MEMORANDUM <br /> DATE: 1 February 2010 <br /> TO: Street File: 4725 North Shore Drive <br /> c <br /> FROM: Melanie Curtis, Planning &Zoning Coordinato <br /> RE: Hardcover— Deck or Patio allowance <br /> While reviewing this file's history in response to questions regarding potential approvals <br /> for deck(s) or patio, staff has uncovered a number of inconsistencies resulting in the <br /> current — no deck — situation. Attached are 4 exhibits (exhibits A-D) illustrating the <br /> following facts: <br /> 1. Resolution 5553 (adopted in December of 2006) approved lot area, lot width, rear <br /> yard and 75'-250' zone hardcover variances for the property in accordance with <br /> the plans as attached. <br /> a. Exhibit A—the final, approved survey reflecting 75'-250' zone hardcover <br /> at 34.5%, and showing a house with attached 3-car garage. No deck is <br /> shown on the approved survey. <br /> b. Exhibit B — the final, approved house plans showing a deck filling in a <br /> notch in the building and accessing off of the kitchen. <br /> 2. The building permit P10743 was issued in February 2007. Revised plans were <br /> submitted with the building permit. <br /> a. Exhibit C — The revised house plans which showed the previously <br /> existing notch in the house off of the kitchen had been filled in with 2 <br /> levels of house and the deck completely removed. <br /> b. Exhibit D—The revised survey showing the house modified to reflect the <br /> removal of the notch and structure expanded in the kitchen area and <br /> bedroom area below. The expansion results in approximately 180 <br /> additional square feet of house. <br /> The home was constructed in accordance with the plans in Exhibits C & D (above), and <br /> not the approved plans as shown in Exhibits A & B. The home which was constructed <br /> substantially complies with the hardcover and setback approvals within Resolution 5553. <br /> Further changes to the home or the hardcover on the site require Planning Commission <br /> and City Council approvals. <br /> Further, due to the changes in the plan an as-built survey is required to be submitted <br /> prior to issuance of a certificate of occupancy which will verify compliance with approved <br /> grading and to assure that the changes to the plan did not adversely impact the <br /> approved plan. <br />
