The Planning Cornmission reviewed this application at a public hearing held on August 15, 2005 and recormnended approval of the lot width variance and conditional use pemut based on the following findings: a. The lot is a legal lot of record created prior to adoption of the current Zoning Ordinance minimum area and width lot requirements. The property is 1.05 acres in area and has 90' in width at the shoreline and 117' in width at the 75' setback. b. The proposed residence meets all other Zoning Ordinance requirements with respect to setbacks, lot coverage by structures, hardcover, and building height. c. The lot is provided with City sewer. d. The applicants are not able to acquire additional property to meet minimum lot width requirements. e. The applicants are relocating the driveway and eliminating the shared driveway situation with the property to the east. � f. The request for fill in excess of 500 cubic yards will not impact the Property as viewed from the lake. g. The adjacent properties will not be negatively impacted by the proposed fill. h. The amount of fill proposed will not result in a net increase in the amount or rate of storm water beiizg directed to the adjacent eastern property in excess of cunent levels. 4. The City Council has considered this application including the findings and recommendation of the Planning Commission, reports by City staff, comments by the applicants and the public, and the effect of the proposed variance and conditional use permit on the health, safety and welfare of the community. The City Council finds that the conditions existing on this property are peculiax to it and do not apply generally to other property in this zoning district; that granting the variance and conditional use permit �vould not adversely affect traffic conditions, liDht, air nor pose a fire hazard or other danger to neighboring property; would not merely serve as a convenience to the applicants, but is necessary to alleviate a demonstrable hardship or difficulty; is necessary to preserve a substantial property right of the applicants; and would be in keeping with the spirit and intent of the Zoning Code and Comprehensive Plan of the City. CONCLIJS�ONS, O]EtI9ER�D COND�TIONS Based upon one or more of the above findings, the Orono City Council hereby grants a lot width vaxiance and a conditional use permit for fill in excess of 500 cubic yards per Orono Municipal Zoning Code Sections 78-330 (B), 78-967 (B) (2), and 78- 1286 (D) (2) to allow constructivn of a new residence on an e.cisting lot which has 90' in width at the shoreline and 117' in width at the 75' setback where 140' in width at both the shoreline and at the 75' setback is normally required, and to incorporate approximately 770 cubic yards of fill into the street side of the property, subject to the following conditions: 1. Council approval is based on the site plan and grading plan submitted by the applicants and annotated by City staff, attached to this Resolution as Exhibit A. Any amendments to the site plan which are not in conformity with City codes will require further Planning Commission and City Coltncil review. 2. I'roposed hardcover for the 0-75', 75'-250', and 250'-500' zones shall remain conforming at U%, 25%, and 30% respectively. Applicants are advised that any requests to increase hardcover beyond the allo�vable limits establislzed in City �ode Section 7�-12�� shall require City approval, and will not likely be approved. 3. Applicants by executing this variance approval covenant that all decorative landscape beds on the property shall not be lined with plastic or fabric liner material to ensure their permeability as non-hardcover surfaces. In order to comply with tlze Planning Commission's stipulation that the amount of fill brought onto the Property be monitored so as to ensure compliance with the approved grading plan, prior to any fill being brought onto the Property, the applicants or the applicants' representative shall make arrangements wi#h the City's Building Official and/or Building Inspector with respect to monitoring and haul routes. 5. Authorities granted by this resolution run with the property not with the applicants, but are permissive only and must be exercised by obtaining a building permit for the new construction within one year of the date of Council approval, or the variance and conditional use permit will expire on that date (September 12, 2006). 6. Violation of or non-compliance with any of the terms and conditions of this resolution shall constitute a violation of the zoning code, shall automatically terminate any authority granted herein, and shall be punishable as a misdemeanor. 7. '�he undersigned applicants have read, understand and hereby agree to the terms of this resolution and on behalf of the applicants and the applicants' heirs, successors and assigns, hereby agree to the recording of this resolution in the chain of title of the property.
