Rodney,
On August 8, 2013, a building permit (Permit #2013-00502) for an in-kind replacement of the lake
yard retaining walls at 4731 North Shore Drive was issued. On November 8, 2013 City Engineer,
Jesse Struve visited the site and observed a pathway and grading which was not shown on the as-
built survey nor was it approved as part of the permit. You were informed in an email dated
November 12, 2013 (enclosed) of Mr. Struve's observations and that land alterations within 75' of
the lake which exceed 10 cubic yards of earth movement and/or result in a change in grades cannot
be approved administratively by staff. Based on Mr. Struve's site inspection it would appear the
work on the site exceeds 10 cubic yards. The work appears to require an after-the-fact conditional
use permit(CUP) review.
Please provide a revised survey reflecting the as-built existing site conditions and summary of total
cubic yards of earth movement(including wall work)within the 75-foot setback. A CUP application is
enclosed.
The City considers the discrepancies between the as-built conditions of the site and the work
conducted to be a violation of permit#2013-00502. We will continue to hold $2,500 in escrow until
the above violations are resolved. Please submit the survey, earthwork calculations and completed
CUP application by May 15, 2014. If the survey confirms Mr. Struve's observations the after-the-fact
approvals are necessary. Please note an after-the-fact fee of $1400 will be required. If you have
any questions, please don't hesitate to contact us.

Rodney,
On August 8, 2013 we issued building permit #2013-00502 for an in-kind replacement of
retaining walls at 4731 North Shore Drive. On November 8, 2013 City Engineer, Jesse Struve

of the permit. As indicated in our November 12, 2013 email, copy attached, we cannot
administratively approve land alterations within 75' of the lake which exceed 10 cubic yards of
earth movement. Based on the site inspection it would appear the changes exceed 10 cubic
yards and are not an in-kind replacement.
We continue to hold $2,500 in escrow until the issues are resolved. In order to begin to resolve
the issues, we need a breakdown of total earth movement (including wall work) and the total for
the grade changes and finish grade with the 75' setback. If the earthwork exceeds 10 cubic
yards an after-the-fact conditional use permit will be necessary. A conditional use permit
application packet is attached.

The Certificate of Occupancy can be issued for the new home permit if the issues identified by Jesse (highlighted below).
We will begin that process once we can confirm. I will stop out at the site later today to check.
However, based on the proposed permit plans for the walls, Jesse's review of the site and the as-built surveyed contours
I need your surveyor to calculate the total amount of earth movement. It appears that there were changes made to the
plan to accommodate a pathway (vs. stairs) and the associated slope grading was not shown on the proposed plan. We
need this broken down into total earth movement (including wall work) and the total for the grade changes and finish
grading within the 75' setback.
We will hold the escrow until the permit for the work in the 75'setback is resolved. As you are aware, and as we
discussed numerous times, I can only administratively approve 10 cubic yards of earth movement within the 75' setback.
If the grading done to accommodate the pathway exceeds 10 cubic yards an after-the-fact CUP will be necessary.

I was out at the site this morning, and there is one issue which needs to be addressed prior to me signing off on the as-
built review. There are areas on the City ROW which was disturbed but nothing was ever reestablished. These areas will
need to be racked, smoothed out, topsoil applied, and seed and blanket installed (see photos).
I do have some questions for Melanie about the walking path which was graded in. The intent of the walls was to
replace existing walls and not to allow for grading to have taken place. I understand why you cut in the path in was to
get materials down the hill for the walls but the permit was to replace the walls "in kind".
Since you did not get a CUP you would have been required to grade this trail back to the original slope after the walls
were completed, but it appears you kept it and stabilized it. I think you should schedule a meeting with Melanie to
discuss this matter on Tuesday. She is gone today, and the office is closed on Tuesday.
If you get the ground in question stabilized with seed and erosion control blanket and as long as you get my question
resolved with Melanie, I can sign off on this on Tuesday.

