Dear Ms. Johnson:
Per your request I have reviewed City files regarding the Special Flood Hazard Area
status of your property at 3818 North Shore Drive. It is my conclusion that while
portions of your approximate 1.2 acre property on Lake Minnetonka are within "Flood
Zone AE" and potentially subject to periodic flooding, your residence structure is located
outside the Flood Hazard Area.
Please review the attached maps. The floodplain level on your lot has been formally
established at an elevation of 931' MSL and based on a comparison of the FIRM and the
topographic map it would appear that the grade adjacent to your home is at an
approximate elevation of 946' MSL. This information would place your residence within
"Zone X", an area determined to be outside the 0.2% annual chance floodplain.

To Whom It May Concern:
The City received a call on August 19, 2005 inquiring about fence height along North Shore Drive. As stated
over the telephone, fence heights in front yards cannot exceed 42 inches. However, after further research on the
above noted property it may be possible to erect a fence 6' in height along North Shore Drive if either point— 1 or
2 below is true and applicable to the property:
1) The piece of property, PID#08-117-23-34-0040, north of Cherry Avenue from 3818 North Shore
Drive is in legal combination with the property addressed 3818 North Shore Drive (PID#08-117-
23-34-0060) and a 929.4' elevation can be located on that parcel on either parcel. The 929,4'
elevation is key as that elevation is considered the OHWL (ordinary high water level) of Lake
Minnetonka.
2) The parcel addressed. 3818 North Shore Drive contains a 929.4' elevation, regardless of
combination status of the parcel located north of Cherry Avenue.
Items 1 and 2 above, if true, classify 3818 North Shore Drive as a lakeshore lot on a major thoroughfare,which is
permitted fences 6' in height along street yards, in accordance with Zoning Ordinance Section 78-1405 (7) (see
attached for your reference). As a point of reference with regard to the Zoning Ordinance Section attached, a
lakeshore lot's front yard is the same as the lake yard and the rear yard is the street yard.
3) If the two parcels are not legally combined or if the main parcel at 3818 North Shore Drive does
not contain a 929.4' elevation of Lake Minnetonka, and therefore the lot is not a lakeshore lot on
a major thoroughfare, an alternative would be to request a Special Lot Combination Agreement,
whereby the two parcels (08-117-23-34-0040 and 08-117-23-34-0060) are legally required to
remain in combination. This would then make the lot a lakeshore lot allowing for a 6' fence
along North Shore Drive.
