Re: Deck Construction
Dear Mr. Doitch:
On Apri124, 1998 this office notified you of the requirement for a building permit to construct decks
in the City of Orono. You were also notified of zoning violations with the deck. Since that
notification, the deck was storm damaged and repaired again without building permits.
Therefore, the City must require you to remove the deck or file a variance application to see if the
City Council would grant variances to a11ow you to keep it. A deadline of November 30, 1998 has
been established for removal or submittal. If you have any questions, please feel free to contact me
at my office.

Dear Ms. Sallas:
This letter is regarding a roof-top deck which was constructed by the previous owner of
your property at 3635 North Shore Drive. The previous owner was notified, by the
attached letter from City staff and during numerous subsequent conversations over a long
period of time that the subject deck was constructed in violation of City Codes and
without a building peiniit.
This letter is your official notification that the deck remains in violation of City Codes.
The City requires that the deck be removed ar a variance must be obtained in order bring
the property into compliance. A variance application is enclosed and a meeting with City
staff is required prior to submittal. Please remove the deck or complete the application
and schedule a meeting with me prior to December 13, 2004 to avoid legal action by the
City.

Dear Ms. Curtis:
This office represents Catherine M. Sallas, the owner of 3635 North Shore Drive. This
letter is in response to yours of October 28 to Ms. Sallas wherein you notified her that a deck
constructed by a previous owner on the property she now owns is in violation of city codes. You
had enclosed a copy of a letter to the previous owner informing that owner of the necessity for a
building permit and that there were "zoning violations with the deck." In neither letter, however,
are the specific code and/or zoning violations specified.
I stopped by your office last week to review the file. Other than the permit record and
copies of permits and the communication with the former owner, I found no reference to
notification of specific building code or zoning violations.
In order for us to fully evaluate the variance procedure which is an apparent option for
our client, would you please provide me with information concerning specific violations of the
zoning and/or building code(s)? We want to fully evaluate all options before proceeding.
I look forward to receiving the requested information and to scheduling a meeting as you
proposed in your October 281etter.

Hello Lyle,
I may have misunderstood or am confused, but I was under the impression from our
conversation a couple of weeks ago that there was a possibility of us (Olson's at 3645
North Shore Drive) , receiving notification of a variance for 3635.
Here's my concern: we are obviously VERY much opposed to their invasive deck remaining on
the property and feel the sooner it can be dealt with, the better for all parties
concerned (Mark Welch at 3625 is also opposed to the deck) . Kathy (the owner of 3635) is
working night and day on the property and after talking with her, it's not clear if she's
going to rent out the property or sell it.
I 'm assuming no one wants the complication of this property changing hands again with an
"out of code" deck. Please let me know the City of Orono's plan and what, if any, help you
need.

Dear Ms. Sallas:
This letter is to follow up a meeting held at the City offices on December 15, 2004
regarding a roof-top deck on your property at 3635 North Shore Drive in violation of City
Codes. It was my understanding that as a result of the above mentioned meeting you
would file a request for after-the-fact average lakeshore setback and lake setback
variances for the deck. The deadline of January 19, 2005 for submittal of an application
for the February 22"d Planning Commission meeting has passed.
To date, the deck remains in violation of City Code Sections 78-1279(1) and (6). The
City requires that the deck be removed or a variance must be obtained in order bring the
property into compliance. Please remove the deck or submit a variance application no
later than 12:00 noon on February 23, 2005 to avoid legal action by the City.
