Last Updated: April,2011 ZONING PERMIT ESCROW AGREEMENT Permit# AGREEMENT made this day of 20_, by and between the CITY OF ORONO, a Minnesota municipal corporation ("City")and ("Owners"). Recitals 1. A building permit application has been filed for a zoning permit for a property located at the ("Subject Property"), legally described as Hennepin County Minnesota. 2. Owner requests the City to review this application. 3. The City will commence its review of the application and incur costs associated with said review only if the Owner establishes an escrow to ensure reimbursement to the City of its costs. NOW THEREFORE,THE PARTIES AGREE AS FOLLOWS: 1. DEPOSIT OF ESCROW FUNDS. Contemporaneously with the execution of this Escrow Agreement, the Owners shall deposit $ with the City. All accrued interest, if any, shall be paid to the City to reimburse the City for its cost in administering the escrow account. 2. PURPOSE OF ESCROW. The purpose of the escrow is to guarantee.reimbursement to the City for all out-of-pocket costs the City has incurred (includingplanning, engineering or legal consultant review) or will incur in reviewing the plan. Eligible expenses shall be consistent with expenses the Owners would be responsible for under a zoning permit application. In the fall the City approved an after the fact CUP in order to document the restoration within the 75'setback. The slope was repaired following the approved designs which the Council saw and approved in November, with the exception of the finishing. The original plan called for an 8" soil layer to be hydro seeded and planted with live plants. Originally the landscape plan reflected a seeded slope with no exposed rocks or walls. Changes to the plan result in a slope which is comprised primarily of boulders with outcroppings of live plants tucked in between the boulders. The plantings appear to be thriving and will eventually "bush out"to screen more of the boulders; however the current landscape plan does not offer the immediate and complete screening of the slope and boulders as the original plan. Additionally, during the installation of the rip rap, and the cleanup of the debris which fell into the lake from the collapse, it appears a small shelf was created at the base of the hill. Following the completion of the slope repair this area was finished with sod (Exhibit F). Planning Staff Recommendation As it appears the slope restoration was completed according to the approved plans,the only outstanding item remains the finished landscaping. The Council should discuss the changes and the results and determine if the screening provided meets the City's goals for a natural looking shoreline. COUNCIL ACTION REQUESTED The Council should determine if the changes to the finished landscape plan are acceptable.
