TO MUNICIPAL ZONING CODE
SECTION 78-1288
AND A CONDITIONAL USE PERMIT
PER MUNICIPAL ZONING CODE
SECTION 78-1286 AND 78-1250 SUBDIVISION 1

(hereinafter "the applicants") are the owners of the property located at 4203 North Shore '
Drive within the City of Orono (hereinafter the "City") and legally described as follows:
Part of Lot 3, Orchard Beach, Heiuiepin County, Minnesota (hereinafter
the "property"); and
WHEREAS, the applicants have made application to the City of Orono
for a variance to urono Iviunicipai Zoning Cocie Section 78-1��u to aiiow a iiardcover
variance for 0.9% within the 0-75' setback zone where 0% is normally allowed and 1.6%
previously existed.
WHEREAS, the applicants have made application to the City of Orono
for a conditional use pennit pursuant to Orono Municipal Zoning Code Sections 78-1286
and 78-1250 to allow grading within the 0-75' setback zone for stair installation.

� FINDINGS
l. This application was reviewed as Zoning File #Q6-3230.
2. The property is located in the LR-1B, Sin�le Fainily Lakeshore
Residential zoning dishict, which requires a minimum of 43,560 s.f. or 1.0
acre in area and 140' in width. The applicants' property is 45,746 s.f.
(1.05 acres) in lot area and 90' in width at the shoreline and 11 T at the 75'
setback line.

3. The Planning Commission reviewed this application at a public hearing
' held on September 18, 2006 and recornmended approval of the hardcover
variance and conditional use permit based on the following fiildings:
a. City Code 78-1282 allows for the installatioli of stairs, lifts and
landings in place of major topographic alterations on steep slopes.
b. The proposed changes to the stair system and wall result in a reduction
in hardcover from 1.6%to 0.9%.
c. The proposed 0:9% hardcover is allowed pursuaut to City Code 12-
1282.
d. The pre-existing concrete stairs had a greater visual irnpact from the
lake than the proposed stair systern.
e. The proposed glacial boulder walls will be minimal and screened from
the lake by vegetation for a natural laoking slope.
f. The applicants have provided a restoration plan meeting the goals and
intent of the Zoning Code and the Orono Community Management
Plan.
4. The City Council has considered this application including the findings
and recommendation of the Planning Commission, reports by City staff,
cam.�-nents by the applicants and the public, and the effect of the proposed
variance on the health, safety and welfare of the commuiuty.
5. The City Council finds that tlle conditions existing on this property are
peculiar to it and do not apply generally to other property in this zoning
district; that granting the variance would not adversely affect traffic
conditions, light, air nor pose a fire hazard or other danger to neighboring
property; would not merely serve as a convenience to the applicants,but is
necessaxy to alleviate a demonstrable hardship or difficulty; is necessary to
preserve a substantial property right of the applicants; and would be in
keeping with the spirit and intent of the Zoning Code and Comprehensive
Plan of the City.

CONCLUSIONS, ORDER AND CONDITIONS
' Based upon one or more of tl�e above fmdings, the Orono City Council hereby
grants a variance to Orono Municipal Zoning Code Section 78-1288 (B) to allow
hardcover within the 0-75' setback zone consisting of 0.9%, and a conditional use permit
per 78-1282 for the construction of a new granite stair system, regrading of the slope and
installation of a low boulder wall subject to the following conditions:
1. Council approval is based on the site plans submitted by the applicants and
annotated by City staff, attached to this Resolution as Exhibits A & B. Any
amendments to the site plans which are not i.n conformity with City codes will
require further Planning Commission and City Council review.
Z. Hardcover in the 0-75' zone shall not increase above 69 s.f. or 0.9% per the
proposed plan and hardcover allowance summary as depicted on Exhibit A.
Applicants are advised that any future requests to increase hardcover or change
the nature of existinglapproved haxdcover shall require City approval, and
increases in hardcover will not likely be approved without concurrent reduction in
existing hardcover.
3. Authorities granted by this resolution run with the property not with the
applicants, but are permissive only and must be exercised by obtaining a building
permit for the new construction within one year of the date of Council approval,
or the variance will expire on that date(November 13,2007).
4. The applicants' contractor must obtain an after-the-fact building permit for the
lake access stair and grading work within 30 days from the date of this e
Resolution.
5. Violation of or non-compliance with any of the terms and conditions of this
resolution shall constitute a violation of the zoning code, shall automatically
terminate a.ariy authority granted herein, and shall be punishable as a misdemeanor.
6. The undersigned applicants have read, understand and hereby agree to the terms
of this resolution and on behalf of the applicants and the applicants' heirs,
successors and assigns, hereby agree to the recording of this resolution in the
chain of title of the property.
