Permit Conditions: Initials
Erosion control mechanisms must be installed and inspected by the City prior to any land
disturbing activities. The contractor must provide a minimum of a 24 hour notice prior to
inspection.
Erosion control shall be installed and maintained throughout the entire project and must
remain until vegetation has been established.
Prior to the refund of the escrow money an as-built survey and hardcover calculations must be
submitted and approved. All disturbed areas must be established with vegetation.
NOTE: The survey incorrectly shows the proposed stairs as 3.5' in width. The building plans are
correct and show the stairs 3' in width. The new stairs must be constructed in accordance with - I
the approved building plan. No new structure(including stairs) is allowed to encroach within �w
the 10'side yard setback.
Advisory Comments
Any changes to the exterior/landscaping improvements, i.e. patios,grading,sidewalks, retaining
walls,etc. not currently shown on the approved survey and landscaping plan will require a
separate Zoning Permit application to be submitted and approved prior to the work
commencing.
Any retaining walls that are over 4-feet in height or tiered walls not separated by twice of the
height of the lower wall require engineered plans and a building permit to be submitted and
approved prior to construction.

On April 1,2016 the City received a building permit application for replacement of existing decks and construction of a
new lower deck. Staff conducted a preliminary review based on the information provided and recommends the
following items be submitted or revised in order for your application to be considered complete and for the plan review
to continue:
1. Certiflcate of Survey. An electronic copy of a sunrey dated January 14, 2016 was submitted, however the
survey does not match the proposed plans,for example the stairs shown on the survey are 3'-5"wide and the
plans show the stairs to be 3'wide. Please have the survey updated to reflect the plans and submit two copies
of an updated,full-size certificate of survey which meets all of the City's survey standards (enclosed). Also,
please have the survey updated to reflect the elevation of the lower deck,i.e.how far is the new portion of the
lower deck above existing topography.
2. Construction Plans. The plans submitted are not to scale. Please submit two sets of constructions plans to
scale.
3. landscape Plan. Will there be any changes to the landscaping with the proposed lower deck? If so,the City
requires a landscape plan be submitted showing all the proposed exterior/landscaping improvements, i.e.
patios,grading,sidewalks,retaining walls,etc. The plan should include the name of the individual performing
the work. Any proposed patios, grading,sidewalks, retaining wralls shown on the landscape plan should also
be reflected on the survey.
� 4. Hardcover Calculations. The property is located in Tier 1 of the Stormwater Quality Overlay District. Please
__ , have the surveyor prepare updated hardcover calculations after the survey has been updated. Enclosed is a
�.(��;� '� copy of the City's Hardcover Information Packet.
��1 5. Escrow&Escrow�reement. Permits involving grading and/or review by the City's engineer require submittal
of an escrow and an escrow agreement. The purpose of the escrow is to guarantee reimbursement to the City
for out-of-pocket costs incurred during the review of your plans. Additionally this escrow will guarantee
���✓ conformance with City Code Chapter 79 relating to erosion control and stormwater. The required escrow
' . � amount for this project is$700. The escrow agreement is enclosed. The properiy owner must sign the escrow
� � agreement and submit a check for$700.

6. Minnehaha Creek Watershed District (MCWD). Your project may trigger the Minnehaha Creek Watershed
District's (MCWDs) permitting requirements; please contact the MCWD directly at 952-471-0590 regarding
your project. Please note,the C'ity of Orono will not issue a building permit without a copy of the MCWD permit
or documentation stating the proposed project does not trigger any of their permitting requirements.

NfJW THEREPORE,THE PARTIES SGREE AS FOLLCIWS:
1. DEPOSIT OF ESCROW FUNDS. Contemparen�usty with the execu�on of this Escrow
Agreemerrt, the Owners shall deposit$7�0 with the City. All accrued interest, if any, shall be paid to the City to
re9mburse the Ciiy for its cast in administering the escrow aa�unt.
2. PURPOSE OF ESCROW.The purpase of the escrow is to guarantee reimbursement to the City
fo� ail out-of-pocket c�sts the Cit�+ has incurre�d (including planning, enginee�ng, in excess of $500, or legal
cQnsuftant review) or vv11{ Incur In reviewing the plan. Eligible expenses shafl be c�ns(stent with expen�es tl�e
Owners vrauld ba responsible for under a building permit applic��lon. The escrow will alsa guarantee
reimbursement to the City for all out-of-pocket costs the Clty has Ina�ned to assure that the work is completed in
acxordance with the Storrrnnrater PoNution Prevention Plan and the provislons of Orono City Code Chapter 79.
The financial security may also be used by the City to eliminate any hazardous oonditions associsted with the
work and to repair any damage to public property or infrastruc�re that is caused by the work(including planning,
engineering, or legal consultant review) associated with buflding permlt #2076-00357 if compliance writh the
approved building permft is not acxomplished.
S. MONTHLY BfLLING. As the City receives consultant bills for incurred c�sts, the Cfly will in turn
send a bi{I ta the Owners. Owne�s shall be responsib{e for payinent to the Cfty within 30 days af the Ovmers'
�eceipt of bilt.
4. DfSBURSEMENT FROM ESCROW ACCOUNT. In the everrt that the Owners do not make�yment
to the City within the�imeframe oudined in#;i ebove, sha[I issue a Stop Work Orsier un�l the Owners pay all sx�nses
invoiced pursuarrt to #3. The City may draw fram the escrow accourrt wit�out further approval af the Owners to

'I'he work for which this permit is issued shall be performed according to
the approved plans and specifications,applicable City approvals,and the
State Building Code. This permit is for only the work described and does
not grant permission for addirional or related work which requires separate
permits. All provisions of laws and ordinances goveming this type of work
shall be compied with whether or not specified herein.This permit will
eacpire and become null and void if construction authorized is not
commenced within 180 days of the date of issuance,or if construcrion is
suspended for a period of 180 days at any time after work has commenced.
'I'he applicant is responsible for assuring all required inspections are
requested in conformance with the State BuIlding Code.This permit may be �
revoked at any time for due cause. G
