' A RESOLUTION GRANTING VARIANCES
FROM ORONO MUNICIPAL CODE
'� SECTION 78-1279
�, FILE NO. 16-3882
'' WHEI�EAS, Jon Ressler and Christine Ressler, a married couple, (hereinafter
the "Applica�ts") are�the owners of the property located at 3683 North Shore Drive within the
City of Oron�(herein�fter"City")and legally described as:
, Attached as Exhibit A(hereinafter"the Property"); and
WHEREAS, the Applicants have made appfication to the City for a variance from
Orono City de Section 78-1279 to permit construction of a 4.5' x 6.5'elevator dormer addition
over a portio of the existing home with garage addition as close as 70 feet from the ordinary high
water level ( HVI/L)of�the lake where a 75 foot setback is required; and
WHERffAS, after due published notice and mailed notice in accordance with
Minnesota St' tutes and the Orono, Minnesota, City Code, the Orono Planning Commission held
a public heari g on No4�ember 21,2016,at which time all persons desiring to be heard conceming
this applicatio� were giiven the opportunity to speak thereon.
INOW, THEREFORE BE IT RESOLVED by the City Council of Orono, Minnesota: -
1. This ap�lication was reviewed as Zoning File#16-3882.

2. The Pr perty is located in the LR-1 C One Family Lakeshore Residential Zoning District
which r quires a minimum lot area of 0.5 acres and a minimum lot width of 100'.
3. The Pla ning Commission reviewed this application on November 21,
Commi ion voted 6 in favor and 0 0 osed on a motion to a 2016, the Planning
setback variance allowing for the construction of the proposed relevator do mere ol the
home, b sed on the following findings:
a). e Property contains 7,776 square feet in area and has 53 feet in width at the
HWL and 58 feet in width at the 75 foot setback.
b). T e Property is unique in that there is a limited buildable area between CSAH 51,
th frontage road, the 75' lake setback and side setbacks. The existing home is
si uated g�nerally in line with the other 4 homes on this narrow piece of land
tween CSAH 51 and the Lake.

c�. The variance to allow construction of the elevator dormer on the Property which is
substandard with respect to area and width will alleviate a practical difficulty
' inherent to the Property and was not created by the Applicants.
d�. The proposed setback does not exceed beyond the existing footprint and is not out
', of character with this neighborhood.
e)� The proposed elevator dormer is minimal and is not proposed to extend more
� lakewar.d, or further into the side setback areas than the existing home.
fl. The variance to construct an attached garage and 2 %2 story additions to the
residence is in harmony with the general intent and purpose of the Ordinance.
g)., The variance to permit improvements to the existing residence in a residential
district is consistent with the comprehensive plan.
h). The Applicants have provided a survey reflecting the limited building envelope on
I the Property which is substandard lot area and lot width establishing that there are
practical difficulties.

i). '�The Applicants propose to use the Property in a reasonable manner not permitted
y the official controls,
j). he circumstances unique to the Property were not created by the Applicants.
k). ,�4pproxirrlately half of the existing home footprint exists in a nonconforming
cation, '�he proposed project will be consistent with the neighbofiood, and will
ot advensely impact adjacent lakeshore properties.
I). he granting of the proposed variance will not in any way impair health, safety,
omfort or morals, or in any other respect be contrary to the intent of this chapter.
m). he gran�ng of the requested variance will not merely serve as a convenience to
t e Appliaants, but is necessary to alleviate demonstrable difficulty.
4. The Ci Council considered this application at a meeting held on December 12, 2016
includin the findings and recommendations of the Planning Commission, reports by City
staff, co ments tyy the Applicants and the public, and the effect of the proposed variances
on the h alth, safety and welfare of the community as well as the impact on properties in
the vicini .

5. The �ity Council finds that the conditions existing on this Property are peculiar to it and
do nqt apply generally to other property in this zoning district; that granting the variances
woulc�not adversely affect tra�c conditions, light,air nor pose a fire hazard or other danger
to ne hboring property; would not merely serve as a convenience to the Owners, but is
nece sary to alleviate a practical difficulty; is necessary to preserve a substantial property
right f the Applicants; and would be in keeping with the spirit and intent of the Zoning
Code nd Comprehensive Plan of the City.

CONCLUSIONS, ORDER AND CONDITIONS
Based on th above fihdings, City Council of Orono, Minnesota hereby grants a variance from
Orono City C de Secti�n 78-1279 to permit construction of a 4.5' x 6.5' elevator dormer 70 feet
from the OH L where a 75-foot setback is required, subject to the following conditions:
1. Coun I approval is based on the survey and building plans submitted by the Applicants
and a' notated by City staff, attached to this Resolution as Exhibits B � C. Any
amen ments ta these plans may require further Planning Commission and City Counci�
revieHr
2. Autho ties gran�ed by this resolution run with the Property not with the Applicants, but are
permi ive onlyi and must be exercised by obtaining a building permit for the new
constr ction and commencing construction of said project. A framing inspection must be
compl ed withirn one year of the date of Council approval, or the variances witl expire on
that da�e(December 12, 2017).
3. Violatiah of or non-compliance with any of the terms and conditions of this resolution shall
constit te a vio�ation of the zoning code, shall automatically terminate any authority
granted�herein, and shall be punishable as a misdemeanor.
4. The un ersigned Applicants have read, understand and hereby agree to the terms of this
resoluti n and on behalf of their heirs, successors and assigns, hereby agree to the
recordi of this resolution in the chain of title of the Property.
