The <br /> property has an existing lot area of approximately 5.2 total acres (some wetland) and <br /> approximately 340' of defined width per Hennepin County tax records and above the <br /> minimum standards established by the zoning district. Principal structure setback <br /> requirements are 50' from the front and rear property lines, 30' from the side property <br /> lines, and 26' from wetlands. The existing house appears to meet these setbacks per a <br /> 1996 survey existing on file at the City Offices. <br /> The lot does not appear to be non-conforming in any manner. However, delineation of <br /> the wetland may result in a dry acreage of under 2.0 acres per zoning district <br /> requirements, which may make the property non-conforming in lot area. If this was the <br /> case and the existing structure was destroyed willingly or destroyed by fire or an act of <br /> God by 75% or more, a variance to lot area may be required in order to rebuild on the site <br /> within the same footprint. Based on the history of lot area variances for <br /> teardowns/rebuilds it is likely that the City Council would grant a lot area variance, <br /> should the new construction meet all other Zoning Ordinance requirements.
