At that meeting you were informed that a conditional use permit is required for all guest apartments per City Code Section 78-418(8)(b). To date, the City has not received a conditional use permit application for the guest apartment. Therefore, this letter serves as your official notification that you are required to file for a conditional use pen-nit. I have enclosed a conditional use perniit application, please complete this application and submit it to the City along with the highlighted required submittals and after-the-fact fee of$1,200.00 by December 22, 2004. Failure to submit the application in the timeframe provided will result in this matter being forwarded to the City Attorney for legal action. Within any RR-1B one-family rural residential district,no structure or land shall be used for the following uses without a conditional use permit: (8) Guest houses and nonrental guest apartments. a. Guest houses. A separate dwelling constructed on an existing undivided lot for the sole use of the occupants of the principal buildings, including their domestic employees or their nonpaying guests. All regular lot requirements shall be met by the guest house. b. Nonrental guest apartments. An apartment within the principal residence structure on a lot for the sole use of the occupants of the principal residence, including their domestic employees or nonpaying guests. There shall be at least one access door to the apartment from within the principal structure, and such door shall be the primary access to the apartment. Application for such a guest apartment shall address the concerns of parking, sewage treatment, entryway and interior access method. Such apartments shall not have utilities metered separately from the principal residence utilities and shall not have a separate street address.
