All 20' of the vacated alley was originally platted as part of Bergquist's Addition to Saga <br /> Hill in 1889; therefore, all 20'would upon vacation under standard County procedures be <br /> returned to the adjacent Lot 9,which you own. (Excerpt from original plat is attached) <br /> 2. The City Council vacated the alley via Resolution#227 on March 25, 1968 (copy attached). <br /> The vacation was apparently filed at the County, presumably by the benefitting property <br /> owner of 4515 North Shore, Mr. Rigelhof, on October 2, 1970. <br /> 3. When I questioned Jim Holen at the Hennepin County property descriptions office(612-348- <br /> 3270)why the County website plat maps show that the vacated alley had been gqually split <br /> between 4515 North Shore and 4545 North Shore, he informed me that Mr. Rigelhof had <br /> deeded the west half to his neighbor at 4545, Mr. Albrecht, in 1968. <br /> 4. For unknown reasons, most old County plat maps we have on file at the City have not <br /> reflected the 1968 deed. However, this was possibly a County mapping oversight. <br /> Based on the above,I suspect you have no claim to the west half of the alley. My suggestion is that <br /> you have your attorney research the titles of both 4515 and 4545 to confirm that the deed to Albrecht <br /> is of record. Jim Holen can probably assist you in this. This research is not something the City <br /> Attorney would be involved in. If you conclude that the deed is in effect,then the only way to regain <br /> the west half of the alley would be to acquire (purchase) it from Albrecht or his successors. <br /> Since the deed is presumably of record as of 1975,under City code,your tax parcel and the one next <br /> door are `lots of record'.
