Planning & Zoning Administrator DATE: June 1, 1993 SUBJECT: Slip Rental - 4480 North Shore Drive Apparently Mr. Grotans who lives in Northeast Minneapolis, owns two adjoining lots (4470/4480 North Shore Drive). Each lot has an old house. According to the neighbor, Jim Lorence, Grotans is renting slips. The evidence we have for this slip rental use includes: 1. An advertisement in the May 2, 1993 Star Tribune (attached). 2. The following licenses from boats stored at the docks which Lorence believes we will find to be registered to parties other than Mr. Grotans: A. 21' Sea Ray MN 8983-GB B. 24' Sea Ray MN 4804-EA C. Unknown Wisconsin license WS 5917KD Lorence also indicated that the following boats are probably owned by Grotans: MN 6567-BN and MN 2944-BP. The sections of our municipal code which I believe act in conjunction to prohibit the rental of boat slips at private residential property are Section 5.42 "Business and Joint use Lake Facilities" and Section 10.24 "LR-1B, 1 Family Lakeshore Residential District". Section 5.42 defines "business of docking, mooring or storing boats" as renting or otherwise providing space, including boat buoys, for docking, mooring or storing three or more boats belonging to persons other than the owner or occupant of the property. It is likely that the first three boats listed above will constitute three boats belonging to someone other than Grotans. Section 5.42 also defines "commercial boat dock business" as providing space for docking, mooring or storing boats for a fee, or boats used in a trade or business, including without limitation, providing rented spaces boat buoys, space for keeping boats owned by the licensee and held for sale, display, rental or otherwise used in connection with a boat or marina's business, and space held for docking of boats during or pending repairs or maintenance of said boats. It can be argued that this definition relies on us being able to prove that money has been exchanged, but if we can do so, this definition does not have a "three or more boats" provision, so if even one boat slip is being rented, that would be considered a commercial boat dock business. Slip Rental Memo June 1, 1993 Page 2 Presuming we have enough information to show that his use can be defined as either a "business of docking, mooring or storing boats" or as "commercial boat dock business", Section 10.24, the LR-1B Zoning District, does not list either of these two business uses as being allowed uses in the LR-1B Zone. Therefore we have two courses of action: 1. Issue a citation for violation of Section 5.42, Subd. 2 for engaging or participating in a business use without first having obtained a license from the City. 2. Issue a citation for violation of Section 10.24, Subds. 2, 3 and 4, for operating a use that is not allowed in the LR-113 Zone. If we tag for not having a business use license, we should make it clear to Grotans that it is a virtual certainty that he will not be granted such a license should he apply for one. The City does not license this type of business use in residential zones. I am attaching the advertisement which Jim Lorence faxed to me, and a copy of Section 5.42, Subds. 1, 2 and 3, and a copy of Section 10.24, the LR-1B District requirements. Once we have verified who owns all the boats and taken some pictures, I would recommend you follow through with your standard violation procedure, but don't give this guy all summer to make these rental boats go away. If this actually ends up in Court, it will be a good test of whether our licensing and zoning code provisions on private slip rental have any teeth. ch § 5.40 ` SEC. 5.40. HOME OCCUPATIONS. Subd. 1. License Required. It is unlawful for any person to engage in, or carry-on, a home occupation, as that term is defined in the Zoning Chapter of the City Code, without first having obtained a license therefor from the City. Subd. 2. Regulation. Licenses will only be issued if the specific use is permitted or otherwise allowed by the Zoning Chapter, and if all conditions set forth in said Chapter are fully complied with. SEC. 5.41. MACE. Subd. 1. License Required. It is unlawful for any person to sell or distribute, at wholesale or retail, the substance commonly referred to as mace, without first having obtained a license therefor from the City. Subd. 2. Limitations. A. Only persons who are duly authorized and licensed Federal firearms dealers shall be licensed. B. This Section shall not apply to official sales to, or purchases from, the City Police Department. SEC. 5.42_ BUSINESS AND JOINT USE OF LAKE FACILITIES. Subd. 1. Definitions. For the purpose of this Section, the following terms have the meanings given them: A. "Boat Slip, Water" means a structure, space, dock or other thing designed or used for the docking, mooring or storing of a boat temporarily or permanently in or on water, including mooring posts, buoys or other devices. B. "Boat Slip, Land" means a structure, space or other thing designed or used for storing a boat temporarily or permanently on land adjacent to a lake, whether it is located on or off the licensed premises. C. "Business of Docking, Mooring, or Storing Boats" means renting or otherwise providing space, including boat buoys, for docking, mooring or storing three or more boats belonging to persons other than the owner or occupant of the property. D. "Commercial Boat Dock Business" means providing space for docking, mooring or storing boats for a fee, or boats used in a trade or business, including, without limitation, provid- ing rented spaces, boat buoys, space for keeping boats owned by - the licensee and held for sale, display, rental, or otherwise used in connection with a boat or marina business, and space held for docking of boats during or