Dear Mr. Oberaigner
I have been working with the City of Orono on the above referenced project as a private citizen(40 years)of
Orono. During the course of this project, I have been under a strict timetable to install access, sewer,and water
to lots in the above referenced project per the strict specifications of the various government entities. The City
of Orono is the source of approval for the plans and specifications have been set with the information provided
by the City of Orono.
I arranged and paid for the above referenced work(in excess of$100,000)to be completed per the plans
approved by the City Council and in accordance with the specifications set by the City of Orono. I received
misinformation regarding the sewer and water connections that was used for the writing of the specifications
from the City and the arrangement of the subsequent work to be done.
The set of misinformation provided by the City of Orono is attached as Ez6ibit A caused undue rework
attached as Ezhibit B that totals $7400.00. With this letter,I am formally requesting the City of Orono to
waive fees totaling$5040.00($2520.00 times 2 lots). These"water and sewer connection fees" are
referenced in the Minutes of the Orono City Council Meeting dated Monday,March 13,2006,Page ZO of
27 starting wit6 KGaffron stated the water connection charges..."
I am presenting what I deem to be a fair settlement of this dispute and upon written acceptance of this offer
consider the dispute closed and final with no option for this item to lead to any future legal action taken by me.
I will await your reply and encourage you to inform me if there is any additional information required.

EXHIBIT A: Water and Sewer misinformation from City of Orono
• Orono Sewer records that were given to Loucks Eng were incorrect. Both the location and the depth
were in error. The depth that was given per city records was at the 12-foot level but was actually at the
22-foot level.
• Both the location and the size of the water main were given by the city of Orono were in error.
• The location of the M.H. for the sewer connection was not correct as per the as builds provided to
Loucks Eng by the city of Orono

EXHIBIT B: Rework Costs incurned due to Water and Sewer misinformation from City of Orono
1. Cost of providing h�affic control
2. Digging a 13 foot hole to connect the sewer and than filling in the hole because the depth to the
connection point of the sewer from the city was in error.
3. Temporary backfilling of the hole in County Rd. 19 due to the hole having to be refilled without
connecting the sewer service.
4. Core drilling of M.H. and doing inside drop to the 22-foot level.
5. Labor cost/machine cost/as a result of incorrect information(records)provided by the city.
6. Lost time on project due to having to reschedule the connection of the sewer and water
connection.
7. The cost of removing old M.H.that was not on records provid�by the city. This M.H.had been
fille�with sand at the time it was removed from service.
