Dear Melanie,
As requested, we have completed an engineering review of the documents submitted for the above
referenced project. Our current review is based on the following submittal items:
• Building Permit Application, dated 6/13/14
• Grading Plan prepared by Kemper&Associates, dated 3/7/14
• Building Plans and Elevations prepared by John Bradley, dated 6/5/14
• City Council Resolution granting approval of variances and CUP
We offer the following observations,comments, and recommendations for your consideration:
1. Perimeter silt fence should be installed and inspected by the City prior to any land disturbing activity.
The Contractor must provide 24 hour notice prior to inspection.
2. A rock construction entrance should be installed at the entrance to the site to limit tracking of
sediment off-site. The entrance should be installed prior to any land disturbing activity.
3. The 12" spruce tree on the southwest corner of the building may interfere with the proposed swale
directing runoff from the front of the residence to the lake. The tree may have to be removed or the
swale slightly relocated to ensure a proper drainage way is provided. This work should be
coordinated in the field with the City Engineer.
4. A financial security of$2,000 from the Applicant is recommended for erosion control and
engineering oversight. The financial security is intended to provide protection in the event that it
becomes necessary for the City to install or maintain erosion and sediment control within the project
area and covers the cost of vegetation re-establishment if the applicant is unable to follow through
with the conditions of approval.
5. The applicant will be required to obtain Minnehaha Creek Watershed District(MCWD) approval and
permitting for their Erosion Control Rule. A copy of any approvals or permits required should be
submitted prior to any work.

TEMPORARY CERTIFICATE OF OCCUPANCY
ESCROW AGREEMENT

AGREEMENT made this t� day of �� � , 20��by and between the CITY OF
ORONO, a Minnesota municipal corporation ("City") and AI & Donna Hagen ("Owners").
Recitals
1. Construction of the new residence located at 3655 North Shore Drive the ("Subject
Property"), legally described, see attachment Exhibit A in Orono, Hennepin County
Minnesota, is the subject of building permit application number 2014-00603 has been
completed.
2. Winter conditions currently prohibit completion of exterior improvements, final grading,
and vegetation establishment. An as-built survey cannot be accurately conducted at this
time.
3. Owners request the City issue a temporary certificate of occupancy ("TCO") to the
Owners so that the Owners may occupy the new residence.
4. The City will issue a TCO only if the Owners establish an escrow to ensure completion of
exterior improvements, continuation of erosion control and submittal of an as-built survey
to the City.
NOW THEREFORE,THE PARTIES AGREE AS FOLLOWS:
1. DEPOSIT OF ESCROW FUNDS. Contemporaneously with the execution of this Escrow
Agreement, the Owners shall deposit $10,000 with the City. All accrued interest, if any, shall be paid to
the City to reimburse the City for its cost in administering the escrow account.
2. PURPOSE OF ESCROW. The purpose of the escrow is to assure completion of any
exterior improvements, final grading, establishment of vegetation as well as guarantee reimbursement to
the City for all out-of-pocket costs the City has incurred (including planning, engineering, in excess of
$500, or legal consultant review) or will incur in reviewing the plan. Eligible expenses shall be consistent
with expenses the Owners would be responsible for under a building permit application. The escrow will
also guarantee reimbursement to the City for all out-of-pocket costs the City has incurred to assure that
the work is completed in accordance with the Stormwater Pollution Prevention Plan and the provisions of
Orono City Code Chapter 79. The financial security may also be used by the City to eliminate any
hazardous conditions associated with the work and to repair any damage to public property or
infrastructure that is caused by the work (including planning, engineering, or legal consultant review)
associated with building permit #2014-00603 if compliance with the approved building permit is not
accomplished.
3. MONTHLY BILLING. As the City receives consultant bills for incurred costs, the City will
in turn send a bill to the Owners. Owners shall be responsible for payment to the City within 30 days of
the Owners' receipt of bitl.
4. DISBURSEMENT FROM ESCROW ACCOUNT. In the event that the Owners do not make
payment to the City within the timeframe outlined in#3 above, shall issue a Stop Work Order until the Owners
pay all expenses invoiced pursuant to#3. The City may draw from the escrow account without further approval
of the Owners to reimburse the City for eligible expenses the City has incurred.
5. CLOSING ESCROW. The Balance on deposit in the escrow, if any, shall be returned to
the Owners when all requirements related to the project are complete. City Staff shall review the terms of
this escrow agreement two times per year to determine whether the requirements of the project have
been successfully completed and whether it is appropriate to return the funds. Owner may also request
the release of the funds, and such funds shall be released upon City Staff receiving the appropriate
verification that all requirements of the project have been successfully completed.

6. CERTIFY UNPAID CHARGES. If the project is abandoned by Owners, or if the eligible
expenses incurred by the City exceed the amount in escrow, the City shall have the right to certify the
unpaid balance to the subject property pursuant to Minn. Stat. §§415.01 and 366.012.
7. ACCESS TO SUBJECT PROPERTY. The Owners hereby grant to the City, its agents,
employees, officers and contractors, the right to enter upon the subject property for the specific purpose
of inspecting and completing any exterior improvements, final grading, establishment of vegetation and
the restoration of the subject property should the Owners not complete the work by the specified dates.

NOW THEREFORE,THE PARTIES AGREE AS FOLLOWS:
1. DEPOSIT OF ESCRO F N�. Contemporaneously with the execution of this Escrow
Rgreement, the Owners shall deposit$ ��� with the City. All accrued interest, if any, shall be paid to the
-City to reimburse the City for its cost in administering the escrow account.
2. PURPOSE OF ESCROW. The purpose of the escrow is to guarantee reimbursement to the City
for all out-of-pocket costs the City has incurred (including planning, engineering, or legal consultant review) or will
incur in meeting with th wners, viewmg the plans, and preparing agenda packet material for City Council
review of application #� - �. Eligible expenses shall be consistent with expenses the Owners
would be responsible for under a land use application.
3. MONTHLY BILLING. As the City receives consultant bills for incurred costs, the City will in turn
send a bill to the Owners. Owners shall be responsible for payment to the City within 30 days of the Owners'
receipt of bill.
4. DISBURSEMENT FROM ESCROW ACCOUNT. In the event that the Owners do not make
payment to the City within the timeframe outlined in #3 above, shall cease all reviews until the Owners pay all
expenses invoiced pursuant to #3. The City may draw from the escrow account without further approval of the
Owners to reimburse the City for eligible expenses the City has incurred.
5. CLOSING ESCROW. The Balance on deposit in the escrow, if any, shall be returned to the
Owners when the review has been completed.
6. CERTIFY UNPAID CHARGES. If the project is abandoned by Owners, or if the eligible expenses
incurred by the City exceed the amount in escrow, the City shall have the right to certify the unpaid balance to the
subject property pursuant to inn. Stat. §§415.01 and 366.012.