Melanie,
Attached is the vegetation analysis from Natural Shore Technologies, Inc. a qualified
independent 3rd party. In addition, My before pictures have yellow notes on them that should
correspond with the report, and after pictures with white notes on them that should correspond
with the report.
We followed the restoration steps 1-7 except for the fact that we could not get compost soil logs
due to availability and time of year (wet compost does not blow well and clogs the blower trucks,
there are only 3 companies that blow compost in the Twin Cities that I know of). We used
woodchip logs in place, the main difference is that you cannot seed into these, but I feel it is
more important to stabilize the bank going into winter versus waiting for soil logs that may have
had to go into spring.
We used compost supplied by the Mulch Store in St. Boni. to fill in the 2" layer between the
logs.
We used .5 LB blue gamma, .5 lb Canaday Rye, and 1 LB winter wheat supplied by Twin Cities
Seed for seeding between the logs. A similar seed blend was used ahead of time to stabilize
behind the walls before the report was completed (you can see that has started to germinate in the
after photos).
We used an excelsior blanket similar to the North American Green SC-150 BN erosion blanket.
The work was completed on 10/17/13 and it does not look like there has been any erosion with

Re: 2013 Bluff Vegetation Survey and Erosion Assessment
Survey Scope:
This document provides a vegetation assessment of the undisturbed slope and a
restoration summary of the disturbed slope area for 4731 North Shore Drive,
Orono. This document presents information that was requested by the City of
Orono.
Slope Assessment (undisturbed slope)
Plant Survey
On the property edges along the slope, there are relatively undisturbed areas
where we conducted a plant survey. The site inspection was performed on
September 30, 2013. (Picture#1)
Common plant species identified along the slope are listed below:
Grey Dogwood Penn sedge
Sumac Zig Zag Goldenrod
Green Ash Canada thistle Mullein
Common Buckthorn Day Lily
Bur Oak Large Leaf Aster
American Elm
Slope Condition
The undisturbed slope has a substantial ground cover, with penn sedge and day
lilies being the two dominant species. We did not detect any substantial soil
erosion or large areas of exposed soil. The dominant shrub species included
smooth sumac, grey dogwood, and buckthorn. Green ash and bur oak were
noted along this slope area (Picture#2).
Restoration Summary (disturbed slope)
Existing Conditions
Currently, there is an approximately 300 SF slope area with patches of exposed
soil. The average slope angle is 2:1. The dominant soil type is a sandy loam.
The root structures of shrubs and small trees are scattered in this slope area
(Picture#3). There was no evidence of concentrated runoff from impervious
surfaces on this area.
Water Management and Site Design
The plan below can be used to revegetate the exposed slope area. It should be
understood that any concentrated water flow on the slope or substantial seepage
may cause slope failure. It is paramount that proper water management be
implemented to prevent any substantial soil erosion. Because Natural Shore
Technologies, Inc. is not involved with the site design, water management, or
revegetation installation, we cannot be held liable for any aspect of a slope
failure.
Restoration Steps
1. Smooth out exposed soil with hand a rake. Cut and dispose of all loose
root material.
2. Remove and treat all invasive weed species. ( buckthorn, thistle and
mullin)
3. Stake in 3 rows of 6" diameter soil logs — one at the top, center and
bottom of the hill slope (parallel to hill slope). Photo #4-6
4. Blow in a 2" layer of soil compost material between the logs, covering all
of the exposed soil areas.
5. Install a native woodland seed mix (Prairie Moon Seed Company) , 0.5 Ib
blue grama, 0.5 Ib Canada rye, and 1.0 Ib winter wheat on top of soil
compost. Lightly rake seed into soil.
6. Cover with North American Green SC-15013N. Install per manufacturers
specifications.
7. Water once per week in fall to facilitate winter wheat germination.
In order to prevent erosion during spring snowmelt, we recommend the above
revegetation work to be completed in fall 2013.
