This fire access road services more than two residential structures, therefore the requirernents of section 503 of the Minnesota State Fire Code shall apply. (Enclosed) The following items should be addressed to meet requirements of the state fire code. A- "No Parking Fire Lane" Signs should be installed along the north side of the access road. B- The tree overhanging the access road should be trimmed back to give more width to the access road. The tree is located on the NW corner of the 3605 lot. G The entrance width to this access road off of North Shore Drive seems to be the major pinch-point accessing these residences. Fire department vehicles coming from the west will be required to do a U-turn onto the access road. If the entrance is widened by 5 feet this would reduce this problem. If these items are addressed, I can accept the 19 foot roadway width from the corner of the garage at the 3605 North Shore Drive residence as shown on the submitted plan layout. It is my understanding that a single home currently exists on Lots 11 and 12 and that Lot 10 is in the process of being rebuilt and has recently received all of the zoning approvals to go forward with that project. As Lot 10 was being reviewed by staff during the zoning application process, the Fire Marshall noted that the road serving this house should be widened. It is my understanding that in fact the road on Lot 10 was widened to a satisfactory width for the Fire Marshall. The issue that has now arisen is that the portion of the road on Lots 11 and 12 is approximately 12 feet in width. Understandably, the Fire Marshall pointed out that the fire code requires a street width of 20 feet and suggested that, as part of the project for Lot 10, the road covering Lots 11 and 12 should be widened. In reviewing the legal descriptions that have been provided to us regarding the width of the road on Lots 11 and 12, it appears that the road is currently as wide as it can get with the existing easements. I am seeking guidance from you at this point as to how you would like our office to proceed with this matter. I believe there are a number of issues that should be addressed before making this decision. 1. The recorded easements state that the road on Lots 11 and 12 is 12 feet wide. While some of the surveys indicate that there may be additional room to shift the road to the south,the City would not be able to do this without conducting further surveys to determine where the true location of the road was meant to be. - - 2. Widening the road on Lots 11 and 12 will impact how close that road is to the existing structures on Lots 11 and 12 in an area where the road is already very close to the buildings. Without an additional easement, the City would be left to negotiate the purchase of additional right-of-way on Lots 11 and 12 or would have to condemn that road right-of-way. I raise these points because it is my understanding that the variance that was issued to Lot 10 was conditioned upon staff attempting to widen the road right-of-way that exists on Lots 11 and 12. It is my opinion that as things stand with the current approvals,there is no way to make the property owner of Lot 10 pay for the costs associated with widening the road on Lots 11 and 12. It will be up to the City to incur the costs to widen the road on Lots 11 and 12. Upon reviewing this correspondence, please feel free to contact me as to what the next course of action should be.
