I have heard from both Paula and Nancy that the arrangement of your shared driveway to North
Shore Drive has become unworkable for a number of reasons. I've been asked what options are
available. I have identified three:
1. �ince North Shore Drive is a county road, Hennepin County controls the number,
location and size of driveways onto it. Dave Zetterstrom of the County Transportation
Department indicates they would not approve two separated driveways. However they
would approve two side by side driveways each wide enough for two-way traffic. To do
this you w-ould need to a�ree upon the location of the driveways. You would each need a
permit from Hennepin County Transportation Department for the portion of the driveway
within the County right of way and a permit from the City for the portion of the driveway
within the City right of way. Contact Dave Zetterstrom (612-�96-03��) for information
about the county permit and me about the City permit.)
2. You could widen the existinb driveway where it enters North Shore Drive. This would
require a permit from the County and the City.
3. Either or both of you could petition the City to construct Oak Place. The road would be
24 feet wide, would be centered in the right of way, and would extend to the north edge
of Paula's driveway. There would be no parking allow°ed on this road and your
individual driveways could be no wider than 20 when they intersected your property
lines. The cost of constructing the road would the assessed to both properties and you
would be expected to maintain it. You will be assessed all the administrative costs as
well as actual construction costs.

You should resolve your differences before the Blairs' house is finished as the portion of the
driveway that drains to North Shore Drive must be paved before the certificate of occupancy is
issued. Since this is a private disagreement City Staff cannot be involved in its resolution. You
may want to consider using a mediation service. I've enclosed a pamphlet from the agency that
serves this area.

As you are probably aware, the shared driveway arrangement between the Blair residence you are
constructing at 3768 North Shore Drive and the Johnson residence at 3818 has disintegrated.
Ms. Johnson intends to close off the existing driveway and construct a new driveway. T'he east edge of
this driveway will be on the centerline of Oak Place. You will need to construct an adjacent driveway
on the east side of the centerline abutting her driveway to provide access to the Blair residence. T'his
driveway must be a minimum of 8 feet wide. A permit is required from Hennepin County as North
Shore Drive is a County Road. The County may specify a wider minimum width and may specify a
maximum width. For information on the permit contact Dave Zetterstrom at Hennepin County
Transportation Department(612-596-0355). You must also obtain permission from Don DeBaere,
Street Supervisor for the City of Orono (952-249-4600) for the work within Oak Place.
In reviewing the Johnson proposal I realized that we failed to note on the permit that the driveway
must be paved from the edge of the roadway to the point that it no longer drains toward the roadway.
The Blairs were made aware of this requirement in a letter I sent them last January(copy enclosed).

Dear Evelyn,
Both Paula and I did not think mediation would solve anything.
She felt we were `ordered' to go to mediation by the City. If that is your
thought we can reschedule. It is not a dispute. It is two different views:
1. Paula wants her own driveway. I say `fine' but carve it out of your
own land. It can abut the county road. We can even put 3 signs
down the middle that say`private drive' with arrows pointing to her
driveway. She can use both sides. I and my family/friends, etc. can
only use the county road side. No problem.
2. Paula wants her new driveway carved from tlie county road land which
abuts my properiy. There aze many arguments against doing that which
you probably are not interested in hearing right now.
3. I will not be applying for any permits. My concern is that if Paula
applies for permits to proceed with using the county road that T will not
be informed in time to appeaz and present my views to the Planning
Comrnission or the County so I am enclosing my schedule to/from
Florida and my card with both addresses.
4. We leave for Florida Qctober 5�,2008. Notices should be sent to
our Florida address for October and November. We return to MN
for the Holidays Dec 3'�. From January through April we will again
be in Florida.. Hopefully the notice for approval of her permits will give
me enough time to fly to MN.
From what I read Mediation would only tell you that we disagreed

I am responding in writing to your phone message of 6:30 a.m., May 16, to better clarify the
situation and my stand and reasoning.
I don't think you're looking at this from my position at all. You do not live there and don't
experience the danger. You say the driveway has been this way since 1939 and you see no
reason to change it. Perhaps, but County Road 19 has changed a lot in 70 years. I have been
almost broadsided several times trying to pull out because the line of sight is impeded by the hill
of dirt and the curve in the road.
Turning into the driveway is also dangerous. With it being a one-lane, 90-degree turn with rock
wail on one side an� hil� on the other, there is ne place for a divers�er�. !f there is any other veh�cle
in the driveway, I have to stop quickly on the highway and risk a rear-end collision. I was almost
hit by your builder when he was backing up in the driveway as I was entering. He couldn't see me
and I couldn't back onto County 19. Luckily he heard my honking and stopped. But it's only a
matter of time before there is an accident.
I've nearly been run over when carrying water down to the street front area. I've also had a
problem when your renters left a vehicle stuck in the driveway. There is no parking on County 19
and i do not have another option of getting in my garage if the driveway is plugged.A single-lane
driveway does not work with this property.
The time has come to have separate driveways. There is enough land for two side-by-side two-
lane driveways and that is my request. Your claim that you don't want to expand the driveway
because you want to limit the removal of dirt is disingenuous considering the mountain of dirt that
is on view from the excavation to build a large new house. You are choosing your aesthetics over
my safety.
Since you have made it clear that you want me to provide your driveway along with its
maintenance forever, I will file for a mediation conference and then appeal to the city. The city
sent us a list of choices and "I don't want to change a thing"wasn't listed. You say will fight me on
this, but it is the city you will have to fight and I believe that safety will be the primary concern.
Please remember that this isn't a personal item. Neither of us is going to live there forever and we
car't predict the behae�i�r of future o��mers.

