Dear Ms. Booker:
It was brought to the attention of the City of Orono on September 28, 1993 that the legal
description for Easement Document No. 4749662 is incorrect. I have compared the easement
description with City utility maps and a copy of the property survey, and have confirmed that
the easement description is not correct.
It is the City's intent to rectify this problem, which will likely require the cooperation of the
property owners in either signing a new corrected easement document or an amendment to the
existing document. I am currently working with the City Attorney to have the correct
documents drafted and will forward them to you within a few days.

UTILITIES AND DRAINAGE EASEMENT
THIS INDENTURE, made this 5fAday of �'Ja„z�, , 191y, between Robert
P. Johnson and Myra K. Johnson, husband and wife, of the County of Hennepin and the State
of Minnesota, (hereinafter referred to as Owner), on behalf of themselves, their heirs, successors
and assigns, and the City of Orono, a municipal corporation under the laws of the State of
Minnesota (hereinafter referred to as City).
WITNESSETH:
Owner, in consideration of the sum of One Dollar ($1.00) and other good and
valuable consideration to Owner in hand paid by the City, the receipt and sufficiency whereof
is hereby acknowledged, does Grant, Bargain,.Quitclaim, and convey unto the City, forever, the
following perpetual easement over and under and across property located in the County of
Hennepin and the State of Minnesota, and legally described in Exhibit "A" attached hereto.
Said easement includes the free right to enter upon,under and over said premises,
to remove trees, brush, grass and dirt and other structures therefrom, in order to construct,
maintain, repair and use sanitary sewer and water pipe, manholes, lift and pump stations, streets,
curbs and gutters, drainage ways and other improvements related thereto and to enter upon said
easement for the purpose of inspecting, repairing, removing and reconstructing such facilities,
including the right to maintain sufficient quantity of soil over any such underground facilities
required to prevent the freezing of liquids therein. The City shall return the area it disturbs to
grade and seed the same and replace the surface soil with the original type material, except in
the case of any area to be used for street and other improvements related thereto.
The Owner does covenant the Owner is in possession of the above-described
property and easement and has lawful right and authority to convey and grant the easement
herein granted.
This document is filed to correct the legal description attached as Exhibit "A" to
the instrument originally filed as Document No. 4749662 on October 27, 1982 with the
Hennepin County, Minnesota Recorder.
State Deed Tax Due Hereon: Exempt

That part of Lot 7, Block 10, Townsite of Langdon Park described as follows:
Commencing at a point in the South line of said Lot 7 which is 56 feet East of the
Southwest comer of said Lot; thence North parallel with the West line of.said lot, a
distance of 104 feet; thence West at right angles a distance of 44 feet; thence North a
distance of 46 feet; thence East at right angles a distance of 124 feet; thence South 150
feet to the South line of said lot, thence westerly 80 feet to place of beginning.
Together with that part of the Northerly 43 feet of Northern Ave., vacated, described as
beginning at the intersection of the East line of premises in question, with the Northerly
line of Northern Ave., thence South on an extension south of said East line, to the South
line of the Northerly 43 feet of Northern Ave., thence Southwesterly along said South

Dear Ronnie Semlak:
I am in receipt of your September 20, 1995 letter which included a photocopy of the utilities and
drainage easement which Robert and Myra Johnson signed and had notarized on March 25, 1994.
The consent form was not enclosed.
In order for the City to file this document at the County,we must present the easement
documents with original signatures,not a photocopy. Further, we must have the consent form
with original signatures.
Given the lengthy period of time since the City initially worked with Sue Booker on this matter,I
am sending you a copy of my October 13, 1993 letter with a blank copy of the easement form
and the consent form. Please return these documents with original signatures to me so that I can
pass them on to the City Attorney for filing.