pending repairs or maintenance of said boats. ORONO CC 126 (4-1-84) § 5.42 E. "Commercial Docks" means docks, mooring spaces, a mooring posts, mooring buoys, or boat slips used in commercial boat dock business or by one in the business of docking or storing boats as defined herein, including all "els", "T's", mooring posts, or any other structures related to the main dock. F. "Joint Use" means more than two persons joining for the purpose of using lakeshore property for swimming, bathing, fishing, docking or mooring boats, or for any other purpose. G. "Business Use" means engaging in the business of docking, mooring or storing boats, or a commercial boat dock business. Subd. 2. License Required. It is unlawful for any person to engage or participate in business use or joint use without first having obtained a license therefor from the City. Subd. 3. Public Hearing. Upon filing of any application for license the Council may call a hearing upon such notice s it may deem appropriate. Provided, that no such hearing shalbe mandatory, but wholly within the discretion of the Council. Subd. 4. Business Use Standards. All business use applications shall provide information showing compliance with the following standards: ~ A. The proposed number of boat slips on the land and on the water and boat buoys shall not adversely affect the public safety, health and welfare or infringe on the public right to use the water, or unreasonably restrict the rights of other property owners to store boats on or adjacent to the same area. ORONO CC 127 (4-1-84) § 10 .23 M; Subd. 2. Lakeshore Set Back, Hard Cover, and Tree Removal Regulations. (See Section 10 .22) . Subd. 3. Permitted Uses. Within the "LR-lA" One Family Lakeshore Residential District, no land or structures shall be used except for one or more of the following uses: A. Any permitted use as regulated in the "R-lA" District. Subd. 4. Conditional Uses. Within any "LR-lA" One Family Lakeshore Residential District, no structure or land shall be used for the following uses except by conditional use permit: A. Any conditional use as regulated in the "R-lA" District. Subd. 5. Accessory Uses. Within any "LR-lA" One Family Lakeshore Residential District, the following uses shall be a permitted accessory use: A. Any accessory use as regulated in the "R-lA" District and 'private docks' subject to the City Code and other applicable regulations, including boat storage density regulations. Subd. 6 . Area, Height, Lot Width and Yard Requirements . A. Height. No structure or building shall exceed 2-1/2 stories or thirty feet in height except as provided in Section 10 .75. B. Lots. Planned residential developments may be allowed by conditional use permits. The proposed land use may not endanger the quality of storm water runoff into Lake Minnetonka or Long Lake. Because of the location of the district near Lake Minnetonka or Long Lake, special regulations are necessary to protect these natural resources from the effects of dense development. This district shall have immediate access to 4 highways and public sanitary sewer. ORONO CC 284 (4-1-84) § 10.24 R- - i - Subd. 2. Permitted Uses. ORONO CC 285 (4-1-84) § 10.20 SEC. 10.20. R-lA ONE FAMILY RESIDENTIAL DISTRICT. Subd. 1. Purpose. The "R-lA" One Family Residential District is intended to provide a district which will allow a combination of low density residential development and limited agricultural activity. Planned residential developments may be allowed by conditional use permit. The district shall have immediate access to highways and public sanitary sewer. Subd. 2. Permitted Uses. Within any "R-lA" One Family Residential District, no structure or land shall be used except for one or more of the following uses: A. One family detached dwellings. B. Public owned parks and playgrounds. C. Municipal buildings. Subd. 3. Conditional Uses. Within any "R-lA" One Family Residential District, no structure or land shall be used for the following uses except by conditional use permit: A. Schools. Public schools and parochial or private schools which teach a curriculum similar to a public school provided no building shall be located within fifty feet of any lot line of an abutting lot in an "R" District and that a fence be erected fifteen feet or more from all street lot lines where the abutting use is for open play, and nursery schools providing fifty square feet of playground space per pupil. B. Churches. Churches including those related structures located on the same site which are an integral part of the church proper, convents or homes for persons related to a religious function on the same site provided no building other than a residence shall be located within fifty feet of any lot line of an abutting lot in an "R" District. C. Clubs, Camps, etc. Golf courses, country clubs, tennis clubs, public swimming pools serving more than one family, scout camps, YMCA camps, YWCA camps, church camps, or private non- profit parks, playgrounds and other similar uses. The principal structure for any of the above listed uses shall be 100 feet or more from any abutting lot in an "R" District, and accessory structures shall be a minimum of fifty feet from any lot line. ORONO CC 279 (4-1-84) S 10.20 D. Public Service Structures. Public service structures, including but not limited to electric transmission lines, buildings such as telephone exchange stations, booster or pressure regulating stations, wells, and plumbing stations, elevated tanks, lift stations and electrical power substations, provided no building shall be located within 50' from any lot line of an abutting lot in an "R" District. Prior to granting such permit it shall be found that the architectural design of service structures is compatible to the neighborhood in which it