All 20' of the vacated alley was originally platted as part of Bergquist's Addition to Saga Hill in 1889; therefore, all 20'would upon vacation under standard County procedures be returned to the adjacent Lot 9,which you own. (Excerpt from original plat is attached) 2. The City Council vacated the alley via Resolution#227 on March 25, 1968 (copy attached). The vacation was apparently filed at the County, presumably by the benefitting property owner of 4515 North Shore, Mr. Rigelhof, on October 2, 1970. 3. When I questioned Jim Holen at the Hennepin County property descriptions office(612-348- 3270)why the County website plat maps show that the vacated alley had been gqually split between 4515 North Shore and 4545 North Shore, he informed me that Mr. Rigelhof had deeded the west half to his neighbor at 4545, Mr. Albrecht, in 1968. 4. For unknown reasons, most old County plat maps we have on file at the City have not reflected the 1968 deed. However, this was possibly a County mapping oversight. Based on the above,I suspect you have no claim to the west half of the alley. My suggestion is that you have your attorney research the titles of both 4515 and 4545 to confirm that the deed to Albrecht is of record. Jim Holen can probably assist you in this. This research is not something the City Attorney would be involved in. If you conclude that the deed is in effect,then the only way to regain the west half of the alley would be to acquire (purchase) it from Albrecht or his successors. Since the deed is presumably of record as of 1975,under City code,your tax parcel and the one next door are `lots of record'. Please have the City Attorney help me research my situation: the vacated alleyway was split and given evenly to each adjacent property owner. My surveyor states that there are discrepancies to this at the County. It is my understanding from discussions with the Orono staff, County Surveyor, and attomey, that In the case of a vacation of land, the property reverts back to the property ovtmers within the original plat of which the land was dedicated. If there are two flanking property owners within this original plat, the vacated parcel is evenly distributed: if only one such property owner, it all is annexed to just its property parcel. The seller of the property has stated that there was no consideration that was funded to the City of Orono for the vacated property, and the City records clearly show a `vacation' versus a sale and purchase. Since our house plans are being finalized, and the City is requesting a drainage easement along basically`the westerly' common lot line of the property, I request your assistance at this time to help establish where the property line is, and get this title issue cleared up according to custom and statute.
