Dear Deggendorfs
It has come to the attention of that office that you have recently constructed a lean too on your
garage at 4040 North Shore Drive in Orono. This letter is to notify you that the city of Orono requires
Building Permits for construction. The city also requires structures to be setback a minimum of ten
feet from the property line.
Therefore the city must require you to remove the structure from the property. A deadline of 12-07-
2009 has been established. If this deadline is not met the city will initiate legal action. If you have any

On November 11, 2009 the city notified you that the lean too you constructed on your garage at 4040
North Shore Drive in Orono was illegal and had to be removed. As of this date the issue remains
unresolved.
Therefore the city must require you to remove the structure from the property before May 10th, 2010.
If this deadline is not met the city will initiate legal action. If you have any questions please feel free

Dear Mr. and Ms. Deggendorf:
This office represents the City of Orono ("City"). The City has sent this matter to our
office for criminal prosecution of violations of the Orono City Code and Zoning
Ordinance.
It has been brought to our attention from Melanie Curtis, Planning and Zoning
Coordinator, that you have failed to maintain the property in compliance with the Orono
City Codes and Zoning Ordinances.
You have until July 30, 2010 to correct the violations on the above-referenced
property. Your failure to comply by July 30, 2010 will result in criminal
prosecution. Each violation is punishable by 90 days in jail and a$1,000 fine for
each day the violation continues to exist.
If you choose to avoid prosecution by correcting the violations, you must first correct
the violations and only then contact Melanie Curtis, Planning and Zoning Coordinator,
at (952) 249-4600 to inspect the subject property. A follow-up inspection must be
completed to verify compliance and eliminate any type of prosecution.
Please make further enforcement action unnecessary by complying with this letter
immediately.

Staff performed a follow-up inspection at the above address. During the inspection Staff
observed a lean-to constructed without a permit which does not appear to meet the required 10'
side yard setback violating City Code Sections 86-66 and 78-330(b).
Staff also observed a temporary structure located on the property. The City of Orono does not
allow temporary structures because they don't meet International Building Code requirements
(i.e. snow and wind load).
This letter will serve as your notice that the property must be brought into compliance by
June 15, 2010 in order to avoid legal action by the City. In order to bring your property into
compliance the above structures must be removed by June 15, 2010.
Please be advised, if you fail to correct the violations this matter will be sent to the City Attorney
for review and may result in criminal prosecution. I have attached the pertinent City Codes for

Sec. 86-66. Required.
It is unlawful for any person to erect, construct, enlarge, alter, repair, move, improve, remove,
convert, or demolish any building or structure, or any part or portion, including but not limited to the
general construction, plumbing, water well, on-site sewage treatment system, wood stoves and fireplaces,
ventilating, heating or air conditioning systems, or cause such work to be done, without first obtaining a
separate building or general permit for each such building, structure or separate component from the city.
(Code 1984, § 12.02)
Sec. 78-330. Area, height, lot width and yard requirements.
(b) Lots. The following minimum requirements shall be observed:

Re: City Code Violations at 4040 North Shore Drive
Property Identification Number: 07-117-23-44-0092
Staff performed a follow-up inspection at the above address. During the inspection Staff
observed a lean-to constructed without a permit which does not appear to meet the required 10'
side yard setback violating City Code Sections 86-66 and 78-330(b).
Staff also observed a temporary structure located on the property. The City of Orono does not
allow temporary structures because they don't meet International Building Code requirements
(i.e. snow and wind load).
This letter will serve as your notice that the property must be brought into compliance by
June 15, 2010 in order to avoid legal action by the City. In order to bring your property into
compliance the above structures must be removed by June 15, 2010.
Please be advised, if you fail to correct the violations this matter will be sent to the City Attorney
for review and may result in criminal prosecution. I have attached the pertinent City Codes for
your reference. If you have any questions, please don't hesitate to call me at 952.249.4600.

Re: Garage addition
Dear Deggendorfs
On November 11, 2009 the city notified you that the lean too you constructed on your garage at 4040
North Shore Drive in Orono was illegal and had to be removed. As of this date the issue remains
unresolved.
Therefore the city must require you to remove the structure from the property before May 10th, 2010.
If this deadline is not met the city will initiate legal action. If you have any questions please feel free
