I'm following up on the email the MCWD sent you.
According to the Grant of Permanent Flowage and Conservation Easement and Restrictive Covenant for Conservation
Area; Wetland and Wetland Buffer(copy attached) retaining walls are not allowed within the easement area. Further,
according to City Code Section 78-1605 if there is a formal wetland buffer the City requires an additional 10' beyond the
wetland buffer.
A Zoning Permit is required in order for us to determine if the revised walls will conform to the above. Please have the
revised walls shown on the landscape plan and a revised survey(both to scale). Please note,walls which exceed 4' in
height or tiered walls not separated by twice the height of the lower wall require a Building Permit(instead of a zoning
permit) and engineered plans submitted for review.

encroach upon the declared 30'wetland buffer and no modification to your MCWD permit is needed. The 25'wetland

direct you in the right direction on required information and City process.

Good afternoon,
I just got a message back from emailing Terrance saying is was done working for the district and I got your contact
information from my coworker Katie. If I should be talking with someone else please let me know but here is the gist of
a project I am working on. Please let me know if you are able to assist me.
Please see the attached conceptual proposed plan and the survey information we have. We will need to put a wall
around the north corner of the house in order to make the yard usable. This wall will need to be roughly 7'tall at the
point that it will enter the wetland setback and continue approximately 52 feet parallel with the setback line and 13 feet
into the setback area at the furthest point. As a note the proposed contour lines are per the survey and new contour
lines will need to be made.
What I am wondering is what my options are for building this wall in the set back. We would like to get pricing to our
client sooner rather than later as there may be an opportunity to install the wall this winter which would be ideal for
soils to settle over the winter prior to completing the rest of the project. Any direction to paperwork and timelines
would be very helpful.
