. The proposed remodel will take place entirely within the existinj footprint. d. The proposed remodel �vill yield a net reduction in hardcover of 108 square feet. 4. The City Council has considered this application includin� the findin�s and recommendation of the Planning Commission, reports by City staff, comments by the applicant and the public, and the effect of the proposed variance on the health, safety and�velfare of the community. 5. The City Council finds that the conditions e�isting on tlus property are peculiar to it and do not apply generally to other property in this zonin� district; that grantin� the variance would not adversely affect traffic conditions, light, air nor pose a fire hazard or other danger to neighborinj property; would not merely serve as a convenience to the applicant, but is necessary to alleviate a demonstrable hardship or difficulty; is necessary to preserve a substantial property right of the applicant; and would be in keeping with the spirit and intent of the Zoning Code and Comprehensive Plan of the City. CONCLUSIONS, 012DER:��tD CONDITIONS Based upon one or more of the above findin�s, the Orono City Council hereby �rrants hardcover, lake setback, and street yard setback variances to Orono Municipal Zonin� Code Section 78-282, 78-1288, and 78-30� (B) to allow an extensive remodel of the existing building which consists of renovating the first floor and re-constructing the Yz story above, subject to the follo�vin� conditions: 1. Council approval is based on the site plan submitted by the applicant and annotated by City staff, attached to this Resoiution as Exhibit B. Hardcover in the 7�'-250' zone shall be limited to 3,340 s.f. or 29% per the proposed plan and hardcover allowance suirunary as depicted on Exhibit A. Applicant is advised that any future requests to increase hardcover or change the nature of existin�/approved hardcover sha11 require City approval, and increases in hardcover will not likely be approved without concurrent reduction in existin� hardcover. 3. Applicant shall remove all plastic or fabric liner material from the decorative landscape beds on the property to ensure their penneability as non-hardcover surfaces. 4. Required removals of structure and hardcover shall be completed and confirmed at the time of the initial required construction inspection. 5. Applicant shall remove 80 s.f. of patio on the lake side of the home so that the patio will not extend any fiirther towards the lake than the deck. 6. Authorities �ranted by this resolution nin with the property not with the applicant, but are permissive only and must be exercised by obtaining a building permit for the new constniction within one year of the date of Council approval, or the variance will expire on that date (June 14, 2005). 7. Violation of or non-compliance with any of the terms and conditions of this resolution shall constitute a violation of the zoning code, shall automatically terminate any authority �rranted herein, and shall be punishable as a misdemeanor. 8. The undersigned applicant has read, understood and hereby agrees to the terms of this resolution and on behalf of the applicant and the applicant's heirs, successors and assi;ns, hereby a�rees to the recordinj of this resolution in the chain of title of the property.
