STATEMENT BY SUBDIVIDER: "The owners, Jim Bruce, Steve Bruce, Jim Lawrence, and Fred Herfurth, all residents of Wayzata and Orono, intend to develop the Abrahamson property (225 North Ferndale) immediately, if approved, into eight single family residences, attached, in pairs. The existing residence will be "added to" to create two residences; an additional three structures of two units each will be constructed. Property is served by sewer and water from Wayzata. Wayzata has approved this density for utilities. The intended market will be older "empty nesters". We expect a density of 2.1 persons per dwelling. The architecture will be "rustic traditional" , and the price range will be $150,000 - 200,000 per unit. All property, other than the platted lot, will be owned, governed, and.maintained by a Horse Owner's Association, all specified and regulated by Deed Restrictions. This will include tennis courts, roads; lawns and wild areas. The density and architecture will conform with surrounding neighborhoods. We know there is a demand for this "way of life", as eight of the eight units are asked for. All eight purchasers are "Lake Area Residents", who desire to rid themselves of the problems of main't4ining their present homes and exchange for a "new, easier-way-of-life" and remain in the Lake Area which they love." Mayor Van Nest: The topography has to be considered as a hardship which does not adhere to performance standards. Jim Bruce: . I believe this proposal conforms to areas adjacent to this. Traffic is not an issue. We believe the number of units would be esthetically sound. Mayor Van Nest: I have a problem with the two variances required which are: 1. Density 2. Attached garages. I do not agree with or approve ; the granting of variances, especially where land utili- zation is concerned. Variances establish precedents, often with unforeseen chaotic results. There were sound reasons for establishing the current zoning requirements when they were issued. However, if in the interim because of economic or other reasons the current requirements are no longer equitable, before any variances are granted, I would strongly recommend that the zoning requirements for the entire City of Orono be reviewed and modified if deemed necessary to • meet current requirements and to benefit the entire community. i Very truly yours, Leo J. When we moved to Orono nearly eight years ago, a major attraction was that it was •a community of single-family dwellings in a semi-rural environment. ' Ironically, that was part of the sales Ditch• used by the then Frederick Herfurth Agency in selling up our Droperty. Attached housing and the added traffic on an already crowded Ferndale Ave. certainly seems inconsistent with Orono's developmental philosoDhy. To City Council Members# I am writing to display our concern for the rezoning of the Southwest area of Ferndale and Chevy Chase Drive to allow attached housing in a single. unit housing area. We purchased our residence, which touches said area, because of the open areas and privacy. I feel it is unfair to allow dense housing in our area, not to mention the decrease in surrounding property values. I (Wally Nelson) was present at the January -22 meeting of the Planning Commission and heard their decision to turn down the Herfuth proposal. My family and I now live onChevyhChase Drive in our the town of Orono. We selectedi home when we moved to Minnesota, from Pennsylvania, in August, 1978. The nature of housing in the area was a very important consideration in our selection of a home. It was important to us that the neigh- borhood did not include attached housing and that it was generally uncongested. '225 North Fern, The code should be enforced and not allow this proposal. (Continued) Fred Herfurth, 635 North Ferndale, discussed the life style that would occur with this proposal. Mayor Van Nest: Maybe protective covenants would be appropriate here to protect the life style proposed and to assure that adjacent properties are protected so as not to allow diminution of values. Issues are: 1. PRD, Conditional Uses 2. Variances to densities (six units, possibly seven) 3. Attached versus detached garages (consider amending code R-lA District) _ Jirw Bruce: We would like to present our reasons for variances to the City. Mr. Sam Marfield, 2455 Scotch Pine Lane, reviewed SCOTCH PINE LANE REPO his letter of January 30, 1979, which states: Letter - Pages . 24-27 Mayor Van Nest commented that .he would support vacating the street and assess the cost back to the property owners. Alan Olson, City Planner, entered into the record SUBDIVISION the request for a subdivision of Fred Herfurth, 225 225 North Ferndale North Ferndale Road, dated February 2, 1979, which # 434 states: Fred Herfurth The Planning Commission recommended denial of this application because of neighborhood opposition to attached units and because of the density requested. The requested PRD density is 0. 