Remarks:
The proposed project involves a new home on Block 8 Lots 1 - 15.
Per Division 1. Sec. 78-1601 of the Wetland Protection Ordinance, the proposed construction on this lot
trigger's the ordinance due to the following proposed work:
o Disturbed property drains towards the wetland.
o Grading exceeds 50 cubic yards.
o Net increase in the square footage of impervious surface area.
This wetland is classified as a "Preserve" basin by the Minnehaha Creek Watershed District classification
system. Under the City Wetland Ordinance wetlands classified as "Preserve" require a 50 foot buffer area
of undisturbed native vegetation and a 20 foot setback from the upslope edge of the buffer for a total
building set-back of 70 feet.
Currently much of the 50 foot buffer required on lots 1, 2, 3 is vegetated with native vegetation such as
maple, elm, and cottonwood however common buckthorn was also common in the understory. The buffer
on Lot 5 appears to be predominately native vegetation and has minimal invasive species. Within the
required buffer area (primarily Lot 4 and 5) there is existing turf grass that extends into the area of buffer.
Turf grass and buckthorn does not meet the required vegetation of a buffer per section 78-1605 (b) of the
City Wetland Ordinance. The area of turf grass within the required buffer will need to be converted to
_ native vegetation or the applicant can request Buffer Flexibility as allowed under section 78-1608 (3) of the
City Wetland Ordinance. If the applicant requests "Buffer Flexibility" the applicant could utilize buffer
averaging. Buffer averaging would allow the reduction of the buffer width in the area of turf grass to
maintain reasonable use of these areas if it is expanded beyond 50 feet in other areas to meet the overall
surface area of the 50 foot buffer which is approximately 11,800 square feet. In order to preserve the
filtering of nutrients prior to reaching the wetland and �ake the buffer width should not be less then 25 feet
in these areas. A mowed path that is 8 feet or less can be allowed to maintain reasonable access to the
existing dock.

g. All seeded areas shall be mulched immediately with clean straw at
a rate of one and one half(1 '/z ) tons per acre. Mulch shall be
� anchored with a disk or tackifier. ��
h. Buffer areas (both natural and created}, shall be protected by silt
fenca during construction and the fence shall remain in place until
the area crop is established, and at that time the fence shall be
removed.
(c) Buffer ai�ea widtlis will be based on the Wetland Protection Strategies
established in the Orono Surface �ater Management Plan (SWMP) (December 2002). A
Protection C19ssification has been assigned to each wetland in �rono based on the
stormwater susceptibility and fiuictional assessment for each wetland. The four
Protection Classifications are described as follows:

The Protection Classification for each wetland will be found on the"Wetland
Management Classif catian Map 8c List" which is hereby adopted by reference, a copy of
which shall be kept on fiie in the office of the City Clerk and shall be available for public
review during all normal office hours. The following are the required buffer area widths

(2) Unacceptable buffer areas have the following qualities, including but not
limited to:
a. Undesirable plant species (including but not limited to reed canary
grass, common buckthorn, purple loosestrife, leafy spurge and
noxious weeds), or
b. Lacking a layer of organic thatch or duff,or
c. Topog�raphy which tends to channelize the flow of surface runoff,
or
d. Fs characteristically unlikely to retain nutrients and sediment.
_ , (3) Buffer areas which have been broken or cultivated within the past ten(10)
consecut�ve �years must be restared to a condition consistent with an
acceptable.buffer area defined in Section 78-1645(b)(1), a restoration or
landscape�`plan must be submitted to the Planning Director, which
restoration shall include, replanting,and maintaining according to each of
the following guidelines: �-�'
a. Buffer areas sl�all be planted with a seed mix containing one
hundred(100%)percent perennial native plant species, except for a
one-time planting of an annual nurse or cover crop such as oa#s or
rye.
b. The seed mix to be used shatl consist of at least twetve(12}pounds
pure live seed (PLS) per acre of native prairie grass seed and five
(5) pounds PLS per acre of native forbs. Native praairie grass and
narive forb mixes shall contain no fewer than four(4) and five (5}
species respectively. �
c. The annual nurse or cover crop sha.11 be applied at a rate of twenty
{20)pounds per acre.
d. Native stuubs and or trees may be used in addition to forbs and
grasses. SYuvbs shall be distributed so as to provide a natural
appearance and shali not be planted in rows.
e. Native prairie grasses and forbs shall be planted by a qualified
contractor.
f. No fertilizer shali be used ii�: establishing new buffer zones, except
on highly disturbed sites when deemed necessary to establish
acceptable buffer vegetation and then limited to amounts indicaiec�
by an accredited soil testing laboratory.

