"The granting of the application is necessary for the preservation and enjoyment of a substantial property right of the applicant." The owners have ample area to construct a conforming accessory building, meeting the 10 foot separation, demonstrating reasonable use. This criterion is not met. 11. The Garage, although could be constructed in a conforming location the proposed variances are proposed to avoid increased visibility of the building from the lake which protects against the appearance of uncharacteristic bulk and mass. I would like to replace some of the rock along the shoreline next summer. There is already rip-rap in place all along the shore. I would like, however, to replace a small section of it with flat stone as opposed to the round boulders currently being used. So nothing changing other than making it a flat, angled rock surface so that we can more easily get into/out of the water. Is this something that needs to be noted on a permit or am I cleared to move ahead because there is already existing rip-rap in place? Here is my plan: 1) To file separate permit applications for the "garage" and "retaining wall, paver patio, and stairs." Since engineering will be required for the latter, don't want to confuse any of that with the garage application, which I hope to be more straightforward and which is more time sensitive. 2) I have an architect hired to create the garage drawings as specified. Will be worked on mid to late next week. 3) I have reached out to the surveyor (Mark Gronberg). He has agreed to update the survey with the correct garage information and the retaining wall, patio, and stairs. I will make sure to adhere to the 75ft setback, only have one set of stairs going down to the water, and clearly mark the location of the dock area. I will be able to use this same survey for both permit applications as the single survey will have the required information for both applications. 2 4) I am working with an engineer to get technical drawings/design for the retaining wall since a portion of it will start around 8 feet and taper down to only a couple feet. This information will be provided as required on the permit application. All of this should take a couple weeks to finish/procure. I will then come in person to the office and file both permit applications. If you see any obvious faults with my logic, would appreciate comments. If not, see you in a couple weeks with both applications in hand. I understand you can't give approval or an opinion until all paperwork is submitted, but I would appreciate it if you could give me a heads-up if you see anything that would obviously be a problem in what I have attached. I'm assuming there is no problem with me writing down my name for all three sections on the front page of the application? 2) I'm assuming I would check the boxes for "Accessory Building" for#1, "Single Family with detached garage" for#2, and and "Accessory Bldg. /Garage" for#3? Just want to make sure that I am selecting the correct boxes. 6 3) I would also like the ability to use this permit to get approval for a small retaining wall that will wrap from the outer edge of the garage and around to the front of the main structure to allow for proper landscaping and the ability to put in a paver patio between the garage and main structure. Can I use this same permit to accomplish all of that? If so, is it permissible to select two options under#3 (Accessory Bldg. / Garage AND Retaining Wall(s) 4-feet or greater)? I did find that you won't need Sheetrock on the exterior of the building. There is an exception for accessory structures and you may need to install Sheetrock on the inside per the Residential Code.