836 acres/unit compared to R-lA zoning requirement of 1.0 acres/unit. The proposal is to construct three new "duplex" structures and remodel the existing house into an additional "duplex" for a total of four residential structures on 6.75 acres. Contrary to the Planning Commission recommendation, I recommend approval of the attached dwellings for these reasons: Four buildings will have less visual impact on the neighborhood than 6, 7 or 8 individual buildings; platting into 6, 7 or 8 individual lots would have less respect for the topography of the site, would likely require a longer roadway, and . . would likely require houses located much closer to the existing neighboring residences than the planned location; the neighboring lots are small with houses located very close to this property, quality "attached" condominium units will not detract fron neighborhood property values, are intended to be owner-occupied and are representative of a growing trend in quality housing. Attached condominium style housing will provide a quality housing alternative in Orono. I believe that this alternative could be approved as a variance to 34.029 limiting "duplexes" to within 200 ft. of a commercial area. A better approach would be to consider amending the ordinance to permit double attached condominium units in R-1A, R-1B, RR-3-A, RR-1B and LR-1C districts (now permitted in R-1B and LR-1C) . I recommend the latter. The density question is more difficult. I am comfortable with the proposed eight units (four buildings) . Strict code enforcement would limit the development to six units (three buildings) however, the lot size is very close to permitting seven units. Because seven units also means four buildings, I would, therefore, recommend approval of the proposed eight units as being a reasonable use of this property. As a PRD Conditional Use Permit, the Council can retain close control over the type of development. This will ensure protection of the neighbors by control over use of the open space, plantings, buffers, and the type of structures. I recommend that you retain review rights prior to issuance of building permits and that final plat approval include a landscaping plan. Approval of attached double residential units (Continued) subject to Council review prior to building permit issuance. 2. Approval of eight units as proposed. 3. Preliminary plat approval as proposed, including: a. private paved road 24' wide with road and utility easement to the City b. extension of City sewer and water with a new fire hydrant at the end of the cul-de-sac and reconnection of the existing building, subject to a developer's agreement for construction details C. submittal and Council approval of a landscaping plan .for the common outlot d. open space easement to the City over common outlot e. park dedication fees based on new schedule f. creation of a homeowner's association acceptable to the City Staff Note - March 5, 1979 After the February 13, 1979 Council meeting, the applicant responded to neighborhood concerns by redesigning his proposal. His February 27, 1979 plan is for seven detached single family units, clustered in a PRD format. The new plan has a density of 0.96 units/acre (up from 0.836 units/acre with the eight unit_ plan) . The sketch is rough but purports to show a design meeting all setback requirements. The City_ Engineer should review the road plan to assure proper width and turnarounds. The plan revision amends the application to: 1) Subdivision, 2) Planned Residential Development, 3) 4% Variance to lot area requirement. This proposal appears to answer the concerns of the Planning Commission and the neighbors regarding attached units, and the density improvement is consistent with the cor.u►ents of the Council. I recommend approval of the revised plan 'conditioned (Continued) upon the same items listed in Item 3 above. Mr. Arnoldy was concerned with the location of the pool and tennis court. The designated area was pointed out* to him on the plat, to which he agreed was satisfactory to him. Mayor Van Nest moved, Pesek seconded, to give preliminary approval for seven family units for Fred Iierfurth, 225 North Ferndale Road, with the PRD a separate application in accordance with the sketch. Motion, Ayes (4) - Nays (0) . Mayor Van Nest moved, Butler seconded, to place on VARIANCE the table the request of Paul Clabo, 1388 Park Drive, 1388 Park Drive for a variance. Psotion, Ayes (4) - Nays (0) . #438 Mayor Van Nest moved, Butler 'seconded, to adopt RESOLUTION #1008 Resolution #1008, A Resolution Approving Lot Area 1388 Park Drive And Lot Width Variances But Denying Setback Variances Paul Clabo For Lot 18, Block 13, Saga Hill Revised, subject to the placement of the house to be no closer to the road than the house to the south. ' Mr. Alan Olson, City Planner, informed the City SUBDIVISION Council that Donald Scott, 2325 Longview Circle, 2325 Longview Circ1F has completed all outstanding conditions sited on #442 his notification of January 26, 1979. Staff recommends Donald Scott approval of the plat in accordance with the enclosed resolution. Mr. Alan Olson, City Planner, entered into the record SUBDIVISION the request of Robert Olson, 4645 Bayside Road, for 4645 Bayside Road a subdivision, dated- November 21, 1978, which states: #443 Robert Olson Sketch Plan- Review - Mr. Olson has submitted an application for a two lot subdivision originally submitted and approved by Council (flay 28, 1974) by Harold Anderson, 4665 Bayside Road. The original application was never finalized because 13r. Anderson # did not complete specific obligations to the City. (Continued)