is to be located and thus will promote the general welfare. Public service structures as defined above that have been approved by the City at required public hearings for public improvement projects shall not require a conditional use permit but such structures shall be subject to all other appropriate standards set forth in this section; amendments to approved plans involving design and/or placement of these structures will require written notice by the City to all affected property owners 14 days prior to the adoption of the amended plans by the Council. An apartment within the principal residence structure on a lot for the sole use -, of the occupants of the principal residence, including their f' domestic employees or non-paying guests. There shall be at least one access door to the apartment from within the principal structure, and such door shall be the primary access to the apartment. Application for such a guest apartment shall address the concerns of parking, sewage treatment, entryway and interior access method. Planned Residential Development. Limited to detached single family dwellings only and subject to the limitations of Section 10.32. I. Duplex Credit. One duplex may be located on a single lot as a conditional use upon application therefor provided that public sanitary sewer service is available, and the lot is adjacent to a commercial or industrial district, and the duplex is constructed within 200 feet of the commercial or industrial district. A duplex is defined as a two-family unit residential building. J. Apiaries. R. Antenna Structure. One independent antenna structure with antenna or combination of antenna attached thereto, subordinate to and servicing the principal use or structure on the same lot and customarily incidental thereto that is not attached to another structure provided the height of the antenna structure does not exceed 65 feet and the antenna structure is set back from any lot line a distance at least equal to the total height of the antenna structure. L. Farms (Crop and stock). Provided that the area is ten or more acres. M. Animals. The keeping of domestic animals for non-commercial purposes including horses for the use of the occupants of the premises. A minimum of one acre in aggregate, exclusive of one acre for the principal building, must be available . for each animal unit, except as hereinafter set forth. A minimum of two acres of open pasture must be available for a single horse- and one additional acre must be available for each additional horse. When the horses are kept stabled and do not require pasture - for feed purposes, the minimum pasture requirement may be adjusted ' at the discretion of the Council. Such minimum pasture acreage. shall not include low lying lands unusable for pasture or grazing. Any person keeping such animals must comply with the provisions of the City Code. r (4-1-84) ORONO CC 280-1 S 10.20 N. Stables and' Barns - Private. The use of an accessory building for keeping animals for non-commercial purposes -- provided it -is for the non-commercial use of the property owner or resident and meets the available area standards outlined in Paragraph M of this subsection. Further, no such structure shall be located less than 150 feet from the nearest adjacent residence and no closer than 75 feet from the nearest lot line. O. Stables and Barns - Public. The use of accessory buildings or land for the storage or rearing of animals not owned by the property owner or resident. Such must meet the requirements of Section 10.03, Subdivision 18. Further, no such structure shall be located less than 150 feet from the nearest lot line. P. Riding Academy. Any such instruction maintained as an accessory use and conducted by the owner shall meet the requirements of Sections M, N and O of this subdivision and no such instruction shall occur less than 100 feet from an adjacent residence or less than 75 feet from the nearest lot line. Within any "R-lA" One Family Residential District, no accessory structure or use of land shall be permitted except for one or more of the following uses : A. Garages. Private garages and parking space. B. Pools, etc. Private swimming pool , tennis courts, and paddocks. C. Home Occupations. Any gainful occupation meeting all of the following requirements when engaged in only by persons residing in their dwelling, when there is no employed assistant, when that occupation is conducted within the principal structure only, when evidence of the occupation is not visible from the street, no signs other than those permitted in "R" Districts are present, no excessive stock in trade is stored on the premises, over the counter retail sales are not involved, the entrance to the home occupation is gained from within the structure, and the use does not adversely affect the character of the uses permitted in the district in which it is located. A professional person may use his residence for consultation, emergency treatment or performance of religious rites but not for general practice of his profession when such general practice will involve the need for more than three off-street parking spaces for the occupant and visitors. D. Signs. Signs as regulated in the Zoning Chapter. E. Temporary Structures. Buildings temporarily located for purposes of constructing on the premises for a period '- ' not to exceed time necessary for such constructing. F. Gardens, etc. Gardening and other horticultural uses including aviaries and decorative landscape features. G. Roadside Stands. One roadside stand offering for sale only farm products produced on the premises provided that such stand does not exceed 200 square feet in area and that it is located at least thirty feet back from the public right-of-way. Planned Residential Developments