MUNICIPAL ZONING CODE
SECTIONS 78-1282 8 78-1680
AND A CONDITIONAL USE PERMIT
PURSUANT TO MUNICIPAL ZONING CODE
SECTION 78-966

WHEREAS, Bradley A. Cleveland Trust Dated 90/10/08, (hereinafter °the
Owne�') are the owners of the property located at 4395 No�th Shore Drive within the City of
Orono (hereinafter the "City") and legally described as: That part of Lots 9, 10, 11, and 12,
Block 18, Saga Hill Revised, which lies westerly of the flowing described line, and its
extensions: Commencing at the point of intersection of the West line of said Lot 9 with
th� shoreline of Lake Minnetonka; thence on an assumed bearing of North 1 degree 53
minutes East along the West line of said Lot 9. to the Northwest corner of said Lot 9;
thence easterly a distance of 233.50 feet along a curve not tangential with the last
described line, said curoe is concave to`the South, has a radius of 1043.0 feet, a central
angle of 12 degrees 49 minutes 37 seconds and a the chord of said curve bears South 76
degrees O5 minutes 32 seconds East �to the point of beginning of the line being
described; thence South 11 degrees 05 minutes 18 seconds West to the shoreline of
Lake Minnetonka, and said ,line there ending, Hennepin County, Minnesota (PIN 07-117-
23-43-0028) (hereinafter the "Property"); and
, WIiEREAS, Bradley A. Cleveland, the trustee of the Bradley A. Cleveland Trust
Dated 10/10/08 (hereinafter the "Applicant") on behalf of the Owner has made applEcation to the
City of Orono for a conditional use permit (hereinafter the "CUP") pursuant to Orono Municipal
Zoning Code Section 78-966 to allow grading for construction of a new lake access pathway
and-stair system in conjunction with removal the existing stairs within the 75-foot setback on the
Property; and
WHEREAS, after due published notice and mailed notice in accordance with
Minnesota Statutes and the Orono, Minnesota, City Code, a public hearing was held by the
Orono Planning Commission on August 18, 2014 at which times all persons desiring to be heard
concerning this application were given the opportunity to speak thereon.

NOW, THEREFORE BE IT RESOLVED by the City Council of Orono,
Minnesota:
FINDINGS
1. This application was reviewed as Zoning File number 14-3680.
2. The Property is located in the LR-1 B One Family Lakeshore Residential Zoning
District which requires a minimum lot area of 1.0 acre and a minimum lot width of
140'.
3. The Planning Commission reviewed this application at a public hearing held on
August 18, 2014 and voted 6 for and 0 against on a motion to approve the CUP.
The Planning Commission finds that the following factors support the granting of
the requested CUP:
a. The Property contains 78,370 square feet in area and has a defined width of
173 feet at the lake and 182 feet at the 75-foot setback.
b. A new residence home on the Property is currently under construction.
c. The Applicant's proposed pathway/stair system is set into the grade and has
been designed -in a way which offers screening of the stairs with a natural-
looking slope as viewed from fhe lake.
d. With a total of 23% overall hardcover, the Property will conform to the
hardcover limitations of a Tier 1 lot.
e. The proposed pathway/stair system within the 75-foot setback area will have
no impact on surrounding lands. Drainage pattems for runoff leaving the site
are not proposed to be signi�cantly altered.
f. The Applicant's proposed pathway/stair system will not alter the essential
character of the neighborhood and will result in minimal or no negative impact
on adjacent properties.
g. The Applicant's project will not adversely impact views of the lake currently
enjoyed by the adjacent properties; views of the property from the lake will be
improved with the new stair and landscape screening offered.
h. The Applicant's request is in harmony with the purpose and intent of the
ordinance.

i. The Applicant has demonstrated that enforcing the provisions of the Zoning
Ordinance deprives the Applicant of the reasonable use of their Property.
j. The Applicant has provided a landscape plan which will serve to screen and
mitigate views of the pathway and stairs from the lake in a natural manner.
4. The City Council has considered this application including the findings and
recommendation of the Planning Commission, reports by City staff, comments by
the Applicants and the public, and the effeet of the proposed CUP on the health,
safety and welfare of the community.
5. The City Council finds that the conditions existing on this Property are peculiar to
it and do not apply generally to other property in this zoning district; that granting
the variance and CUP would not adversely affect traffic conditions, light, air nor
pose a fire hazard or other danger to neighboring property; would not merely
serve as a convenience to the Applicants, but is necessary to alleviate a practical
difficulty; is necessary to preserve a substantial property right of the Applicants;
and would be in keeping with the spirit and intent of the Zoning Code and
Comprehensive Plan of the City.
CONCLUSIONS, ORDER AND CONDITIONS
Based upon one or more of the above findings, the Orono City Council hereby grants a
CUP pursuant to Orono Municipal Zoning Code Section 78-966 to allow grading for construction
of a new lake access pathway and stair system in conjunction with removal the existing stairs
within the 75-foot setback on the Property; subject to the following conditions:
1. Council approval is based on the survey and landscape plan submitted by the Applicant
and annotated by City staff, attached to this Resolution as Exhibits A � B. Any
amendments to the approved survey and plan �vhich are not in conformity with City
codes will require further Planning Commission and City Council review.
2. The Applicant shall install landscaping to screen the proposed improvements when
viewed from the lake according to the plan submitted as Exhibit B.
3. Proposed hardcover levels shall be conforming to the Tier 1 standards; no hardcover
variances are granted. Structural coverage limitations shall also be met.
4. Authorities granted by this resolution run with the Property not with the Applicant, but are
permissive only and must be exercised by obtaining a zoning permit for land alteration

for the pathway and stairs and commencing construction of said project within one year
of the date of Council approval, or the CUP will expire on that date (September 8, 2015).
5. Violation of or non-compliance with any of the terms and conditions of this resolution
shalt constitute a violation of the zoning code, shall automatically terminate any authority
granted herein, and shall be punishable as a misdemeanor.
6. The undersigned Applicant has read understands and hereby agrees to the terms of this
resolution and on behalf of the Applicant and the Applicant's heirs, successors and
assigns, hereby agrees to the recording of this resolution in the chain of title of the
Property.
