Berg Trust (hereinafter the "Owner"), of the property located at 3669 North Shore Drive within the City of Orono (hereinafter the "City") and legally described as follows: Lot 3, Crystal Beach and Adjacent Abandoned County Road, Hennepin County, Minnesota(hereinafter the"property"); and WHEREAS, the Applicant has made application to the City of Orono for a variance to Orono Municipal Zoning Code Section 78-350 to allow a second-story addition to encroach 2.5' into the side yard where a 10' side yard setback is required and a 4.7' setback currently exists for the first story; and WHEREAS, the Applicant has made application to the City of Orono for a variance to Orono Municipal Zoning Code Section 78-1279(1) to allow a second story addition to be constructed with a 51.5' setback from the lake where 75' is required; and 78-1279(6) to allow a second-story addition to encroach up to 17' into the average lakeshore setback where no encroachment is permitted and the first-story currently encroaches up to 17' into the average lakeshore setback; and VVHEI�EAS, the Applicant has made application to the City of Orono for a variance to Orono Municipal Zoning Code Section 78-1288 to allow hardcover within the 0-7�' zone in the amount of 1,U46 s.f. (29.1%) where 0% is normally allowed and 1,129 s.f. (31.4°i�) currently exists and hardcover within the 75'-250' zone in the amount of 1,794 s.f. (76.7%) where 25% is normally allowed and 1,798 s.f. (76.9%) currently exists in conjunction with the second-story addition; and �'HERE 4S, the Applicant has made application to the City of Orono for a variance to Orono Municipal Zoning Code Section 78-1403 to allow a structural covera�e level in the amount of 2,042 s.f. where 1,500 s.f. is permitted and 1,935 s.f. currently exists in conjunction with the construction of the second-story. Page 1 of 5 �O� O 4 CITY of ORONO a � ti ��� �G~' R ESOLUTION OF TH T OUNCI L `�kE8H.04' NO. �� � � NOW, THEREFORE BE IT RESOLVED by the City Council of Orono, Minnesota: FINDINGS 1. This application was reviewed as Zoning File 07-3329. 2. The property is located in the LR-1C One Family Residential Zoning District which requires a minimum lot area of 0.5 acre and a minimum lot width of 100'. 3. The Planning Commission reviewed this application at public hearings held on November 19, 2007 and January 22, 2008 and recommended approval of variances based on the following findings: a. The property contains 5,925 s.f. (0.13 acre) in area and has 47' in width. b. The lot is substandard in area and a residence has existed on the property for many years. c. There is no additional land available to bring the ]ot width or lot area into conformity. d. The Applicant submitted a revised proposal following the direction given by the Planning Commission at the November 19, 2007 public hearing meeting. e. The hardcover variance request as revised reflects reductions in both the 0-75' and 7�'-?�U' zones. f. The 66 s.f. shed should be removed. g. The revised, proposed second-story complies with average ]alceshore, both side yard, and rear (street) yard setback requirements. The second-story is proposed to be setback 64' from the lake where a 75' setback is required. 4. The City Council has considered this application including the findings and recommendation of the Planning Commission, reports by City staff, comments by the Applicant and the public, and the effect of the proposed variance on the health, safety and welfare of the community. The City Council finds that the conditions existing on this property are peculiar to it and do not apply generally to other property in this zoning district; that granting the variance would not adversely affect traffic conditions, light, air nor pose a fire hazard or other danger to neighboring property; would not merely serve as a convenience to the Applicant, but is necessary to alleviate a demonstrable hardship or difficulty; is necessary to preserve a substantial property right of the Applicant; and would be in keeping with the spirit and intent of the Zoning Code and Comprehensive Plan of the City. CONCLUSIONS, ORDER AND CONDITIONS Based upon one or more of the above findings, the Orono City Council hereby grants a variance to Orono Municipal Zoning Code Section 78-1279(1) to allow the second-story to encroach 11' into the lake setback; and Section 78-1288 to allow hardcover within the 0-75' zone in the amount of 1,005 s.f. (28%) where 0% is normally allowed and 1,129 s.f. (31.4%) currently exists and hardcover within the 75'-250'. zone in the amount of 1,467 s.f. (62J%) where 25% is normally allowed and 1,798 s.f. (76.9%) currently exists in conjunction with the second-story addition; and grants a variance to Orono Municipal Zoning Code Section 78-1403 to allow a structural covera�e level in the amount of 1,976 s.f. where 1,�00 s.f. is normally allowed and 1,935 s.f. currently exists in order to pennit the construction of the second-story, subject to the following conditions: 1. Council approval is based on the elevation sketches and site plan submitted by the Applicant and annotated by City staff, attached to this Resolution as Exhibits A and B. Any amendments to the site plan which are not in conformity with City codes will require further Planninj Commission and City Council review. 2. Hardcover in thE 0-75' zone shal] not increase above the level of 1,005 s.f. (28%). Hardcover in the 75-250' zone shall be limited to 1,467 s.f. (62.7%) per the proposed plan and hardcover allowance summary as depicted on Exhibit A. Applicant is advised that any future requests to increase hardcover or change the nature of existii�;/approved hardcover shall require City approval, and increases in hardcover will not likely be approved without concui-rent reduction in existing hardcover. 3. Applicant shall remove all plastic or fabric liner material from the decorative landscape beds on the property to ensure their permeability as non-hardcover surfaces. 4. Required removals of structure and hardcover to be removed shall be completed prior to the framing inspection for the second-story addition. 6. An as-built survey verifying compliance with the approved building permit, �iardcover � removals and approved site plans shall be submitted prior to the Final Inspection for the addition. 7. Authorities granted by this resolution run with the property not with the Applicant, but are permissive only and must be exercised by obtaining a building permit for the new construction within one year of the date of Council approval, or the variance will expire on that date(February 11, 2009). 8. Violation of or non-compliance with any of the terms and conditions of this resolution shall constitute a violation of the zoning code, shall automatically terminate any authority granted herein, and shall be punishable as a misdemeanor. 9. The undersigned Applicant has read, understood and hereby agrees to the terms of this resolution and on behalf of the Applicant and the Applicant's heirs, successors and assigns, hereby .agrees to the recording of this resolution in the chain of title of the property.
