A RBSOLUTION GRANTING A VARIANGS TO ORDINANCB NO. 96, SECOND SffitIBS, AND APPROVING A �S AND BODNDS SUBDIVISION OF A LOT LINE REARRAZJGIIKBNT FOR PROPSRTIES LOCAT$D AT 4345 AND 4365 I�ORTS SHORS DRaVS FII,$ �1695 WH$REAS, the City of Orono is a municipal corporation organized and existing under the laws o£ the State of Minnesota; and WHBREAS, the City Council of the City of Orono (hereinafter "City Council") has adopted subdivision regulations for the orderly, economic and s�fe development of land within the City; and WHEREAS, on August 26, 1991, the City Council adopted Ordinance No. 96, Second Series, an ordinance establishing an interim moratorium on the granting of land subdivisions that have not received preliminary approval from the City; and WHERBAS, the City Council has considered the application for a subdivision of a lot line rearrangement by Thomas and Alice Stuck of 4365 North Shore Drive and John Bauer �of 4345 North Shore Drive (hereinafter "the subdividers") of properties legally described as follows: A. The North 125 feet of the West half of Lot 6, and the East half of Lot S, � Block 18, "Saga Hill Revised, Hennepin Co Minn. ". B. Lots 7, 8 and the East half of Lot 6; ALSO that part of the West half of Lot 6 lying South of the North 125 feet thereof, Block 18. "Saga 8i11 Revised, Hennepin Co Minn."; and WH$RBAS, the subdividers hav e requested a variance to Ordinance No. 96, Second Series to allow the proposed subdivision of a lot line rearrangement to proceed; and Page 1 of 3 r �t � � �t . � O� O o ��v CITY of ORONO �. a �'� ' ;� � ,�, �Q �,� s � P ` �`� �'�' RESOLUTION OF THE CITY COUNCIL � 3042 ��kESII�g'� NO. �iTH$REAS, the Orono Planning Commission reniewed the request for the moratorium variance on October 21, 1991 and recommended approval, finding that no new building lots will be created by the proposed subdivision; and , WSERBAS, the City Council finds that the proposed variance is not contrary to the intent of the Comprehensive Plan, that it is compatible with the zoning and official control amendments being considered by the City as part of the Shoreland Regulation review process, that it promotes the health, safety and welfare of the citizens, and that failure to grant the variance would create a hardship for the applicant; and � 1�1HERB�IS, the subdividers have completed all requirements of the City far metes and bounds subdinision for division and combination purposes. , I�OW, THER$FORE, B$ IT RESOLV$D, that the City Council of the City of Orono hereby grants a variance to Ordinance No. 96, Second Series and hereby approves the metes and bounds subdivision of a lot line rearrangement for Thomas and Alice Stuck and John Bauer as shown on the Certificate of Survey by Mark S. Gronberg dated September 30, 1991 and attached to th3s resolution, sub�ect to the following conditions: l. Upon approval of this subdivision by the City Council of ° Orono, the owner of Parcel A as described in the Certificate of Survey referenced above must apply to the City for legal combination for tax purposes with Parcel C as described in that same survey. 2. The aforesaid division as shown on the attached Certificate of Survey shall be filed by the City of Orono with the Hennepin County Recorder's office on or before May 12, 1992 together with a c�rtified original copy of this resolution. The approval granted by this Resolution shall expire if the division has not been filed by the date specified above. In that event, it will be necessary to file a new application with the City of Orono for subdivision review.