I need clarification and diredion on the development of my driveway. I have received conflicting information and
constantly changing requirements. Every time I think I have performed all of the stated requirements, I get shut
down and another hurdle tossed my way.The first time it was that I had to have a surveyor out to define the east
edge of my properly-an extra$350. Then I was told I need an engineering quality drawing-an extra$500. Now
the driveway project has turned into a road-building project according to the latest requirement change. What was
a$3000-$5000 cost has increased to$15,000-$20,000. I have already invested over$1,000 and have absoiutety
nothing but a survey stake and road plan on a piece of paper for the trouble. Not to rr�ention many, many hours of
my time and the entire driveway building season gone.
1)Why has a driveway plan morphed into a new aty street for Orono?If I build a street,will the public be able to
use it?Will Orono maintain it-and the snow rerr�oval and general maintenance?
2) How will the city ensure that both homeowners pay their fair share?When other streets are built in Orono, are
the homeowners assessed for the entire cost?How is it divided and billed?This is now beyond my means to
finance the neighbor's portion and yet you require the excavation be done in one session.
3)Why was this requirement sprung on me at the last moment'? I have followed all of Evelyn's letters and
requests and no where did it say the driveway had to be developed using street-building specs.Who added this
requirement and why?Under what authority?
4) If I do nothing,what will you require from the Blairs?How will you enforce it?
I had another very close call last Fri trying to pull out of my driveway.All I am trying to accompUsh is a safe
driveway wide enough for iwo vehicles and with adequate sight lines.Why has this turned into such a difficuft
battle? It would've been simplest if from the start you would have vacated the land and allowed us to each build
our own driveway under the rules of Hennepin County access.

Please be advised that this law firm represents the City of Orono. I am writing
this letter in the hopes that I will be able to clarify the City's position regarding the
proposed work within the City's right-of-way(Oak Place)that provides each of yow
homes access to North Shore Drive. The City has r�;eived a proposed plan prepared
by Crronberg& Associates, Inc., dated November 5, 2008. It is my understanding that
this plan was prepared for Ms. Johnson. The City has reviewed the plan and the City
Engineer has provided comments. Provided that the plan dated November 5, 2008, as
well as the Engineer's comments are followed,the City has approved the proposed
plan. The current design, as approved by the City, is necessary to satisfy Hennepin
County, the City Code and the F've Marshal.
There have been questions re�arding who is responsible for the installation,
payment, and ultimate maintenance of the access bein�placed within the City's right-
of-way. The City will not be contributing any money toward the construction that is
being proposed within the Oak Place right-of-way. Furthermore,the City will not
mairrtain or plow this area. It is up to each of you to decide how the expenses for this
project will be split between the two of you.

As you are probably aware, the shared driveway arrangement between the Blair residence you are
constructing at 3768 North Shore Drive and the Johnson residence at 3818 has disintegrated.
Ms. Johnson intends to close off the existing driveway and construct a new driveway. The east edge of
this driveway will be on the centerline of Oak Place. You will need to construct an adjacent driveway
on the east side of the centerline abutting her driveway to provide access to the Blair residence. This
driveway must be a minimum of 8 feet wide. A permit is required from Hennepin County as North
Shore Drive is a County Road. The County may specify a wider minimum width and may specify a
maximum width. For information on the permit contact Dave Zetterstrom at Hennepin County
Transportation Department (612-596-035�). You must also obtain permission from Don DeBaere,
Street Supervisor for the City of Orono (9�2-249-4600) for the work within Oak Place.
In reviewing the Johnson proposal I realized that we failed to note on the permit that the driveway
must be paved from the edge of the roadway to the point that it no longer drains toward the roadway.
The BIairs were made aware of this requirement in a letter I sent them last January (copy enclosed).

1 need clarification and direction on the development of my driveway. i have received conflicting information and
constantly changing requirements. Every time I think I have performed all of the stated requirements, I get shut
down and anothe�hurdle tossed my way.The first time it was that I had to have a surveyor out to define the east
edge of my property-an extra$350. Then I was told I need an engineering quality drawing-an extra$500. Now
the driveway project has turned into a road-building project according to the latest requirement change. What was
a$3000-$5000 cost has increased to$15,000-$20,000. I have already invested over$1,000 and have absoiutely
nothing but a survey stake and road plan on a piece of paper for the trouble. Not to mention many, many hours of
my time and the entire driveway building season gone. �
1)Why has a driveway plan morphed into a new aiy street for Orono?If I build a street,will the public be able to
use it?Will Orono maintain it-and the snow removal and general maintenance?
2) How will the city ensure that both homeowners pay their fair share?When other streets are built in Orono, are
the homeowners assessed for the entire cost? How is it divided and billed?This is now beyond my means to
finance the neighbor's portion and yet you require the excavation be done in one session.
3)Why was this requirement sprung on me at the last moment? I have followed all of Evelyn's letters and
requests and no where did it say the driveway had to be developed using street-building specs.Who added this
requirement and why?Under what authorily?
4) If I do nothing,what will you require from the Blairs?How will you enforce it?
I had another very close call last Fri trying to pull out of my driveway.All I am trying to accomplish is a safe
driveway wide enough for two vehicles and with adequate sight lines.Why has this turned into such a difficu�
battle? It would've been simplest if from the start you would have vacated the land and allowed us to each build
our own driveway under the rules of Hennepin County access.
