The Southeast Quarter of the Southwest Quarter of Section 28, Township 118, Range 23 West of the 5th Principal Meridian except the north 66 feet of the west 66 feet thereof. The East 331 feet of the South 776 feet of Government Lot 1, Section 28, Township 118,Range 23 West of the 5th Principal Meridian. Government Lot 1, Section 33, Township 118,Range 23 West of the 5th Principal Meridian, except roads. All in Hennepin County, Minnesota; and WHEREAS,the Wold Architects and Engineers has made application on behalf of the Owner to the City of Orono for approval of a conditional use permit to allow additions to these buildings; and WHEREAS, after due published notice and mailed notice in accordance with Minnesota Statutes and the City of Orono Zoning and Planning Codes, the Orono Planning Commission held a public hearing on September 15, 2008, at which time all persons desiring to be heard concerning this application were given the opportunity to speak thereon. . Page 1 of 3 0 0 CITY of ORONO a ti RESOLUTION OF THE CITY COUNCIL ��`4kES80g�G NO. NOW, THEREFORE BE IT RESOLVED by the City Council of Orono, Minnesota: FINDINGS 1. This application was reviewed as Zoning File#08-3379. 2. The Planning Commission reviewed this application on September 15, 2008 and on a vote of 5 - 0 recommended approval of the conditional use permit. 4. The City Council has considered this application including the findings and recommendations of the Planning Commission, reports by City staff, comments by the owners and the public, and the effect of the proposed additions on the health, safety and welfare of the community as well as the impact on properties in the vicinity. 5. The City Council finds that the proposed additions are in accord with the objectives and purposes of the RR-1B zoning district in which the site is located and with the comprehensive municipal plan and that the proposed additions would not be detrimental to the public health, safety or welfare, or materially injurious to properties or improvements in the vicinity. CONCLUSIONS, ORDER AND CONDITIONS Based upon the above findings, the Orono City Council hereby grants a conditional use permit for building additions,subject to the following conditions: 1. Council approval is based on the site plan and building elevations submitted by the applicant and annotated by City staff, attached to this Resolution as Exhibit A. Any changes or amendments to this plan may require further Planning Commission and City Council review. 2. Authorities granted by this resolution run with the property not with the owner, but are permissive only and must be exercised by obtaining building permits before September 22, 2009 or grounds will exist for revocation of the conditional use permit. 3. Violation of or non-compliance with any of the terms and conditions of this resolution shall constitute a violation of the zoning code, shall automatically terminate any authority granted herein, and shall be punishable as a misdemeanor. The undersigned Owner has read, understands, and hereby agrees to the terms of this resolution and on behalf of the Owner and the Owner's successors and assigns, hereby agree to the recording of this resolution in the chain of title of the properties.
