To Whom It May Concern:
The above referenced property is zoned RR— 1B, One Family Rural Residential District,
requiring a minimum lot size of 2.0 dry acres and 200' of width at the right-of-way. The
property has an existing lot area of approximately 5.2 total acres (some wetland) and
approximately 340' of defined width per Hennepin County tax records and above the
minimum standards established by the zoning district. Principal structure setback
requirements are 50' from the front and rear property lines, 30' from the side property
lines, and 26' from wetlands. The existing house appears to meet these setbacks per a
1996 survey existing on file at the City Offices.
The lot does not appear to be non-conforming in any manner. However, delineation of
the wetland may result in a dry acreage of under 2.0 acres per zoning district
requirements, which may make the property non-conforming in lot area. If this was the
case and the existing structure was destroyed willingly or destroyed by fire or an act of
God by 75% or more, a variance to lot area may be required in order to rebuild on the site
within the same footprint. Based on the history of lot area variances for
teardowns/rebuilds it is likely that the City Council would grant a lot area variance,
should the new construction meet all other Zoning Ordinance requirements. If the house
is destroyed by fire or an act of God by less than 75% it may be reconstructed in the
manner that it exists today.
