AGREEMENT made this day of , 20_, by and between the CITY OF ORONO,
a Minnesota municipal corporation ("City") Land Source, LLC ("Owners").
Recitals
1. A building permit application has been filed for a new single family home located at 3825 North
Shore Drive the ("Subject Property"), legally described as Lot 4, Block 1, Sherri Lakeview Estates, Hennepin
County, Minnesota.
2. Owners request the City to review this application.
3. The City will commence its review of the application and incur costs associated with said review
only if the Owner establishes an escrow to ensure reimbursement to the City of its costs.
NOW THEREFORE,THE PARTIES AGREE AS FOLLOWS:
1. DEPOSIT OF ESCROW FUNDS. Contemporaneously with the execution of this Escrow
Agreement, the Owners shall deposit$2,500 with the City. All accrued interest, if any, shall be paid to the City to
reimburse the City for its cost in administering the escrow account.
2. PURPOSE OF ESCROW. The purpose of the escrow is to guarantee reimbursement to the City
for all out-of-pocket costs the City has incurred (including planning, engineering, in excess of $500, or legal
consultant review) or will incur in reviewing the plan. Eligible expenses shall be consistent with expenses the
Owners would be responsible for under a building permit application. The escrow will also guarantee
reimbursement to the City for all out-of-pocket costs the City has incurred to assure that the work is completed in
accordance with the Stormwater Pollution Prevention Plan and the provisions of Orono City Code Chapter 79.
The financial security may also be used by the City to eliminate any hazardous conditions associated with the
work and to repair any damage to public property or infrastructure that is caused by the work (including planning,
engineering, or legal consultant review) associated with building permit #2014-00463 if compliance with the
approved building permit is not accomplished.
3. MONTHLY BILLING. As the City receives consultant bills for incurred costs, the City will in turn
send a bill to the Owners. Owners shall be responsible for payment to the City within 30 days of the Owners'
receipt of bill.
4. DISBURSEMENT FROM ESCROW ACCOUNT. In the event that the Owners do not make payment
to the City within the timeframe outlined in #3 above, shall issue a Stop Work Order until the Owners pay all expenses
invoiced pursuant to #3. The City may draw from the escrow account without further approval of the Owners to
reimburse the City for eligible expenses the City has incurred.
5. CLOSING ESCROW. The Balance on deposit in the escrow, if any, shall be returned to the
Owners when all requirements related to the project are complete. City Staff shall review the terms of this escrow
agreement two times per year to determine whether the requirements of the project have been successfully
completed and whether it is appropriate to return the funds. Owner may also request the release of the funds,
and such funds shall be released upon City Staff receiving the appropriate verification that all requirements of the
project have been successfully completed.
6. CERTIFY UNPAID CHARGES. If the project is abandoned by Owners, or if the eligible expenses
incurred by the City exceed the amount in escrow, the City shall have the right to certify the unpaid balance to the
subject property pursuant to Minn. Stat. §§415.01 and 366.012.

17. Provision to the City of final plans and specifications for improvements to the
property includin� construction of sewer and water service improvements,
stozn�water and draina�e systems and facilities, site grading and landscapina per
the requirements of Resolution No. 5434.
NOW, THEREFORE, BE IT RESOLVED that based on the findings of
Resolution No. 54�4, the City Council of the City of Orono does hereby approve the five lot
residential plat of SHERRI LAKEVIEW ESTATES, Hennepin County, Minnesota subject to the
following declarations and conditions:
1. ZoninQ, Shoreland Status. The property is zoned LR-1C Single Fanlily Lakeshore
Residential District and subject to the lot development standards of the LR-1C District.
Additionally, Lots 1 throu�h 5 are within the designated Shoreland Overlay District and
subject to the City of Orono Shoreland regulations pertinent thereto.
2. Lot Standards. Buildable envelopes including approved setbacl:s for the two new back
lots (Lots 3 and 4) are as shown on Sheets C2-1 and C3-1, the Preliminary Site Plan and
Preliminary Grading Plan per Eahibit B of Resolution No. 5434. For both Lots 3 and 4,
the northerly yard is the front yard, the southerly yard is the rear yard, and the easterly
and westerly yards are side yards. For Lot l, by definition the easterly yard is front, the
westerly yard is rear, the southerly yard is a side yard, and the northerly yard is a side
street yard. However, because of its hiahly visible corner lot status at the intersection of
two major County roads, Lot 1 shall be further limited in that no principal or accessoiy
structures shall be allowed ��thin 20 feet of the north lot line. Accessory structures may
be placed on all Lots according to City standards e�cept as noted for Lot 1.
3. Drivewav Access. Driveway access to Lots 1 and 3 shall be a shared driveway within
Outlot A. Driveway access to Lots 4 and 5 shall be a shared driveway within Outlot B.
The existing driveway access onto Shadywood Road for Lot 2 shall remain. All other
curb cuts or access points onto the adjacent County Roads shall be rernoved. The
developer shall establish the appropriate shared driveway easeinents and maintenance
covenants over Outlots A and B. Developer shall provide copies of approved Hennepin
County pernlits for driveway access locations for Outlots A and B.

We will extend the silt fence on the survey.As far as the rain gardens go we showed them from the preliminary plat so
everyone would be aware of their location.They should have been constructed with the plat like the one was when we
surveyed Lot 2. Do we need to show details for them when that should have been the responsibility of the original
developer with the subdivision. Please advise.

Dear Melanie:
As requested, we have completed an engineering review of the documents submitted far the above
referenced project. Our current review is based on the following submittal items:
• Final Construction Plans, dated 5/15/2014
• Certificate of Survey prepared by Gronberg&Associates, Inc., dated 5/7/2014
We offer the following observations, comments, and recommendations for your consideration:
1. The proposed silt fence should be extended around the perimeter of the site. The silt fence should be
installed such that runoff from the site cannot directly enter the rain garden to the north.
2. The plans should provide more detail for the proposed rain gardens. Details should include, bottom