Submittal Requirement
The applicant will need to have the upslope edge of the buffer and setback lines added to the survey
provided by Gronberg and Associates, Inc.
For the areas of buffer a landscaping plan that addresses the buckthorn removal and conversion of turF
grass areas to native vegetation will need to be submitted. This plan will need to meet the minimal
standards provided in Division 3. Sec 78-1605 (b)(3) (See Attached Section of Ordinance).

Mrs. Blair is having second thoughts about the project but if she decides to go forward
we need some information added to the building permit survey, having to do with the
wetland buffer and setback. She and Beissel thought it best if I told you directly.
This is what needs to be added:
1. The wetland setback line (20' feet from the buffer).
2. The name of the wetland delineator or company and date of the delineation.
3. The wetland buffer. This will not be the usual configuration because they need
access to the dock and there is a turF lawn area that provides this access that
John Smyth and I decided could be recognized as an existing surface. So there
will be an 8 foot strip of no buffer centered on the dock extending back 25 feet
from the edge of the wetland, then the strip of no buffer will widen to the edge of
the existing turf (or less if the Blairs wish). The depth of the buffer will need to
be increased elsewhere so the area of the buffer is the same as it would be if
buffer was simply 50 feet from the wetland.
We will also need a description of the wetland and the buffer we can use on the
covenant/easement document.

The Grantors on behalf of themselves, their heirs, successors and assigns, hereby
covenant and agree as follows:
1. That the following are prohibited in perpetuity within the wetland and wetland
buffer as described in the legal description and site plan attached hereto as Exhibit
A:
A. Constructing, installing, or maintaining anything made by man, including
but not limited to buildings, structures, walkways, fences, retaining walls,
fireplaces, clothes line poles, playground equipment, roads, hardcover of
any kind, underground utility lines and distribution equipment, light poles,
traffic signals, traffic regulatory signs, mailboxes; except: 1) feeders, bird
houses, and other devices intended to foster wildlife; and 2) docks or
boardwalks when allowed by City of Orono ordinance and under a valid
City permit.
B. Cutting, mowing or removing shrubs or other vegetation, and cutting,
destroying or removing trees greater than four inches in diameter, except
for tree disease control by or as directed by a governmental agency.
Grantors may remove brush, diseased or dead trees of any size, noxious
weeds or invasive, non-native plants.
C. Excavation or filling or material alteration of grade, including changes to
the size, depth or contour of the wetland; dredging, mining or removal of
earth, loam, peat, gravel, soil or any other natural material.
D. The deposit of waste, yard waste, or debris.
E. Application of fertilizers, whether natural or chemical.
F. Application of chemicals for the destruction or retardation of vegetation.

