Melanie,
I have reviewed the existing and proposed drainage areas and would offer a few suggestions. When you look at the
drainage area,they have decreased drainage to the neighboring property(overall), but it has increased the drainage
which is being directed to the neighboring property's retaining wall and house. It is a relatively small amount because it
is just the increased hardcover area (685 SF per the surveyors numbers below). The existing house hardcover was
directed at the neighboring property, but it was directed south of the existing retaining wall.
Although it is a small number, I have concerns the neighboring property might perceive an issue and potential damage
to the wall or their structure. In a 1" rainfall the additional 685 SF will add 57 CF or 430 gallons of additional water. I
think a simple solution would be to grade a small depression area or rain garden type solution. This depression area will
hold an equivalent of 1.5" of volume of the house hardcover or approximately(685SF * 1.5"/12=85.6 CF or
approximately 650 gallons).
Since this may be a we area,the builder would have various options to deal with it. This would be a very minor
depression area which could be grass (mow able)or vegetated to be like a rain garden. They could also do some minor
soil corrections (mixing in sand/gravel) into the native soil to promote infiltration. Another fairly easy option would be
to do a sand/topsoil mixture with grass. You can then put an draintile underdrain which daylights to the west. This will
allow for temporary storage, but would allow for proper drainage so it is not a prolonged wet area.

This would also provide some rate control of the water being directed to the neighboring property. The water would sit
in the depressed area but be released over a longer period and not contribute to an increase in the flow to the
neighboring property during the peak rainfall.

On May 9,2013 the City received a building permit application for a new principal structure. After a cursory review of
the building permit application, Staff noted proposed grading with 75 feet of the Ordinary High Water Level (OHWL).
Grading within 75 feet of the OHWL requires a council approval via a conditional use permit(CUP). This issue was not
apparent when planning staff met with your staff and homeowners or it would have been noted at that time. The
proposed grading appears to be outside the level of backFill grading that our Building Official can approve as part of a
demolition permit. Attached is a copy of the CUP application. Please note the deadline for the first available meeting
is Wednesday, May 22, 2013 at Noon. This deadline is for the June 17th Planning Commission and July 8 C'rty Council
meeting dates.
in the meantime,we continue to review the permit for the home. The following items must be submitted or revised
in order for your application to be considered complete and for the plan review to continue:
1. Demolition Permit Application. Please complete the enclosed demolition permit application and return with
the required submittals as noted.
2. Escrow & Escrow Agreement. Permits involving grading and/or review by the City's engineer require
submittal of an escrow and an escrow agreement. The purpose of the escrow is to guarantee reimbursement
to the City for out-of-pocket costs incurred during the review of your plans. Additionally this escrow will
guarantee conformance with City Code Chapter 79 relating to erosion control and stormwater.The required
escrow amount for this project is$2,500. The escrow agreement is enclosed. The property owner must sign
the escrow agreement and submit a check for$2,500.
Your project may trigger the Minnehaha Creek Watershed District's(MCWD) permitting requirements; please contact
the MCWD regarding your project. Please note, the City of Orono will not issue a building permit without a copy of
MCWD permits or documentation from the MCWD stating the proposed projed does not trigger any of their
permitting requirements. The above information is required in order for the plan review to continue. Please feel free

1. Constructian of the new residence located at 4395 North Shore Drive the ("Subject
Property'), legally described as Lots 3, 4 and the west '/2 of lot 5, Saga Hill Revised,
Hennepin County Minnesota, is #he subject of building perrnit application number
2013-00317 has been completed.
2. Winter conditions currenUy prohibit completion of exterior improvements, final grading,
and vegetation establishment. An as-buiit survey cannot be accUrately conducted at this
time.
3. Owners request the City issue a temporary certificate of occupancy ("TCO") to the
Owners so that the Owners may occupy the new residence.
4. The City will issue a TCO oniy if the Owmers establish an escrow to ensure completion of
exterior improvements, continuation of erosion control and subm'rttal of an as-built survey
to the City.
NOW THEREFORE,THE PARTIES AGREE AS FOLLOWS:
1. DEPOSIT OF ESCROW FUNDS. Contemporaneously wwithh the execution of this Escrow
Agreement, the Owners shall deposit$10,OQ0 with the City. All accrued interest, if any, shall be paid to
the City to reimburse the City for its cost in administering the escrow account.
2. PURPOSE OF ESCROW. The purpose of the escrow is to assure completion of any
exterior improvements, final grading, establishment of vegetation as well as guarantee reimbursement to
the City for all out-of-pocket c�sts the City has incurred (including planning, engineering, in excess of
$500, or legal consultant revisvv)or will incur in reviewing the plan. Eligible expenses shall be consistent
with expenses the Owners wauid be responsible for under a building perm� appliqtion. The escrowr will
also guarantee reimbursement to the City for all out-of-pocket costs the City has incurred to assure that
the work is completed in accordance with the Stormwater Pollution Prevention Plan and the provisions of
Orono City Code Chapter 79. The financial security may also be used by the City to eliminate any
hazardous conditions associated arith the work and to repair any damage to public property or
infrastructure that is caused by the work (including pfanning, engineering, or legal consultant review)
associated with building permit #2013-00317 if compliance with the approved building permit is not
accomplished.
3. MONTHLY BILLIIVG. As the City receives consultant bills for incurred costs, the City witl
in tum send a bill to the Owners. Ovmers shall be responsible for payment to the City within 30 days af
the Owners' receipt of bill.
4. DISBURSEMENT FROM ESCROW ACCOUNT. In the event that the Quvners do not make
payment to the City within the timeframe outiined in#3 above,shall issue a Stop Woric Order until the Owners
pay all expenses invoicsd pursuant to#3. The City may draw from the escrow account without further approval
of the Owmers to reimburse the City for eligible expenses the City has incurred.
5. CLOSING ESCROW. The Balance on deposit in the escrow, if any, shali be retumed to
the Owners wrhen the review has been compteted and written notification is received from the Owners
requesting the funds.

6. CERTIFY UNPAID CHARGES. If the project is abandoned by Owners, or if the eligible
expenses incurred by the City exceed the amount in escraw, the City shall have the right to certify the
unpaid balance to the subject property pursuant to Minn. Stat.§§415.01 and 366.012.
'7. ACCESS TO SUBJECT PROPERTY. The Owners hereby grant to the City, its agents,
employees, officers and contractors, the right to enter upon the subject property #or the specific purpose
�f inspecting and completing any exterior improvements, final grading, establishment of vegetafion and
the restoration of the subject property should the Owners not cflmplete the work by the specified dates.
