4545 N.Shore Drive H)#07-117-23-31-0019 in Orono.

Regarding the possible encroachment of 2+feet on my property which was prompted by the Permit Survey
for Stonewood Development dated 12-19-2002 on which the west lot shows a dimension of 109.7 ft. This
does not compare with Hennepin. Co. recorded measurement of 97.67 ft plus 10 ft of vacated surface
easement which would be 107.67 ft. or 2.03 ft plus a small additional due to the angles involved. My
property survey has now been completed and Hennepin County markers were unearthed that assisted in
locating the old fire lane boundaries located on my eastern boundary next to Hwy. 19. The markers indicate
that the survey stakes set by your Survey company are proper.
In regards to the changes in the dimensions from 92.67ft and then to 97.67 and now to 109.67 ft. on the
Northerly boundary we assume this is only a change on your side of the 1/2 Vacated Alley and therefore
does not affect our property as previously questioned.
We therefore withdraw our objection to the questioned 2.+foot property encroachment by Stonewood.
Regarding the issue of TITLE of the 1/2 of vacated alleyway(actually an old fire lane)I gave Tony Lund,
Stonewood director of this project, a copy of the recorded Quit Claim Deed by Henry J. Rigelhof and
Eleanor Rigelhof to Harold Leon Albrecht and Carol Ann Albrecht on July 9, 1968 thus settling this issue
of a recorded instrument granting us one-half of this alleyway.

As discussed in a meeting with Michael Gaffron on 8-11-2003
Property line shown on Permit Survey for Stonewood Development dated 12-19-2002 on West side of lot
has a dimension of 109.7 ft which does not compare with Hennepin. Co. recorded measurement of 97.67 ft
plus 10 ft of vacated surface easement which would be 107.67 ft. or 2.03 ft plus a small additional due to
the angles involved.
This indicates a 2.++- foot the 4535 N.Shore Drive is on my property 4545 N.Shore Drive. I have
measured from my original west stake plus 1/2 vacated fire lane to the 4535 N.Shore Dr.plus 1/2 vacated
fire lane line and find it is approximately 3 feet past the property lime. In addition the Hennipen County
Highway Dept.placed my Driveway at this point and had stated it is at the right location.
A Surveying Co.will survey the 4545 N.Shore Drive property this week,hopefully 8-11-03 to 8-15-03 or
the first part of the neid week 8-18-03. Survey stakes will be placed and as soon as certified drawings are
done I will present them to the City.
As there is a For Sale Sign on the property and the house is in construction I would like to advise the City
of Orono of this matter so corrections can be done now.
A copy of the Saga Hill area is attached.
