We have reviewed the revised plans for the proposed new home construction at 4415 North
Shore Drive. The plan is dated 12-16-10. We have the following comments with regards to
engineering matters:
• With the current plan, it appears there is potential for a larger portion of runoff to be
directed to the north. To maintain existing drainage patterns, the grading plan should be
clarified so that runoff north of the house and on the east half of the proposed driveway
will be directed to the swale along the east edge of the properly. This can be
accomplished either by showing a high point in the proposed driveway to the south of
the existing 954 contour, or by grading a cross-slope into the driveway such that runoff
will be directed to the east.

We have reviewed the plans for the proposed new home construction at 4415 North Shore Drive.
The plans are dated 12-16-10. We have the following comments with regards to engineering
matters:
• The proposed retaining wall along the east side of the home is shown as 4.0 feet in
height. If field changes increase the height, engineering design and details must be
submitted for review.
• The grading plan should be clarified so that a high point is shown in the proposed
driveway at or near elevation 955. This existing high point is likely located near the word
"GRAVEL" on the "EXISTING GRAVEL DRIVEWAY" label shown on the plan. The goal of
this would be to maintain existing drainage patterns and not increase the amount of
runoff to the adjacent west property. Generally, the roadside of the house would
ultimately drain around the east side of the house to the lake entirely within the
property.
• This project will disturb more than 100 CY of material. Sediment and erosion control
information meeting the requirements of Orono's City Code 79-7(c)(2) must be
submitted. The minimum $2000 sediment and erosion control financial security should
be required of the owner for this permit.

BUILDING PERMIT ESCROW AGREEMENT

AGREEMENT made this�day of oCx�-�� , ZO l° , by and between the CITY OF ORONO,
a Minnesota municipal corporation ("City") and @ �- v �-- �7Z�i ("Owners°).
Recitals
1. A building permit application has been filed for a new residence located at 4415 North Shore
Drive, the("Subject Propert�'), legally described as attached as"Exhibit A°.
2. Owner requests the City to review this application.
3. The City will commence its review of the application and incur costs associated with said review
only if the Owner establishes an escrow to ensure reimbursement to the City of its costs.
NOW THEREFORE,THE PARTIES AGREE AS FOLLOWS:
1. DEPOSIT OF ESCROW FUNDS. Contemporaneously with the execution of this Escrow
Agreement, the Owners shall deposit$2,5Q0 writh the City. All accrued interest, if any, shall be paid to the City to
reimburse the City for its cost in administering the escrow account.
2. PURPOSE OF ESCROW. The purpose of the escrow is to guarantee reimbursement to the City
for all out-of-pocket costs the City has incurred (including planning, engineering, in excess of $500, or legal .
consultant review) or will incur in reviewing the plan. Eligible expenses shall be consistent with expenses the
Owners would be responsible for under a building permit application. The escrow will also guarantee
reimbursement to the City for all out-of-pocket costs the City has incurred to assure that the work is completed in
accordance with the Storrnwater Pollution Prevention Plan and the provisions of Orono City Code Chapter 79.
The financial security may also be used by the City to eliminate any hazardous conditions associated with the
work and to repair any damage to public property or infrastructure that is caused by the work (including planning,
engineering, or legal consultant review) associated with building permit #2010-01195 if compliance with the
approved building permit is not accomplished.
3. MONTHLY BILLING. As the City receives consultant bills for incurred costs, the City will in turn
send a bill to the Owners. Owners shall be responsible for payment to the City within 30 days of the Owners'
receipt of bill.
4. DISBURSEMENT FROM ESCROW ACCOUNT. In the event that the Owners do not make payment
to the City within the timeframe outlined in#3 above, shall issue a Stop Wor1c Order until the Owners pay all expenses
invoiced pursuant to #3. The City may draw from the escrow account without further approval of the Owners to
reimburse the City for eligible expenses the City has incurred.
5. CLOSING ESCROW. The Balance on de�osit in the escrow, if any, shall be returned to the
Owners when the review has been completed and written not�cation is received from the Owners requesting the
funds.
6. CERTIFY UPIPAID CHARGES. If the project is abandoned by Owners, or if the eligible expenses
incurred by the City exceed the amount in escrow,the City shall have the right to certify the unpaid balance to the
subject pr erty pursuant to Minn. Stat. §§415.01 and 366.012.

Temporary Erosion Control and Sequencing
1. Install perimeter control fencing per the standard detail plates. No more than
600 linear feet of silt felice should be continuous and collecting at one point.
Undulate the silt fence or use "simles" or crescents of silt fence.
2. Install a rock construction entrance per the standard detail plate. Rock pad
exits are needed where the site exits to the private drive. Rock pads should
be 3 inch rock, 6 inches deep, and 75 feet long and span the full width of the
exit. Geotextile fabric should be placed under the rock.
3. Use horizontal slope grading
4. Install erosion control around any temporary dirt stockpile areas.
5. The contractor for the project shall inspect all erosion control BMP's after
each rainfall and repair as necessary and remove sediment from silf fences
if it reaches 1/3 capacity.
8. The contractor shall schedule his operations to minimize the amount of
disturbed area at any given time. The contractor shall limit his activities
to the grading limits as shown.
9. Remove all temporary BMP's once the site has reached final stabilization (a
uniform perennial vegetative cover with a density of 70 percent over all pervious
surface areas).
Permanent Erosion Control
1. All exposed soils on site must be stabilized with in 3 days:
a. Stabilization on slopes flatter than 4:1 consists of disc -anchored
mulch and seed; stabilization on slopes greater than 4:1 and in areas
of concentrated flows consists of erosion blankets and seed.
2. Temporary mulch and seed is needed for exposed areas which sit fallow for
3:1 or steeper in 7 days, 3:1 to 10:1 in 14 days, and flatter than 10:1 in 21
days. Also open stockpiles need to have temporary stabilization if they are to
remain inactive for more than 7 days.
