Hello Rick,
Roger and I have looked over your revised plans you submitted today. Thank you for addressing the issues so
quickly. We have two remaining points of concern on the building plans.
1. This home received a side yard setback variance to allow for a 8.6 setback instead of 10'. In the bump-out along
the west side of the home,the roof is shown a foot taller than the approved variance allows. This roof peak will
need to be lowered to match the variance approved plans.
2. It looks like you redesigned the roofline on the lakeside of the home to address the height,thank you. However,
the new overhang in the center of the shed roof seems to start higher on the roof and extends farther out than
the variance approved roofline. This overhang will need to be shortened to match the variance approvals.
I also have a few questions regarding the as built:
1. The as built submitted today show retaining walls along the tuck-under garage. If these have not been
constructed yet they need to be removed. If they are existing the top of wall and bottom of wall elevations must
be shown. The height and spacing of these walls may trigger the need for engineered plans.
21 Please have the surveyor confirm the lakeside walkout elevation.
4. Please remove all proposed elevations and only show the exiting elevations for the foundation that is on site.
4. What is the floor elevation of the tuck under garage?
5. Since the garage top of foundation has increased in height from 940.9 to 942.9 (raised 2 feet), a grading plan will
need to be submitted and approved.
I have included an updated survey we received from advances surveying this afternoon.
We are available tomorrow after 3pm. Please confirm with me if that works or if you have any further questions.

Hello Rick,
Thank you for the email. It was during the as built foundation review that we realized the building permit plans did not
match the variance approvals. The home in the building plans were almost 2 feet taller than what was approved by
variance by the City Council.This new roof expansion created an encroachment in the setback areas where variance are
needed.
City staff can only approve permit for projects that meet the city code or where variances are granted.The building
plans you submitted for permit do not meet the city code or the variance approvals because of the roof line
expansion. If you want to move forward with the roof shown on the building plans you would need City Council
approval for another variance, or you could continue construction by submitting new plans that match the already
approved variance.
Because city staff does not have the authority to approve permits that do not meet city code your current permit is not
valid and construction cannot continue until the discrepancy is resolved.
The city has placed a stop work order on this project until new plans are submitted and approved that match the city
code and the approved variances.
Additionally,the foundation as built identified old/preexisting foundation elevations as "existing elevations" all
previous notations on the survey should be removed. Only current as built elevations should be shown. The garage top
of foundation elevations called out 940.9 and 942.9, suggesting either a 2 foot step down into the garage or a 2 foot
height increase of the garage floor. Please clarify the current elevations on site.Also, please include the lake side
foundation as built elevation.
I just revived your new plans. I will review them with Roger to confirm this has solved the roof line issue. If these are
matching and we can allow you to proceed so you still want a meeting with city staff? It appears we wouldn't be able to
have a meeting until tomorrow afternoon with all the parties.

The homeowner and I are requesting an urgent meeting ASAP with all of you to discuss the"stop work order"that was
put into effect less than 2 hours after we were notified of an issue with the roof height that was an approved permit#2017-
01424 on Friday Feb. 16th. It is extremely disturbing/disappointing that after the as-built foundation survey was
completed,permit granted,and work had been commenced for over 4 weeks, it was realized that the city was in error for
approving something different than the variance granted,which was unknown to us. This permit took almost 5 weeks to
be reviewed and approved by the city, after most of the work had already been approved on variance. This city error, can
easily be corrected with formal documentation. To shut down a job in a couple hours with no reasonable response when
the solution could be as easy as documentation and a conversation is completely unprofessional and at the very least very
not an example of what a new resident would like to see from their city.
I would like to expect that since we currently have 5 permits with the city, and many previously completed successful
projects in Orono,that we would be granted a slightly more reasonable response than"you have no permit&we have no
idea what you are building"which was communicated via, Laura on Friday and a sign posted within a little over an hours'
time. Let me clarify again,the permit was already approved by the city and the city missed a calculation and/or had an
oversight on the permit, so I would expect a response back as swift as the stop work order to get this resolved. Valuable
time and expense has been lost and the city offices were closed on Monday. It is imperative that this gets addressed
immediately and that your actions can be explained to the current owner.
Please let me know when you are available to resolve this issue this morning.

Hello Rick,
Per our phone conversation I have scanned in the home elevations that were approved with the variance and the
submitted building permit elevation. Note,when you measure from grade to roof peak on the rear elevation (Lakeside).
The roof is 2 feet taller then what was approved with the variance. This is a new encroachment in the lakeyard setback,
average lakeshore setback and side yard setback. These encroachments were not approved through your variance and

are not allowed per the City Code. The building permit plans are no longer valid for your project. Rather than void the
permit, please submit new plans which address the roof line to be consistent with the variance approval.
To confirm, a stop work order have been issued to the property until this is resolved.

Hello Rick,
It has come to our attention that the building permit for 3060 North Shore Drive does not match the variances that were
approved for the new home/addition project. The project will need to stop immediately until this can be reconciled.
The building permit 2017-01424 has a higher roof by 2 feet compared to the approved variances given on October
9th,2017. The distance between the lowest floor and the top of the roof is longer by two feet. This has created a new
height that has encroached into the 75' Lakeyard setback,the average lakeshore setback and the side yard setback. This
height of the roof will need to be addressed before work can continue.

We believe there to be two options moving forward. If you believe there are others, let s discuss.
1. You can submit for a new variance with the new roof line. The deadline for submittal is next Wednesday. The
application would go to the March 19th, 2018 Planning Commission and the April 9th, 2018 City Council
Meeting. You can apply online,through our permitting system.

2. You can redesign the roofline of the home to match the height that was submitted and approved through the
variance process. New plans would need to be submitted and approved before work can continue on site.
Additionally,the foundation as built called out the existing foundation in the garage at 940.9 and also called out the
foundation as 942.9. This suggests a 2 foot step down into the garage. (See attachment) not reflected on the approved
plans Please clarify the as-built foundation elevations including what it is currently and what the proposed foundation
elevations as part of the building permit. Also, please include the proposed elevation for the lakeside foundation and
the as built elevations.
Our inspector must issue a stop work order on site this afternoon. I am available for any questions as well.

As requested I revised the adjusted grading plan, stamped it approved and offer these comments:
1. If does not appear that the revised plan has altered the drainage patterns from those previously approved.
2. The change has resulted in two of the retaining walls being planned at exactly 4 ft tall. If the walls exceed 4 ft,
engineered plans will be required.
3. Care should be taken to ensure the southwestern driveway does not direct water into the lower garage.

HI Chris.
Please see the attached revised survey with the changes you requested. I will also drop off 2 full sized copies.
We addressed the retaining wall issue by separating the two walls so these aren't considered Tiered walls.
We've indicated on the survey the drainage pattern and was able to address the bituminous potion by directing storm
water runoff from the car port area onto the existing front lawn. Please note that the properties to the north and south
are higher in elevation that this property and our drainage plan hopes to accommodate this.
We're in the process of completing a landscape plan and will forward to you shortly. Please let me know if this delays
the permitting process with the other departments and I'll push harder for completion of the plan.

The MCWD permit has been applied for and they are currently reviewing this.