may be allowed by conditional use permits. The district shall have immediate access to highways and public sanitary sewer. Subd. 2. Permitted Uses. Within the "R-1B" One Family Residential District, no land or structures shall be used except for one or more of the following uses: A. Any permitted use as regulated in the "R-lA" District. Subd. 3. Conditional Uses. Within any "R-1B" One Family Residential District, no structure or land shall be used for the following uses except by conditional use permit: A. Any conditional use as regulated in the "R-lA" District except that a Planned Residential Development shall not be limited to detached single family dwellings only. Subd. 4. Accessory Uses. Section 5.42, Business and Joint Use of Lake Facilities, defines specific business uses, commercial uses and joint uses of lake facilities. Section 5.42, Subd. 1(C) defines the "business of docking, mooring or storing boats" when use involves three or more boats belonging to persons other than the owner or occupant of the property. A "commercial boat dock business" is defined as the act of providing space for docking, mooring or storing boats for a fee, and does not specifically limit the definition to something that is occurring in a commercial zoning district. "Joint use" is defined as more than two persons joining for purposes using lake shore property for... docking or mooring of boats . The intent of Section 5.42 is to define the licensing procedure and requirements for marinas in our Lakeshore Commercial (B-2 ) zoning districts, and for licensing joint uses (typically by homeowners' associations) in the residential districts. Zoning Code Sections 10.23, 10.24 and 10.25 list private docks as an approved accessory use" subject to city code and other applicable regulations including boat density regulations. "Private docks" are not defined in the definitions section. City staff have narrowly interpreted that the above referenced municipal code sections taken as a group suggest that business use includes the private property owner renting dock space to an off-site person or persons, and that private docks are TELEPHONE-473-7357• FAX-473-0510 Ms. Rachel Thibault September 9 , 1991 Page 2 interpreted as being docks for use only by the individual property owner or occupant. Therefore , while our code does not specifically and unquestionably prohibit a lakeshore resident from renting a slip for boat storage purposes in so many words , the regulations can be interpreted as having that effect. We realize this interpretation may be arguable. The RS District which includes Big Island and Deering Island, has more specific allowances for joint use of docks , since those areas are of a somewhat unique nature. Joint use docks allowed in these recreational districts are subject to regulations related to the use of the property. Section 10.41 defines the uses and performance standards of the B-2 Lakeshore Commercial zoning district (map enclosed). Subd. 8C discusses lighting limitations for the B-2 zone, and Subd. 8H deals with boat storage generally. Subd. 8I discusses land storage requirements for boats . Subd . 12A discusses nonconforming uses and suggests that the City intends that marinas should not increase the number of slips when nonconformities exit. The LMCD, in addition to requiring compliance with municipal zoning ordinances, amended the LMCD Code in 1978 to provide Section 3.02, Subdivision 10: No person shall sell, rent, or lease for watercraft storage purposes any space within dock use areas other than at commercial docks or at docks of apartments. In order to deal with the increased concern relative to the extent of this practice, and the village attitude on the matter, we would appre- ciate your comments as to village policy on renting or leasing of dock space, and a copy of any governing ordinances. You have asked us whether the lease of the above- referenced property to two persons who appear to be using it exclusively for mooring their boats constitutes a commercial dock business" as defined in Section 5.42 of the Orono City Code. After reviewing the facts you have presented to us, we conclude that this arrangement does not constitute a commercial boat dock business as defined in Secliou 5.42 of the Coda. Sectioll 5.42, subd. 1D defines a commercial boat dock business as: "providing space; for docking, ttlooring, or storing boats for a fee, or boats used in a trader or business, including, without limitation, providing rented spaces, boat buoys, space for keeping boats owned by the licensee and held for sale, display, rental, or otherwise used in connection with a boat or marina business, and space held for docking of boats during or pending repairs or maintenance of said boat." As you correctly point out in your ntettto, such a commercial boat dock business is not allowed in the family lake shore residential district within which this property lies. The question, therefore, is whether the owner of the property, Mr. Grotans, is operating a commercial boat dock business by leasing his property to Mr. Paulson and Mr. Stroup. The only evidence suggesting that this is the comttlercial rental of dock spaces is the money paid by Messrs. Paulsen and Stroup pursuant to the lease agreement they have with Mr. Grotans. While it appears that Messrs. Paulson and Stroup are primarily interested in this property as place to dock their boats, they.are legally entitled to use of the entire property, including the house. If this type of arrangement is construed to be an unlawful operation of a commercial dock, any dwelling in this district which is not owner-occupied would also constitute an illegal commercial dock if the tenant used the dock on the property to store a boat. 2 1 9/2 2026867 1 1/3/93 Michael P.
