We hated to bother you at home, but we were nervous with surveyors walking around on our property. The survey team said that the boyfriend of the daughter of the next-door neighbor was interested in purchasing the Orono Fire Lane, west of our property line, and was ordering a survey with that in mind. Thank you Jay for telling us that the fire lane will remain the property of the City of Orono. I know that when we purchased our home we came to the City of Orono to inquire about the abandoned fire lane and learned that it would ALWAYS remain the property of The City of Orono. That is what we want. What we are asking is this: Can we have some written assurance that the Fire Lane will remain the property of the City of Orono? Should it be available for sale, would we have an equal chance to bid for it just as would the neighbor on the other side? Michael, is this assurance something you could send to us? We know you ar� very busy. W'e liatc to buthtr y�u witt► such a triviai item. But ;t was quite a big thing to hear that information from the survey crew. We are right now quite worried. The right-of-way adjacent to your property,which you refer to as a fire lane,was created and dedicated to the public as`Crystal Street' as part of the plat of"Shady- wood"in 1893. It retains its status as a 33'wide public right-of-way,and appears on County plat maps as an eastward extension of the south half North Shore Drive. The City does not have the right to sell this parcel to anyone.Because`Crystal Street'was dedicated to the public use from the plat of Shadywood,the only way it can become non-public is via a street vacation process,in which the City Council would have to conclude that the right-of-way serves no present or future public purpose. If the City vacated the right-of-way,it would by law revert back to the adjacent underlying owner from the plat in which it was originally dedicated,i.e.the ovmers of Lot 1,Block 1,Shadywood(the owners of 3705 North Shore Drive).In answer to your query as to whether you would have an equal opportunity to bid on the parcel, the answer is no. However,I can assure you that the City has no intent to vacate this right-of-way. I am enclosing an excerpt � from the Orono Community Management Plan which establishes that the existing and potential access points to Lake Minnetonka are very deaz,and even though they may have no current public uses,we cannot predict what public uses they may serve in the future. Transportation Plan LAKE ACCESS PRESERVATIONAND MANAGEMENT With more than 40 miles of Lake Minnetonka shoreline and nearly 5 miles of additional lake shorelines, Orono's lakes provide a significaat recreational resource for all Orono residents, not just for those who own property abutting the lakes. This value was long ago realized by the City fathers,as well as by eazly land developers. In order to provide lake access for the general public, as well as to provide for fire department access to the lake as a water source, a number of lake access corridors were created as the shoreland developed. T'hese typically are platted, dedicated right-of- ways leading from the local road system to the shoreline, and are commonly from 16' to 66' in width. The historic level of use of these right-of-ways (sometimes refened to as "fire lanes" or "lake access roads") ranges from minimal to year-round. Certain of these corridors have been maintained by the City for local swimming beaches or as winter snowmobile and ice-fishing accesses. Certain accesses are provided with docks for fishing, and some have ramp azeas suitable for launching a small boat. However, most do not have designated pazking available, and aze primarily intended to serve the neighborhood rather than the general public. A number of these access corridors have steep topography and experience a relatively low level of usage. The value of these corridors to the general public both now and in the future is too great to be measured. While an access corridor or fire lane may appear to an adj acent landowner as abandoned, there may well be a future public need for that corridor that may not be obvious today. The Minnesota Supreme Court in 1944 (Application of Baldwin, et al No. 33721 for vacation of a platted dedicated lake access road) upheld the value of retaining the public's right to access the lake. In an excerpt from the findings of the Court: "This court requires no proof that Lake Minnetonka ts a priceless heritage of the people of Mfnnesota, to be preseived and passed on to posterity. Judicial notice will be taken of theJact that tt is one of the most preclous jewels in the str�ieg ojTen Thousand Lakes of which Minnesota is so jusily proud.. Because of�ts wtde expanse and proximlty to our metropolitan areas, �t Ls much frequented and used for boating,,fTshing,picnicktng and bathtng - perhaps more tlian any other lake ln the state. Its sliore line of nearly 100 ntiles is dotted with permanent komes and summer cottages,not only at its wat¢rs edge,but extending far back from the shore. But the use of the lake is not conftned to dwellers on tts shore or nearby. During the summer season especiaUy, it 3s the mecca for thousands upon thousands of urbanites, noi so fortunate as to possess a lake ho►ne, who-young and old alike-seek its shores and wate�s for diverse recreational purposes. Transportation Plan lake population,however,the extent of lakesl�ore available to ihe public generally and the means of public access to the lake have diminished and therefore become increasingly valuable frorn year to year...we must not forget that ihe public includes persons other ihan those in the tmmediate viciniiy. The general public has a true concern in the recreationa[facilities offered by d:e[akes which nature has so freely given us tn this state. Their generous sharing by all wil[make for a healtl:ier and happier people. The many not fortunate enough to be able to acquire the advantages of ownership of lake shore properties should not be deprived ojthese benefrts. This we wnuld do if we permiued streets leading to the lakeshore to be vacated.. "The loss to the publlc of ISO feet of shorellne out of a total of approximately 100 miles may to the Baldwins seem inconsequential or even infrnitesimal and nothing to be disturbed about But,of thu 100 miles of preciaus shoreline, only a small fraction has been reserved joi the public; and if the courts should create a precedent by permitting a single inroad,however srnal�upon the public's share of the shoreline, other inroads wi[1 tnevitably jollow,until the aggregate becomes a rea!threat to the publlc's jree access to the lake. To avoid any possi6i[ity of such a result, tlie courts should witJz equal vlgor repulse the first, the second, and every other assault upon the public domain." Less than 1%of Orono's lake shoreline has been dedicated as public access corridors. Nearly all the rest is privately owned, and not available to the public for lake access purposes, save for the DNR Maxwell Bay Access, Heruiepin County's North Arm Access and the City's Summit Park on Long Lake. Hennepin County's Noerenberg Gardens Memorial Park, while abutting Lake Minnetonka,has deed restrictions that disallow use for docking or launching boats. With shoreland abutting a dozen separate bays in Lake Minnetonka, Orono has a commitment to maintaining access via the dedicated access corridors. Lake Access Policies It is the City's intent to permanently retain for public use all existing lake access corridors and fire lanes, regardless of the current level of use or maintenance. To this end,the City will follow these policies: 1. Requests for vacation of dedicated lake access right-of-ways will be denied in all cases except where equal or better lake access will be granted nearby in return. 2. The City will identify and take necessary action to preserve the public's right to use of any such accesses wluch exist but which may not have been formally dedicated. 3. The City will endeavor to work with property owners adj acent to lake access corridors to ensure that both the rights of the public and � the rights of the private landowner are upheld.
