Dear Jeanne:
We have reviewed the lakeshore washout on the Henry property at 4725 North Shore Drive.
The washout area was stabilized with buried timber walls and new fill placed on the
embankment in 1988.
The hank has again partially eroded and some of the walls are exposed. The walls have
moved because of the load and don't appear to be adequate to hold the embankment. The
erosion control measures may have also been inadequate to stabilize the filled area.
We would recommend that the property owner place silt fence to protect the lake. 'There
should also be a plan provided to stabilize the hank and prevent further erosion.

REGARDING: henry Residence
3ubterranial walls are installed with metal posts and two
inch boarus. By adding more boards to the top of the exist-
ing walls, they woulc' in mos:: cases bent' the walls further
than we want. Although the walls are installed plumb, they
are expected to bend downhill until almost perpendicular to
tate slope of the hill.
Due to the inadequacy of the vegetative cover on this hill ,
we feel that ?lis is the cause of the surface erosion, re
sulting in further lane; loss.
'1'o reconcile this natter, we feel the corrective measure
would be to fill in tie existing open (soil loss) area, re-
seed with MN DOT 500 grass seed and cover with the appropriate
erosion control fabric.

Dear Jeanne:
We have reviewed the information s-Ahmitted by NadeauLandscape on the Henry
Residence.
The landscape contractor proposed to fill the ,area that has eroded and reestablish the
vegetation. 'Phis is an acceptable option, but it could have a significant potential for failure.
Tile area near the lake should he protected with silt fence. The addition of deep rooted
plants should also he considered to minimize the possibility of future failures.

We have now been contacted by the insurance company
representing your neighbor, Mr. Meyer. The insurance
company has asked us for any and all documentation
supporting your claim that Mr. Meyer' s building up of his
property resulted in run-off damage to your property.
We have approximately 8 photographs in our file. The only
photograph that I can see demonstrates the build-up is
one of a tree trunk which apparently shows dirt and fill
above the original ground level of the trunk.
In order to provide the insurance company with the required
information we will need the negatives for all photographs
you have taken of your property damage and your neighbor' s
property which show the build-up. Please get those negatives
to our offices at your earliest convenience.

Please also provide us with any additional materials which
support our position. The stronger we cai. 'te our case
µ7l' at the outset, the more likely it is that we can negotiate
a favorable settlement with the insurance zompany without
having to place this matter into the court system.

repair the steps at 4725 North Shore Drive . This is due
mainly to our busy schedule and our present lack of per-
sonnel. Many of our employees are still in school and
therefore we just have not had a spare moment.
Mr. Daniel R. Nadeau is presently working at an out of
town job and I have been working around the clock to " `
keep us on schedule. I hur-bly apologize and hope that
you can understand my situation by granting us an extension
on our deadline date. If you have any questions, please

I am writing you concerning the project at the henry
residence located on 4725 North Shore Drive. Nadeau
Landscape was to complete the project on 8-25-88. I
personally made an effort to carry out this tas): but
was unable to locate the erosion blanket needed to
complete the project. After being told that I coulO
recieve the fabric today, I found it hadn' t arrived
and wouldn' t be in until Monday. (8-28-88)
I apologize for the extremely poor service we have
given the lienry's and yourselves. I realize this
project was handled in an unprofessional manner and
promise it will never happen again.

Dear. Sirs:
Our offices have been contacted by Mr. and Ms. J.P. Henry
regarding water damage to their property at 4725
Northshore Drive, Mound, Minnesota 55364. Mr. and Ms.
Henry are of the opinion that improper landscaping work
done by their neighbor caused storm run off to erode much
of the Henry's property during the great storm of July
23, 1987.
The Henrys further inform us that the City of Orono,
Engineering Department, has reviewed the area and has
ordered the neighbor, Dennis Meyer to restore his
property to its original condition, thus restoring the
rainfall run off to its normal path.
Would you please provide us with any reports generated by
the engineering department with respect to this matter.
We are in the process of negotiating with Mr. Meyer's
insurance and they have aske us to document our claim.
