Web Site: The Minnehaha Creek Watershed District Board of Managers reviewed the above mentioned
www.minnehahacreek.org permit application at their Board meeting on March 27,2003. It was the action of the Board to
approve the transfer of the permit to Lundgren Brothers Construction with the following
conditions:
• Payment of Rule J fees in the amount of$49.78
• Submit a new su for wetland alteration in the amount of$5000.00

Scott Thomas Due to the size and complexity of certain projects,the Board,by Rule J,requires that site
inspections be conducted. In these cases, the applicant is required to pay to the District,a fec equal

Robert Schroeder and any subsequent monitoring of the work-These costs are referred to as Rule J fees.
Once the above mentioned fees have been paid and the other conditions have been met staff will
transfer the permit. You are rcmindcd that work on the project cannot begin until the permit has
been issued. This permit will expire on July 12,2002.If final municipal approval of the project
results in changes to the project you must submit revised plans to the MCWD for review.

Recommendation:
Approval. permit should not be issued until the following conditions are met:
1. Reimbursement of mailing costs
2. Payment of Rule J fees
3. Submit a declaration for the preservation of wetland buffers which must be executed and
recorded

Background:
The applicant is proposing to construct a driveway access to a recently subdivided property at the
location cited above in the City of Orono. The proposed project consists of filling 3,400 square
feet of a Type 2/6 wetland for the purposes of creating a driveway to access the property.
Impacts will be mitigated on-site tluough the creation of 9,500 square feet of new Type 3
wetland which be performed simultaneously with the construction. Permits would allow for
grading, fill, mitigation and WCA replacement plata approval.
Rule R:
Erosion control consisting of silt fence has been provided throughout the site.
kUle D:
As stated above,the project will involve the filling of 3,400 square feet of wetland followed by
the subsequent mitigation on-site of 9,500 square feet of new Type 3 wetland. The applicant has
provided a sequencing discussion in accordance with WCA which includes justification of
Hennepin County mandated sight distances for accesses to CSAH 19. These requirements
thereby limit the applicant to the proposed impact location for access to the property from the
County Road. Because the replacement plan exceeds the WCA required 2:1 ratio,MCWD staff
has verified the application to be in compliance with WCA guidelines. The applicant has also
proposed a 25-foot wetland buffer in accordance with MCWD Rule D.
