HomeMy WebLinkAbout#4888-variance-2002 .' , ` � ��� , , n ,� 11l' ��=� � ��� , � � �: .-.'�g, 0 � �'��;,.,� � CITY of ORONO � ��` �:�,.: � �'� � ��' ���� G'�' RESOLUTION OF THE CITY COUNCIL L`�.kEs�4`�' rvo. 4 � � � A RESOLUTION GRANTING A VARIANCE TO NTUNICIPAL ZONING CODE SECTION 10.22, SUBDIVISION 2; AND SECTION 10.56, SUBDIVISION 16 (L)(2) FILE N0.02-2841 `VHEREAS,David Dickey and Jennifer Dickey,(hereinafter"the applicants")are the o«�ners of the property located at 4425 North Shore Drive within the City of Orono(hereinafter"the City+') and legally described as follows: Exhibit A (hereinafter "the propert�'); and `VHEREAS, the applicants have applied to the City for a variance to Municipal Zoning Code Section 10.22, Subdivision 2 and Section 10.56, Subdivision 16 (L)(2) to permit 4,96�.4s.f. (33.0%)hardcover in the 75-250'lakeshore setback where 4,96�.4 s.f.(30.8%)hardcover erists and 3,706.5 s.f. (2�%)is allo�ved to permit construction of an attached garage and foyer to the e�istin�residence; and `VHEREAS, after due published notice and mailed notice in accordance with �Tinnesota Statutes and the City of Orono Zoning and Planning Codes, the Orono Planning Cornmission held a public hearing on October 21, 2002, at which time all persons desiring to be heard concerning this application were given the opportunity to speak thereon. NO�V, THEREFORE, BE IT RESOLVED by the City Council of Orono, l�Sinnesota: FINDINGS 1. This application�vas reviewed as Zoning File#02-2841. 2. The property is located in the LR-1B Zoning District,where 1 acre is the minimum required lot area. 3. The Orono Planning Commission reviewed this application on October 21,2002 and recommended approval of the proposed variance based upon the following findin�s: A. The existing residence�vas built in 1971,prior to current zoning standards. The topography of the property is such that runoff will drain toward the lake and not towazd neighboring properties. All the property within 75' of the lakeshore will provide an adequate absorption area. C. The adjacent properties are not affected by the garage and foyer addition. D. A portion of the garage addition is over existing driveway hardcover. - E. The lot coverage by structures is well below the allowed 15%. F. The property has water on two sides,with almost 80%of the property within 75' of the lakeshore. 4. The City Council fmds that the conditions existing on this property are peculiaz to it and do not apply generally to other property in this zoning district;that granting the variance will not adversely affect traffic conditions,light,air,nor pose a fire hazard or other danger to neighboring property;would not merely serve as a convenience to the applicants,but is necessary to alleviate a demonstrable hardship or difficulty;is necessary to preserve a substantial property right of the applicants; and would be ixi keeping with the spirit and intent of the Zoning Code and Comprehensive Plan of the City. 5. The City Council has considered this application including the findings and recommendations of the Planning Commission,reports by City Staff, comments by the applicants and the effect of the proposed variances on the health, safety and �velfare of the community. CONCLUSIONS,ORDER,AND CONDITIONS Based upon one or more of the above findings,the Orono City Council hereby grants a variance to Municipal Zoning Code Section 10.22,Subdivision 2 and Section 10.56, Subdivision 16(L)(2)to permit 4,965.4s.f.(33.0%)hardcover in the 75-250'lakeshore setback where 4,965.4 s.f. (30.8%) hardcover exists and 3,706.5 s.f. (25%) is allowed to permit conshuction of an attached garage and foyer to the existing residence. Approval is subject to the following conditions: 1. Council approval is based on the site plan submitted by the applicants attached to this resolution as Exhibit B. Any amendments to the site plan may require furth�r Planning Commission and City Council review, Page 2 of 6 1 t . � � O� o �. Authorities granted by this variance run with the property not with the applicants, but are pemussive only and must be exercised by application for a building permit within one year of the date of Council approval,or these variances will expire on that date(October 28,2003). 3. Violation of or non-compliance with any of the terms and conditions of this variance shall constitute a violation of the zoning code,shall automatically terminate � any authority granted herein, and shall be punishable as a misdemeanor. , 4. The undersigned applicants have read,understand and hereby agree to the terms of this resolution and on behalf of themselves,their heirs, successors and assigns, hereby agrees to the recording of this resolution in the Chain of Title of the property.
