WITNESS, that Grantor(s), in consideration of the sum of One Dollar ($1.00) and other good and valuable consideration given by Grantee, the receipt of which is acknowledged by Grantor(s), do(es) hereby grant, bargain, sell and convey to Grantee, its successors and assigns, an easement for maintenance of sewer and water utilities, including the right to reconstruct the same, together with ingress, egress and access thereto over, above, under and across the land located in the State of Minnesota, County of Hennepin, legally described as follows: The southerly 10 feet of the following described Torrens property: That part of the West 57.3 feet of the East 115.05 feet of Government Lot 1, Section 8, Township 117, Range 23, lying North of a line drawn Westerly passing at right angles through the East line of said West 57.3 feet, at a point distant 165 feet North of its intersection with the Northerly line of "Lydiard's Park", Lake Minnetonka; all in Hennepin County, Minnesota (hereinafter the "easement") including but not by way of limitation, a full and free right of authority to enter upon said land to maintain, operate and repair a sanitary sewer or municipal water main or line, and the Grantee shall have the right to make use of said land as is reasonably necessary and advisable to the maintenance, opzration and repair of said facilities. In addition to any other remedy the Grantee may have, the covenants and restrictions contained herein may be enforced by injunction. TO HAVE AND TO HOLD said easement unto said Grantee, its successors and assigns, permanently.
