A RESOLUTION GRANTING VARIANCES
TO MUNICIPAL ZONING CODE
SECTIONS 78-1288,78-1282 AND 78-330
FILE NO. 06-3246
WHEREAS, the Estate of Mary Peterson, (hereinafter "Owner") is the
owner of the property located at 4205 North Shore Drive within the City of Orono
(hereinafter "City") and legally described as: That part of Lot 2 "Orchard Beach", lying
Southeasterly of the following described line and its Northeasterly extension: Commencing at
the Northeast corner of Lot 3, "Orchard Beach"; thence on an assumed bearing of North along
the Northerly extension of the East line of said Lot 3 a distance of 78.92 feet; thence on a
bearing of West a distance of 89.50 feet to the point of beginning of the line being described;
thence South 31 degrees 56 minutes 53 seconds West to the Southwesterly line of said Lot 2
and there ending. Subject to the easement for County State Aid Highway No. 19 as shown in
Hennepin County Highway Plat no. 50 recorded as Cr doc. 4746024. Subject to a perpetual
easement for underground utility purposes in favor of the City of Orono as contained in CR
Doc. No. 3925296. Hennepin County, Minnesota (hereinafter"the Property"); and
WHEREAS, Highmark Builders has made application on behalf of the Owner
to the City for a variance to Municipal Zoning Code Section 78-1288 to allow 28.4 percent
hardcover in the 75 to 250 foot zone when 25 percent is allowed. and
WHEREAS, Highmark Builders has made application on behalf of the Owner
to the City for a Variance to Municipal Zoning Code Section 78-1282 to allow
encroachments into the average lakeshore setback by the house and an encroachment into the
average lakeshore setback by deck stairs; and
WHEREAS, Highmark Builders has made application on behalf of the Owner
to the City for a Variance to Municipal Zoning Code Section 78-330 to allow construction of
a replacement residence on a lot with an area of 0.62 acre when 1.0 acre is required and a
width of 60 feet when 140 feet is required; and
WHEREAS, after due published notice and mailed notice in accordance with
Minnesota Statutes and the City of Orono Zoning and Planning Codes, the Orono Planning
Commission held a public hearing on March 19, 2007, at which times all persons desiring to
be heard concerning this application were given the opportunity to speak thereon.

NOW, THEREFORE, BE IT RESOLVED by the City Council of Orono,
Minnesota:
FINDINGS
1. Tliis application was reviewed as Zoning File#06-3246
2. The property is located in the LR-1B zoning district, where 1 acre is the
minimum lot area and 140 feet is the minimum lot width. The property is
approximately 0.62 acre in area and 60 feet in width.
3. The Planning Commission reviewed this application on March 19, 2007 and on
a vote of 5 - 2 recommended approval of the variances, based on the following
fmdings:
a. The lot is a legal lot of record created prior to adoption of the current
Zoning Ordinance minimum area and width lot requirements.
b. The lot is provided with City sewer.
c. The Owner is not able to acquire additional property to meet minirnum lot
width and area requirements.
d. A house has existed on the lot since 1951.
e. The property is bisected by a sewer easement. Placing the house on the
street side of this easement would create a hardship because the house to
the west would be 20 feet closer to the lake and the house to the east would
be 70 feet closer to the lalce so lake views would be limited. The hazdcover
proposed in excess of that allowed is the amount required to extend the
driveway into the 75 to 250 foot zone.
f. The property to the west is also bisected by the sewer easement. Because
the easement crosses that property at an angle toward the lake the house on
that property is located on the street side of easement. This creates a
limited area between the sewer easement and the average lakeshore
setback. Because of the design of the proposed house and the angle of the
average lakeshore setback the proposed encroachment into the average
lakeshore setbacic will have minimal impact on lake views from this

adjacent house. (Lake views from this property will actually improve as the
existing house is forward of the average lakeshore setback.)
4. The City Council has considered this application including the findings and
recommendation of the Planning Commission, reports by City staff, comments
by the applicants and the public, and the effect of the proposed variance on the
health, safety and welfare of the community.
5. The City Council finds that the conditions existing on this property are peculiar
to it and do not apply generally to other property in this zoning district; that
granting the variances would not adversely affect traffic conditions, light, air
. nor pose a fire hazard or other danger to neighboring property; would not
merely serve as a convenience to the owner, but is necessary to alleviate a
demonstrable haxdship or difficulty; is necessary to preserve a substantial
property right of the applicants; and would be in keeping with the spirit and
intent of the Zoning Code and Comprehensive Plan of the City.
CONCLUSIONS, ORDER AND CONDITIONS
Based upon the above findings, the Orono City Council hereby grants variances to Orono
Municipal Zoning Code Sections 78-1288, 78-1282, and 78-330 subject to the following
conditions:
1. Council approval is based on the site and house plans submitted by the
Applicant and annotated by City staff, attached to this Resolution as Exhibits
A. and B. Any amendments to these plans may require further Planning
Commission and City Council review.
2. Hardcover in the 0-75' zone shall be limited to 35 s.f. or 0.8 %. Hardcover in
the 75-250' zone shall be limited to 3,512 s.f. or 28.4%. Hardcover in the 250-
500' zone shall be limited to 2,732 s.f. or 26.39 % per the proposed site plan
and hardcover allowance summary as depicted on Exhibit C. The Owner is
advised that any future requests to increase hardcover or change the nature of
existing/approved hardcover shall require City approval, and increases in
hardcover will not likely be approved without concurrent reduction in existing
hardcover.

3. Owner shall not place any plastic or fabric liner material under any landscaping
on the property to ensure their permeability as non-hardcover surfaces.
4. Authorities granted by this resolution run with the Property not with the '
Owner, but aze pernussive only and must be exercised by obtaining a building
permit for the new construction before Apri19, 2008 or the variance will expire
on that date.
5. Violation of or non-compliance with any of the terms and conditions of this
. resolution sha11 constitute a violation of the zoning code, shall automatically
terminate any authority granted herein, and shall be punishable as a
misdemeanor.
6. The undersigned Owner has read, understood and hereby agrees to the terms of
this resolution and on behalf of its successors and assigns, hereby agrees to the
recording of this resolution in the chain of title of the property.