G. The application of herbicides, pesticides, and insecticides, except for
noxious weed control by or as directed by a governmental agency.
H. Outside storage of any kind.
I. Activity detrimental to the preservation of the scenic beauty, vegetation,
and vv�ldlife.
2. Establishment and Maintenance of Wetland Buffer. The wetland buffer, as shown
in Exhibit A, shall be established and improved to become an "accepta.ble buffer
area" as described within City of Orono Ordinances, and sha11 thereafter be
maintained by Grantors in perpetuity free from mowing or other vegetative
disturbance, fertilizer application, yard or other waste disposal, the placement of
structures or any other alteration that impedes the function of the buffer in protecting
the quality of water in the wetland or buffering flows into the wetland.
3. Grantors for themselves,their heirs, successors and assigns, further grant the City of
Orono the affirmative right, but not the obligation ta do the following within the
wetland and wetland buffer:
A. Preserve, improve, and enhance the natural habitat by altering, clearing,
and removing trees or other vegetation, by changing the contour of the
land, and by planting trees or other vegetation, consistent with City
Ordinances. Except in an emergency the City shall give the owner(s) of
the property 14 days notice by US mail or personal service at the property.
The City shall use property tax records to determine the name(s) and
address(es) of the owner(s).
B. Enter upon the wetland and wetland buffer at any time to enforce
compliance with the terms of this instrument and/or the ordinances of the
City.
4. Crrantors reserve for themselves and for their heirs, successors and assigns and
their invitees, the right to enter upon the wetland and wetland buffer and to do
and perform such acts as are not inconsistent with City ordinances. Such uses
shall be deemed to include, but not be limited to planting of trees, flowers, and
other vegeta.tion consistent with City Ordinances; walking along trails and paths;
bird watching; the study of nature; and all other acts of a similar nature or
purpose.
5. Grantors do not intend that the public should have any interest in the above land
by virtue of this ind.enture or otherwise, except as hereinabove set forth.

Landscaping Plan:
Per a request in a previous memo(dated 10-25-07), a landscaping/restoration plan for the
wetland buffer area has been submitted and was reviewed on 11-9-07. The following
recommendations have been made to ensure the submitted planting/landscaping plan meets
the requirements of Orono's wetland buffer ordinance:
The following species should be removed from the planting plan as they are not locally native to
Hennepin County or the surrounding area:
o Arctic willow
o Hostas
o Daylilies
o Fountain grass
The applicant may use these species in their landscaping plans outside of the 50'wetland
buffer, but not within the buffer area. The following provides recommended plant species
that could be used as substitutions within the wetland buffer:
o As substitutions for the non-native shrub species Arctic Willow consider the following
native plant species: Meadow willow(Salix gracilis), Bebb's willow(Salix bebbiana),or
red-osier dogwood(Comus sericea).
o As substitutions for the non-native grass species"Fountain Grass"consider the following
native plant species: big bluestem(Andropogon gerardii), little bluestem(Schizachyrium
scoparium), northem dropseed(Sporobolus heferolepsis),or Indiangrass(Sorghastrum
nutans).
o As substitutions for the non-native daylily species consider the following native plant
species:smooth blue aster(Aster laevis), purple prairie clover(Dalea purpurea),golden
alexander's(Zizea aurea),or black-eyed susan(Rudbeckia hirta).
o As substitutions for the non-native Hostas consider the following native plant species:
wild geranium(Geranium maculatum), blue lobelia(Lobelia siphilitica),or culver's root
(Veronicastrum virginicum).
With the exception of the non-native species listed above,the actual number of grass and
wildflower flower species listed in the proposed seed mix does meet the requirements of
Orono's wetland buffer ordinance. To ensure seeding occurs at the appropriate rate the
applicant should revise the planting plan to show planned seeding rates and/or amounts of
each species to be planted. As stated previously the ordinance does require seetling to
occur at a minimum of 17 Ibs per acre of native seed (121bs per acres must be grasses, 51bs
per acre must be wildflowers). Location of the different seed mixes or plants proposed within
the buffer should be provided on the plan unless it is the same for the entire buffer. If it is the
same for the entire buffer a note that intlicates the entire buffer will be seeded or planted
(specify species)with this quantity(specify amount in pounds and/or#of plants)will suffice.

With the driveway issues resolved we anticipate you will be requesting a CO for the Blair
residence soon. One of the items that has to be addressed before we can issue it is the
wetland buffer. It needs to be planted, the City's wetland consultant needs to inspect it,
and a legal description of the buffer area submitted to the City. Because the buffer will be
newly planted an escrow to guarantee its survival will probably required.
I remember having a conversation with you and Tony Hawkins about the buffer. Has it
been planted? Will you be able to plant it this season? Please let me know so I can do
what needs to be done to prepare for the CO.

