I realized I had misunderstood the plans and as a result a portion of the owner's suite cantilever is in error. When I reviewed the plans for the building permit I though the westerly wall of the second floor was set in 18 inches from the wall of the first floor so the eave extended 18 inches from the first floor wall. As you may recall,you had to reduce the eave on the east side from 24 inches to 18 inches because only an 18 inch encroachment into the 10 foot setback is allowed. The code was recently changed to allow a two � foot encroachment so there is no problem with the eave along the westerly side of the house. However there is a problem with the cantilevered area of the owner's suite. My misunderstanding of the plan places the westerly 18 inches of this area within the average lakeshore setback. The average lakeshore setback was for the decks steps only.I have discussed the situation with Soren Mattick,the City Attorney, he indicated and I concurred that since there is no variance for it the portion of the cantilever than is within the average lakeshore setback must be removed. I apologize for my error. Unfortunately we are dealing with a code so I have no room to make an accommodation. Please submit plans for the revision to the cantilever to Lyle Oman, Building Official.
