6. We have read and understand Rule F of the Minnehaha Creek Watershed District and assert that we are in
compliance with that rule, which states in pertinent part:
CRITERIA FOR tAYING SANDBLANKEfS. All permitted sandblanketing shall comply with the following standards:
A The sand or gravel used must be clean prior to being spread. The sand must contain no toxins or heavy
metals, as deflned by the Minnesota Department of Natural Resources, and must contain no weed
infestations, such as water-hyacinth, alligator weed, Eurasian watermlifoil, or animal life infestations, such
as zebra muscles or their larva. Violators w81 be prosecuted to the full extent of the law.
B. The sand layer must not exceed six inches in thickness, 50 feet in width along the shoreline, or one-haif the
width of the lot, whichever is less; and may not extend more than ten (10) feet waterward of the ordinary
highwater mark.
C. Only one installation of sand or gravel to the same location may be made during a four-year pe�od. After
the four years have passed since the last blanketing, the locatfon may receive another sandbianket

Dear Mr. Strelow:
As you are aware, a site inspection was performed at your property
on May 24 , 1994 . Those present at the site inspection discussed
the current status of your shoreline. It was noted that the
placement of sand had exceeded what was originally permitted by the
watershed district. The placement of additional sand beyond what
was permitted is currently considered a violation of District
rules. You and your contractor both agreed to remove a portion of
the sand to comply with the specifications submitted as part of
your permit application.
Furthermore, it was agreed that the rip rap placement along the
entire shoreline needs to be refined so that current voids between
rocks are filled.
This matter will be reviewed at the next Complaints and Violations
Committee meeting on Thursday, May 26, 1994 aL 6: 00 p.m. in tne
Grays Bay Room, Minnetonka Community Center, 14600 Minnetonka
Community Center, Minnetonka. You are welcome to attend this
meeting.

Dear Mr. Valek:
At a site inspection on August 2, 1994, it was confirmed that remedial work, agreed
to on May 24, 1994, was still not completed. The required remedial work consists
of:
l. Removal of sand in excess of 6-inches in depth and in conformance with the
City of Orono's requirements.
2. Removal of top rocks of riprap installation such that riprap does not extend
above level of natural shoreline.
3. Hand-placement of rocks in existing riprap voids with rocks removed above
and/or additional rock.
At the July 28, 1994, Minnehaha Creek Watershed District Complaints and
Violations Committee Meeting, a deadline of August 19, 1994 was set for
completion of the above work. The above deadline has been set prior to the hearing
regarding your Shoreline Improvement Contractor License scheduled for August 23,
1994 at 4:00 p.m.

Notice of Public Hearing On Shoreline Contractors License
Dear Mr. and Mrs. Valek:
I am writing to confirm my telephone conversadon with Mrs. Valek and Mr. Andrew
Syverson, the Engineer for the Minnehaha Creek Watershed District, on Wednesday, August 3.
As we have discussed, the Minnehaha Creek Watershed District Board of Managers has,
based upon a review of the status of this project, initiated a public hearing to review the status
of the shoreline improvement contractor license of Landmen Construction. Pursuant to MCWD
Rule M, the District provides thirty (30) days advance notice to the licensee concerning such a
hearing, unless the licensee waives the thirty-day period and requests a hearing prior to that time.
Based upon my previous conversations with you, we had initially set the hearing date for
Thursday, August 11 at 4:00 p.m.
The MCWD Board of Managers met again on July 28, 1994 to review the status of this
matter and your letter indicating a desire to wait to perform the remedial work until November
of this year. As indicated to you by the letter from Andrew Syverson dated August 2, 1994, the
Board of Managers decided to set a deadline for the remedial work of August 19, 1994, and to
reschedule the public hearing concerning your shoreline improvement contractor license for

August 23, 1994 at 4:00 p.m. at the Minnetonka City Hall. The public hearing on August 23 will
review the status of this project, any outstanding or past violations of District Rules, applicable
permit conditions, or other law relating to the construction of shoreline improvements, and will
review the ability of the licensee to do business according to the provisions of the District's
Rules or a permi� Pursuant to MCWD Rule M, the MCWD Board also may consider whether
the license should be revoked, suspended, or made subject to condidons, and the bond forfeited.
Again,as I indicated by telephone,if the remedial work described in Mr. Syverson's letter
of August 2 has been completed on or before August 19,then I would recommend to the MCWD
Board that the public hearing scheduled for August 23 be cancelled.

At a site inspection on August 22, 1994, it was confirmed that remediai work, as specified in
a previous letter dated August 2, 1994, had not been fully completed. The required remedial
work remaining consists of:
1. Removal of sand in excess of 6-inches in depth and in conformance with the
City of Orono's requirements. Some sand had been removed, prior to the
above referenced site visit, but what remains does not conform with either of
the above requirements.
2. Removal of top rocks of riprap installation where the riprap extends above the
level of the natural shoreline. This had not been done.
3. Hand-placement of rocks in existing riprap voids with rocks removed above
and/or additional rock. It appears that landscape binder rock was poured over
the top of the existing installation. While this may be somewhat beneficial,
the intent was to "hand-place" various sized rocks into existing voids such that
the finished product be well packed and contain no significant voids.
Additional effort along these lines is required.

This letter is to serve as a final extension to allow Landmen Construction, Inc. to complete
the above remedial work. The public hearing concerning your shoreline improvement
contractor license is rescheduled for September 6, 1994 at 4:00 p.m. at the Minnetonka City
Hall. At the hearing, tne MCWD Board may consider whether your license shall be
revoked, suspended, or made subject to condition and the bond forfeited.
Please call me (479-4224) or Louis Smith (334-8731) should you have any questions
concerning this matter. Questions could also be addressed at the August 25, 1994,
Complaints and Violations Committee meeting schedule for 6:00 p.m. at the Minnetonka