Remarks:
Per section 78-1601 of the Wetland Ordinance the new home construction will
trigger wetland buffers and setback for the proposed project at 3768 North
Shore Drive. According to the submitted building plan one wetland has been
delineated within the property boundaries at 3768 North Shore Drive (Cty 19).
The wetland is classified as Preserve and requires a 50 foot upland buffer and
20 foot setback from the buffer. The survey appears to show a 25 foot buffer
on Lots 3, 4, and 5 and a larger buffer on lots 1 and 2. Although not formally
requested it appears the applicant may be proposing buffer flexibility as
described under 78-1608 (3)Noncoformities. This does not appear to be
appropriate because this is a proposed new structure and"nonconformities" as
described in the Wetland Ordinance require an existing structure to be present.
Buffer Condition and Requirements
A site evaluation was completed on 25 October 2007 to determine the
condition of the vegetation in the existing upland buffer. Currently a large
portion of the buffer is turf grass and the remainder of the buffer has been left
in a natural wooded condition. The wooded portion of the buffer currently
contains buckthorn. According to Division 3 sec. 78-1605 turf grass and
buckthorn are considered to be an undesirable plant species and should be
removed from the buffer area. After the turf is removed it is required to be
planted or seeded with native species.
The applicant will need to provide a Management/Landscaping plan that
includes the following:
1. Method proposed to be used to control buckthorn (MN DNR website
source for options). All buckthorn removal should be done using hand
tools as large equipment can further disrupt the wetland buffer. At a
minimum buckthorn should be cut and the remaining stems should be
treated with an approved herbicide following label instructions.
Treating the cut stumps will help prevent regrowth of the buckthorn.
2. Method of establishing native vegetation in turf areas (MN BWSR Web
Site—Publication: "Restoring & Managing Native Wetland and
Upland Vegetation" source for options).
3. Species proposed to be seeded or planted. According to the ordinance
Div. 3 Sec. 78-1605 (3)the seed mix must contain at least 12 pounds
(PLS)per acre of native prairie grass seed and 5 pounds (PLS)per acre
of native wildflower seed. The grass mixture must contain a minimum
of four species while the wildflower mixture must contain a minimum
of five species. (MN BWSR Web Site—Publication: "Restoring &
Managing Native Wetland and Upland Vegetation" source for options).
4. Schedule of activities that are part of the management and
establishment of vegetation.
Certificate of Survey Requirements
To be in compliance with the submittal requirements of the ordinance the
Certificate of Survey needs to be updated to reflect a 50 foot buffer and 20 foot
setback from buffer. As proposed the applicant would be required to get a
variance from the Wetland Ordinance.
Restriction and Covenant for Wetland and Buffer
Per Section 78-1611 of the wetland ordinance the owner shall record restriction
and covenants over the wetland and buffer with the property chain of title. A
form with the language for the Restriction and Covenants is available from the
City.
Recommendations
It is recommended that this application not be approved until issues presented
in this memo are addressed.

Thanks—both for checking and for the list. This is an old permit so we did not escrow for the buffer when it was issued.
How much should be have now, before we issue the certificate of occupancy?
I will put it on my calendar to write the Blairs after the holidays and explain the mowing and the other conditions. This is
their summer house. I'm thinking they contract with a lawn service and if they aren't told different, they would destroy
the buffer their first visit.

Hi Evelyn,
I reviewed the above referenced property on 11/10/09. The site restoration is complete and turf grass is installed and
the buffer has been seeded. The extent of the buffer seeded and protected is consistent with the ordinance
requirements. The seeding likely occurred late in the season because there was only sparse cover crop that has
developed. The applicant has provided erosion control blanket so there should be no erosion issues while they wait for
the native seed to develop. I would recommend that they mow the buffer twice next year at 6-inches in height to reduce
the competition from annual weeds and spot spray the thistle observed with round-up before it becomes an issue. I have
scheduled a compliance check for next July on my calendar to see how the buffer is developing and hopefully sign off on
compliance. This same note is provided on a summary table that I am using to help keep track of Wetland ordinance
compliance in the City (highlighted in yellow). I have attached the spread sheet in case you want to use it for your
records as well.

The landscape contractor changed the wetland buffer planting plan. I believe he contacted
�rou to ensure the seed mix he used was appropriate, but I need to confirm that.
He provided me with a copy of the receipt for the seed.
It was purchased from Prairie Restorations on 7/20/09:

Is this acceptable or do you need additional information?
